Rd. 241 Member Bruce Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-08 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ANDREA EDMUNDSON AND STEVEN COX FOR AN ACCESSORY STRUCTURE AT 3125 CO. RD. 24 WHEREAS, Andrea Edmundson and Steven Cox (the "Applicants") are the fee owners of the property located at 3125 Co. Rd. 24, in Medina, which land is legally described on Exhibit A attached hereto ("the Property"); and WHEREAS, the Property is zoned Rural Residential ("RR") and contains 13.87 acres; and WHEREAS, Section 825.19, Subd. 3 of the Medina code of ordinances requires a conditional use permit for more than two accessory buildings or an aggregate of more than 3,000 square feet of accessory buildings on lots larger than 5 acres in the RRdistrict; and WHEREAS, the Applicants have applied to construct a barn containing 15,700 sq. ft.; and WHEREAS, this matter was reviewed by the planning commission at its meeting on January 8, 2002 and by the city council at its meeting on January 15, 2002. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that a conditional use permit be granted to the Applicants allowing them to construct a 15,700 sq. ft. barn on the Property, subject to the following terms and conditions: 1. The barn may not exceed 15,700 square feet in size; 2. The number of adult horses owned by the Applicants and maintained on the Property may not exceed 12 plus a maximum of 2 foals up to two years of age; RHB-208999vI 02-08 ME230-330 February 5, 2002 2 3. There shall be no commercial use of the Property for horse boarding or lessons; 4. Erosion control methods as shown on the plans and specifications approved by the City must be installed before work is started and orange silt fencing shall be used on all of the north side of the structure; 5. All conditions of the city engineer must be met; 6. The building location must be surveyed on site; 7. The Applicants must install landscaping in accordance with the plan approved by the city staff; 8. No building permits shall be issued until the Applicants demonstrate in writing compliance with the requirements of the Minnehaha Creek Watershed District, Hennepin Conservation District, Minnesota Pollution Control Agency and the Department of Natural Resources; 9. The Applicants must store and dispose of manure in compliance with all applicable local and state regulations, including those of the Minnesota Pollution Control Agency, whichever is more restrictive; 10. All exterior lighting must be shoe box style, designed and constructed so that the globe is recessed and open only on the bottom and no light is cast directly on any adjacent property or any offsite roadway; 11. There shall be no exterior lighting on the north or west sides of the barn; 12. Hay and equipment must be stored inside the barn; 13. The barn must have a shingled roof to match the existing house and the steel siding must be earth tone in color with a minimum 18" overhang, gable to eave; 14. The Applicants must submit to the city a survey or site plan which delineates the wetlands on the Property; and 15. The Applicants must pay a fee to the city in the amount determined by staff to represent the actual cost to the city of reviewing this conditional use permit.
