HomeMy Public PortalAbout2002-010 Resolution Granting Final Plat Approval of Bennis LakeviewMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-10 RESOLUTION GRANTING FINAL PLAT APPROVAL OF BENNIS LAKEVIEW WHEREAS, Daniel Bennis/Bennis Investment Properties, LLC (the "Applicant') is the fee owner of property located at the southwest intersection of Holy Name Drive and Lakeview Road (the "Property"); and WHEREAS, the Applicant intends to plat the Property by combining three lots into two; and WHEREAS, the city council has previously granted preliminary approval of the plat; and WHEREAS, the Applicant has requested final approval of the plat of Bennis Lakeview, which plat has been reviewed by city staff for compliance with city ordinances and the terms of preliminary plat approval. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that final plat approval is hereby granted to the Applicant for Bennis Lakeview, subject to the following terms and conditions: 1. The Applicant is required to connect the existing house on lot 1 to sanitary sewer within one year of the date of final plat approval; 2. When a new house is constructed on lot 2 it must be built in compliance with all required setbacks; 3. The existing shed on lot 1 is acknowledged to be an existing non -conformity because of the side yard setback; 4. The existing garage on lot 2 is acknowledged to be an existing non -conformity RHB-203531v1 ME230-326 1 02-10 February 5, 2002 because of the front yard setback; 5. The Applicant must pay to the city an administrative fee in an amount necessary to reimburse the city for the cost of reviewing this application; and 6. The final plat must be filed with Hennepin County within 60 days of the date of this resolution or the approval hereby granted shall be null and void. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina that variances are hereby granted in connection with approval of the plat of Bennis Lakeview to permit both lot 1 and lot 2 to have less than five acres of contiguous soils suitable for a standard on -site sewage disposal system. The variances are justified because, although the Property is zoned rural residential, it is served by sanitary sewer.
