HomeMy Public PortalAbout2002-014 Resolution Granting Setback Variance to Anthony Patterson for a House Addition at 1912 Highcrest DriveMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-14 RESOLUTION GRANTING SETBACK VARIANCE TO ANTHONY PATTERSON FOR A HOUSE ADDITION AT 1912 HIGHCREST DRIVE WHEREAS, Anthony Patterson (the "Applicant") is the fee owner of property located at 1912 Highcrest Drive (the "Property"); and WHEREAS, the Property contains a sunroom which was constructed pursuant to a sideyard setback variance granted in 1981; and WHEREAS, the Applicant wishes to convert the sunroom to living space and to add a room immediately above the sunroom on the second floor of the house; and WHEREAS, the proposed second floor addition would also encroach into the minimum side yard setback and requires a second variance; and WHEREAS, this matter was reviewed by the planning commission on February 12, 2002 and by the city council on February 19, 2002; and WHEREAS, it has been determined that granting a setback variance to permit construction of the requested addition is in keeping with neighborhood standards and will not allow a reduction in setback any greater than already permitted on the Property. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a variance be granted to the Applicant to reduce the required side yard setback on the Property from 20' to 15' in order to convert the first floor sunroom and add living space immediately above, subject to the following terms and conditions: RHB-210788v 1 ME230-8 1 02-14 March 6, 2002 1. The additions must be constructed in substantial compliance with the plans and specifications presented to and reviewed by the planning commission and city council; 2. The Applicant must comply with all building code and other ordinance requirements in constructing the additions; and 3. The Applicant must complete construction within one year of the date of this resolution or the approval hereby granted will be null and void. BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that the setback variance hereby granted to the Applicant is in compliance with the neighborhood standards and that a hardship is present due to the placement of the existing house on the Property and the topography of the lot.
