CALL TO ORDER: Mayor Swain called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, September 4, 1984, in the Council Chamber of the City Hall. 2. The invocation was given by Acting City Manager Shaw. 3. The Pledge of Allegiance to the Flag was led by Mayor Swain. 4 ROLL CALL: Present: Councilmen - Atkins, Dennis, Gillanders, Tyrell, Swain Absent: Councilmen -None Also Present: Acting City Manager Shaw, City Attorney Martin, Parks & Recreation Director Kobett, Public Works Coordinator Peterson, and Judy Cook, Temple City Times. Councilman Tyrell moved to approve the absence of City Manager Koski, seconded by Councilman Gillanders and unanimously carried. Councilman Gillanders introduced visitors from Hawkesbury Shire, Australia. Mrs. Yvonne Wheland and her two sons, Craig and Chris, are in the U.S. to participate in the water ski competition. Mrs. Wheland presented a gift book to Mayor Swain and a letter of intro- duction from Hawkesbury. CONSENT CALENDAR: Councilman Tyrell moved to approve Items A through F on the Consent Calendar as recommended, seconded by Councilman Atkins and unanimously carried. A. APPROVAL OF MINUTES - Regular Meeting of August 21, 1984. Approved as written. B. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF AUGUST 28, 1984: (1) PROPERTY NUISANCE CASE 84 -118 (5561 Sultana Avenue) Adopted Resolution No. 84 -2303 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF. (2) SET PUBLIC HEARING: TENTATIVE TRACT NO. 43195 AND CONDITIONAL USE PERMIT 84-721 (4456 -4504 Temple City Boulevard) Set public hearing for September 18, 1984, to consider approval of subject tract. (3) PLANNING COMMISSION ACTION Received and filed memo from Planning Commission relating to action taken at their regular meeting held August 28, 1984. C. ACCEPTANCE OF BID: FY 1984/85 CHIP AND SLURRY SEAL PROGRAM Accepted low bid from Engineering Corporation of North America in the amount of $97,774.44 for the FY 1984 -85 Chip and Slurry Seal Program and authorized the Mayor and City Clerk to sign the. RESOLUTION NO. 84 -2300: SB 821 FUNDS - PEDESTRIAN FACILITIES FOR FISCAL YEAR 1984/85 Adopted Resolution No. 84 -2300 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS AUTHORIZED UNDER SB 821 AND APPROVING THE ADOPTION OF ITS SIDEWALK IMPROVEMENT PROGRAM. E. RESOLUTION NO. 84 -2301: EMPLOYMENT OF PERSONNEL Adopted Resolution NO. 84 -2301 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. F. RESOLUTION NO: 84 -2302: WARRANTS AND DEMANDS Adopted Resolution No. 84 -2302 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $135,919.23 DEMAND NOS. 8311 THRU 8378. 6. UNFINISHED BUSINESS: A. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF JULY 5, 1984: TRAFFIC SIGNAL STUDY - TEMPLE CITY BOULEVARD AND WOODRUFF AVENUE Acting City Manager Shaw presented background information stating City Council at their regular meeting held on July 17 reviewed the traffic signal study for the subject intersection and requested cost informa- tion on a pedestrian actuated signal light. Signal Maintenance, Inc. estimates costs for a. semi - actuated traffic signal are approximately $35,000 to $40,000 excluding design and inspection costs. The Los Angeles County Road Department has quoted a total cost which includes design, installation and inspection of $73,000. The Traffic Couuuission concurred that warrants and justification for a traffic signal at this intersection do not exist and recommends one parallel parking stall be removed and replaced with 19 feet of additional red curb for increase visibility at the intersection. Councilman Gillanders stated he recognized that it is a large,sum of money but it should not be measured against what a life is worth. There has been an ongoing problem at that intersection and, although it does not meet the necessary criteria of the Traffic Commission, he does not know what can be done to solve the problem other than to put in a signal. Councilman Tyrell stated the warrant criteria which are set up by the Traffic Commission are not the only things to consider. This particu- lar intersection is frequented by elderly pedestrians going to the market; has been an ongoing problem for years; it is hazardous for the elderly to cross the street; and felt the installation of such a signal was warranted. Councilman Atkins concurred with the Traffic Couuuission in that there is not sufficient pedestrian traffic to warrant a signal light; felt that far greater hazards exist at busy traffic signal intersections which are not working properly and people are driving and walking across congested traffic intersections; if an expenditure was to be made, it would be of greater benefit to fix the unreliable signals. Additionally, he stated the signal light may not solve the problem which, he felt, was jaywalking. Councilman Dennis agreed with Councilman Atkins; felt there were sever intersections within the community that are comparable to this one; th.. type of pedestrian may be a little different but did not justify the installation of a signal light. He agreed with Councilman Gillanders in that the cost of installation cannot be measured against what a life is worth, but felt that the apparent disregard for basic traffic pedestrian regulations would not be corrected by a signalized inter- section. 1 1 I9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Carlos Christie, 9074 E. Fairview, San Gabriel, stated he had opened an automotive repair shop at 9415 Las Tunas Drive and was informed by staff that the zoning was C -2 which permits an automotive repair shop but only with approval of a conditional use permit; the cost of the non- refundable filing fee application is $300; also needed were 10 copies of an engineer's plot plan; was further informed that in all likelihood the conditional use permit would not be approved since it appeared that he had insufficient parking spaces; and was requesting a temporary permit for two to three months until he could get re- established in another area. Council Minutes, September 4, 1984 age 3 Mayor Swain stated she hasy'done busines ;s in that area for a number of years and watched the-'p eople crossing the'street with difficulty. She has seen people actually stop cars to help pedestrians cross the street. There are a great number of small apartments in that area where a lot of elderly residents live and she would be in favor of a pedestrian actuated signal on the south side of the intersection. Councilman Gillanders inquired if Prop "A" funds could be utilized and staff was instructed to investigate that possibility. Councilman Dennis stated if the signal lights were to be installed he would recommend that they be traffic actuated since the cost is similar and the same type of people drive who cross the intersection. Councilman Tyrell moved to approve the installation of traffic signals at the intersection of Temple City Boulevard and Woodruff Avenue, seconded by Councilman Gillanders and carried on a roll call vote. C. ORDINANCE NO. 84 -552 RELATING TO PARK RULES AND REGULATIONS City Attorney Martin introduced Ordinance No. 84 -552 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING SECTION 3589 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO PARK RULES AND REGULATIONS for first reading by title only. Councilman Tyrell moved to waive further reading, seconded by Councilman Dennis and unanimously carried. 7. NEW BUSINESS: None. 8 COMMUNCATIONS: A. COUNTY REGISTRAR - RECORDER: REQUEST TO USE CITY HALL AS. CHECK -IN- CENTER ON NOVEMBER 6, 1984, FOR STATEWIDE GENERAL ELECTION Councilman Tyrell moved to approve use of City Hall as check -in center for the November 6, 1984, general election, seconded by Councilman Gillanders and unanimously carried. B. COUNTY REGISTRAR - RECORDER: REQUEST TO USE LIVE OAK PARK FACILITIES AS POLLING PLACE FOR NOVEMBER 6, 1984, STATEWIDE GENERAL ELECTION Councilman Gillanders moved to approve request from Registrar of Voters to use Live Oak Park for two polling places for the November 6, 1984, general election, seconded by Councilman Dennis and unanimously 'carried. Council Minutes, September 4, 1984 - Page 4 Mayor Swain stated the City does have an ordinance that states he does need to have a CUP to operate this type of business in this particular area of the City; the application must be made to the Planning Cohuuission; they will investigate, hold a hearing, and make the decision as to whether this business could operate and under what conditions; the drawings do not have to be done by an engineer, they could be done by himself or anyone who could produce a reasonably good plot plan; and if the Planning Commission denies his CUP then he could appeal to the City Council. Mr. Christie presented photos of a gas station on Las Tunas which showed that sections of the Zoning Code were being violated; that the station had insufficient parking spaces, and that he had filed a com- plaint with the City. Mayor Swain responded that if the complaint has been filed, it will be investigated and action will be taken. However, Council could not grant him a temporary permit; by law it had to go through the Planning Commission. Councilman Tyrell suggested since Mr. Christie has an attorney and there appeared to be a language barrier problem, in order to avoid any misunderstandings, it might be advisable if Mr. Christie's attorney contact the Planning Director to ensure a thorough understanding of the necessary procedure. RECESS TO CRA: At this time Council recessed to meet as the Community Redevelopment Agency; approved the minutes of the regular meeting of August 21, 1984; and adopted resolution approving warrants and demands. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. CLAIM FOR DAMAGES: BRAD T. PARKER Received claim for damages, denied and referred to JPIA. B. Mayor Swain stated the Granada Hotel in Arcadia is being considered for the Friday night banquet in connection with the City's 25th anniversary. The banquet room can accommodate 200 to 300 guests and would be very suitable for overnight accommodations as well. However, they do require a $400 deposit at this time. Councilman Gillanders moved to approve the $400 deposit expenditure to the Granada Hotel for the 25th Anniversary, seconded by Council- man Tyrell and unanimously carried. C. Councilman Tyrell stated Deputy Lloyd Brooks, 5603 Cambury Avenue, Temple City, assigned to East Los Angeles Station, was fatally in- jured in a traffic incident on September 1, 1984, while directing traffic at the scene of an accident in the San Gabriel Canyon arc He is survived by his wife Charlene, and two adult daughters. 12. ADJOURNMENT: Councilman Tyrell moved that Council terminate proceed- ings and adjourn the meeting in honor of Deputy Brooks. Meeting adjourned at 8:15 p.m. Next regular meeting of the City Council will be held Tuesday, September 18, 1984, 7:30 p.m. in the Council Chamber of the City Hall.
