HomeMy Public PortalAbout1986-10-28 Regular Meeting1 COUNCIL MINUTES OCTOBER 28, 1986 The regular monthly meeting of the Bal Harbour Village Council was held on Tuesday morning, October 28, 1986 at 9:30 A.M. in the Village Hall. The meeting was called to order by Assistant Mayor Sol Taplin and the roll was called. Morris Approval of Minutes: A motion to approve the minutes of the September 30, 1986 regular meeting was made by Mrs. Antiles and seconded by Mr. McKeehan. As there were no changes or additions, the motion carried unanimously (4-0). Presentations: Asst. Mayor Taplin called upon Chief Baquero who recognized Police Office Clifford Wardlow. Through thorough investigative efforts, Wardlow made numerous arrests during the month of September. As such, Wardlow was selected as Officer of the Month for September 1986. The Chief presented Wardlow with a certificate in honor of his achievement and Councilwoman Antiles presented him with a check from the Village in the amount of $100 as further recognition of his achievement. Officer Wardlow was then congratulated by the other Council members. Public Hearing - Board of Equalization: Asst. Mayor Taplin then explained that the Council, serving as a Board of Equalization, was to hear complaints re- garding the security district assessment roll. The public hearing was then opened for anyone desiring to speak. As no one came forward , the public hearing was closed. Later in this meeting, upon recommendation from the Village Attorney, Resolution 320 was passed adopting the Security District assessment roll. Ordinances - Second Reading - Public Hearing: The proposed ordinance was read in full by the Village Clerk. Building Official, George Desharnais explained that severalchanges had been incorporated into the ordinance since its first reading. These changes are as follows: Section 3.5-8C - amended such that in the ocean front and business district, no boundary wall or fence shall exceed centerline adjoining the street. As no one desired to speak the public hearing was closed. A motion to incorporate the amendments into the ordinance was made by Mr. McKeehan and seconded by Mrs. Antiles. There being no discussion, the motion was passed unanimously (4-0). A motion to adopt the ordinance was then offered by Mr. McKeehan and seconded by Mrs. Antiles. There being no discussion, the motion passed unanimously (4-0) becoming: ORDINANCE 297 ORDINANCE OF BAL HARBOUR VILLAGE AMENDING APPENDIX A, SECTION 3-2(K) TO INCLUDE CANVAS STRUCTURES IN THE DEFINITION OF CARPORT; ADDING SECTION 3-2 (K) (1. -A) TO PROVIDE A DEFINITION FOR MECHANICAL EQUIP— MENT; AMENDING APPENDIX A, SECTION 5-4 TO EXCLUDE MECHANICAL EQUIPMENT FROM REQUIRED SETBACKS; AMENDING APPENDIX A, SECTION 5-5 (c) TO PROVIDE ADDITIONAL REQUIREMENTS FOR CARPORTS; AMENDING APPENDIX A, SECTION 5-8 (a) TO LOWER THE MAXIMUM HEIGHT OF WALLS AND FENCES IN RESIDENTIAL, PRIVATE CLUB AND MULTIPLE FAMILY DISTRICTS FROM SIX FEET TO FIVE FEET. AMENDING APPENDIX A, SECTION 6-1 TO AMEND THE DEFINITION OF BUILDING HEIGHT TO INCLUDE A THIRTY FOOT MAXIMUM HEIGHT AND TO INCLUDE A MAX- IMUM LOT COVERAGE; AMENDING APPENDIX A, SECTION 7-7 (f) TO REQUIRE LANDSCAPING PLANS TO BE PREPARED BY PERSONS AUTHORIZED UNDER FLORIDA STATUES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE. Ordinances - First Reading: A proposed ordinance further amending the zoning code was then read by title by the Village Clerk. A motion to approve the ordinance was made by Mr. McKeehan and seconded by Mrs. Antiles. There being no discussion, the motion passed uanaimously (4-0) on first reading ORDINANCE OF BAL HARBOUR VILLAGE AMENDING APPENDIX A, SECTIONS 6-1 (g) and 6-2 (g) OF THE BAL HARBOUR VILLAGE CODE TO PROVIDE SIDE SETBACK REQUIRMENTS; AMENDING APPENDIX A, SECTIONS 6-10 (e) TO LIMIT VEHICULAR ACCESS TO AND FROM THE BUSINESS DISTRICT; PRO- VIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE. An ordinance prepared per Council's instructions 1986 meeting, repealing Village Ordinance No. 278 was Village Clerk. A motion to approve the ordinance on fi by Mrs, Antiles and seconded by Mr. McKeehan. There be motion passed unanimously (4-0) at the September 30, read by title by the rst reading was ing no discussion, the ORDINANCE OF BAL HARBOUR VILLAGE REPEALING ORDINANCE NO. 278 WHICH REQUIRES PUBLIC LODGING ESTABLISHMENTS TO INSTALL SMOKE DETECTION SYSTEMS IN ACCORDANCE WITH ORDINANCE NO. 275; PROVIDING FOR SEVER - ABILITY AND AN EFFECTIVE DATE. An ordinance adding additional persons to the Pension Committee was presented for consideration. Village Manager Louise K. Miller explained that the composition of the Pension Committee was being changed in accordance with State requirements. The police officers have already held an election and elected Glen Grundy to represent them on the Committee. General employees would be involved in a similar process to select their representative. As this ordinance was presented for first reading, it was read by title by the Village Clerk. A motion to approve the ordinance was made by Mrs. Antiles and seconded by Mr. Laikin.There being no further discussion, the motion passed unanimously (4-0) ORDINANCE OF BAL HARBOUR VILLAGE AMENDING SECTION 13-25 (1) TO PRO- VIDE FOR ELECTION OF ONE POLICE OFFICER AND ONE GENERAL EMPLOYEE TO THE PENSION COMMITTEE; PROVIDING FOR SEVERABILITY, INCLUSION IN THE October 28, 1986 3 CODE AND AN EFFECTIVE DATE. Resolutions: Village Attorney Weiss advised that it would be ap- propriate for the Council to pass a resolution adopting the security district assessment roll. A motion to this effect was made by Mr. McKeehan and seconded by Mrs. Antiles. There being no discussion, the motion passed unanimously (4-0). Resolution 320 RESOLUTION OF BAL HARBOUR VILLAGE ADOPTING ASSESSMENT ROLL FOR THE SECURITY DISTRICT; PROVIDING FOR AN EFFECTIVE DATE. Reports and Recommendations: Village Attorney Weiss reported that plans for the mini -park are underway and that the required documents were currently being reviewed by the State Department of Transportation. Mr. Weiss also noted that letters had been sent out to those few residents who had still not remitted their security district assessment for 1985-86. Asst. Mayor Sol Taplin announced that construction of the beachfront jogging path had begun. A sample area near the Sheraton has been completed. Mr. Taplin invited residents to visit the site and see the path. Upon com- pletion, this jogging path should be among the most beautiful anywhere. Mr. McKeehan expressed concern regarding children in golf carts and on bicycles traveling the wrong way on one way streets. Mrs. Miller indicated that the administration and police department were currently reviewing alter- native solutions to this dangerous problem. Mrs. Miller announced that a purchase order would be issued on this date for a new automatic gate arm to be installed at the Collins Avenue entrance to the security district. She also reminded those present of the upcoming November 4th election and the charter questions affecting the Village that will be on the ballot. Sample ballots are available in the lobby. Mr. Taplin requested that, should the charter amendment allowing ordinances to be read by title only pass, copies of ordinances be made available along with the agenda. Mrs. Miller requested that the Council approve an invoice from Pistorino find Alam , the firm that has served as consultants to the Village regarding the smoke detection ordinances, he approved for payment. The amount of the invoice is $3,555. A motion to approve this payment was made by Mrs. Antiles and seconded by Mr. Laikin. There being no discussion, the motion passed unanimously (4-0). Mrs. Miller also requested approval for a purchase of a water alarm system from Lauderdale Services. The amount of the purchase is to be $3,600. A motion was made by Mr. McKeehan to approve the purchase and seconded by Mrs. Antiles. There being no discussion, the motion passed unanimously (4-0).
