This Agreement is based on the following information. ARTICLE A.1 PROJECT INFORMATION § A.1.1 The Owner's program for the Project: (Identify documentation or state the manner in which the program will be developed.) The Owner desires to construct a Public Safety Building for the City of Tybee Island I pursuant to RFP#2012-633,incorporated fully herein as"Exhibit B." The anticipated site ' I improvements and building square footage for each area are as follows: (1) Administrative—10,640 square feet, (2)multi-purpose courtroom,training,and city council chambers—2,400 square feet,(3)detention area/holding cells—360 square feet,(4) sally port/garage enclosure(add alternate)—1,000 square feet,(5)fire bay(add alternate)— 420 square feet, and(6)and automated fuel reading system with 2 new fuel pumps(add alternate). The parties agree that the City may want to make changes to this written program. The parties agree that the Owner can meet its obligations under Section 5.1 of this Agreement,providing in a timely manner regarding requirements for and limitations on the Project, including a written program which shall set forth the Owner's objectives, schedule,constraints and criteria,so long as the Owner has furnished to Architect the foregoing prior to Architect's commencement of the Schematic Design Services Phase under this Agreement. Owner will provide Architect with a written protocol for phased demolition prior to commencement of demolition. § A.1.3 The Owner's budget for the Cost of the Work,as defined in Section 6.1: (Provide total, and if known, a line item break down.) The Owner's preliminary budget for the Cost of Construction is$2.8Million. The preliminary budget is the basis for the Architect's compensation in the Agreement. Any changes to this preliminary budget for the Cost of Construction, in excess of$250,000, shall entitle Architect to a fee increase equivalent to 7%of the total budget for the cost of construction after allowing a set-off for the preliminary budget amount and the$250,000 excess to which the Architect is not entitled to any further compensation.The Architect is only entitled to this fee increase as it relates to the budget for the project and Architect shall not be entitled to any additional fee or compensation due to the fact that the actual Cost of Work may exceed the budget. § A.1.4 The Owner's other anticipated scheduling information,if any,not provided in Section ..2: § A.1.5 The Owner intends the following procurement or delivery method for the Project: (Identify method such as competitive bid, negotiated contract, or construction management.) The design and construction of the building is to be architecturally compatible with the neighborhood, energy efficient,meet state police certification, ADA,and FEMA requirements. The project shall also include a telephone and interne wiring design per the Owner's requirements. The Owner if responsible for having completed a Phase 1 Limited Site Investigation Report and for having a survey completed.
