AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING FROM C-O OFFICE COMMERCIAL TO C-2 GENERAL COMMERCIAL, PROPERTY
LOCATED IN THE 700 BLOCK OF STONERIDGE PARKWAY, DESCRIBED AS PARTS OF LOTS
2, 3, 4, AND 5 OF STONERIDGE VILLAGE SUBDIVISION, SECTION ONE, JEFFERSON CITY,
COLE COUNTY, MISSOURI.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would not necessitate a change to the
Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from C-O Office Commercial to C-2
General Commercial: Parts of Lots 3, 4 and 5 of Stoneridge Village, Section One, per plat of record in Plat
Book 12, page 585, Cole County Recorder's Office, more particularly described as follows: BEGINNING at the
northwesterly corner of the aforesaid Lot 4 of Stoneridge Village, Section One, thence N84°31'21"E, along the
northerly boundary of Lot 4, 56.39 feet;thence S5 036'53"E,490.63 feet to a point on the southerly boundary of
the aforesaid Lot 3;thence S8301 1'25"W,along the southerly boundary of Lot 3,84.84 feet to the southwesterly
corner thereof and said corner being on the easterly line of the 100 foot wide Stoneridge Parkway right-of-way;
thence along said right-of-way line,the following courses:N5 028'37"W,258.77 feet;thence Northerly on a curve
• to the right, having a radius of 950.00 feet, an arc distance of 176.99 feet, (the chord of said curve being

southerly boundary of said Lot 2, 56.39 feet;thence northerly to a point 330 feet westerly of the easterly line of
Section 10, Township 44 North, Range 12 West, and 265 feet southwesterly of a point located at the 35 foot
easterly extension of the southerly boundary of a tract of land described in Book 370, Page 399, Cole County
Recorders Office;thence northwesterly toward a point located at the 35 foot easterly extension of the southerly
boundary of said tract of land described in Book 370, Page 399,Cole County Recorders Office, in a straight line,
to the easterly boundary of Stoneridge Parkway; thence southwesterly along the easterly boundary of said
Stoneridge Parkway to the POINT OF BEGINNING, and containing approximately 0.2 acres, more or less.
Containing in all, approximately 1.10 acres, more or less.
Section 2. This ordinance shall be in full force and effect from and after its passage and
approval.

The City Council of the City of Jefferson, Missouri,will hold a public hearing on Monday, March 17,
2008 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320 East

Case No. P08001 — 700 Block of Stoneridge Parkway; Rezoning. Request filed by
MOCAP Development LLC, property owner, Michael Farmer, authorized representative, to
rezone approximately 0.9 acres from C-O Office Commercial to C-2 General Commercial.
The property is generally located on the eastern side of Stoneridge Parkway approximately
700 feet south of Missouri Boulevard and is described as part of Lots 3, 4, and 5 of
Stoneridge Village Subdivision Section One, Jefferson City, Cole County, Missouri. (Central
Missouri Professional Services, Consultant)
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Bates distributed a current aerial photography zoning map and a
reduced scan of Stoneridge Village Subdivision, Section One. He explained that the proposed
rezoning request affects Lots 3, 4 and 5 of Stoneridge Village Subdivision, Section One, which
are currently split by the C-2/C-O zoning line. Mr. Bates stated that the purpose of the rezoning
is to bring Lots 3, 4 and 5 into conformance with the rest of the development.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that the original zoning line
separating the C-2 and C-O zoning districts was established prior to the design of Stoneridge
Parkway and the plating of the Stoneridge Village Subdivision. He stated that there is a small
triangular piece on Lot 2 of Stoneridge Village Subdivision which is currently zoned C-O Office
Commercial. Mr. Barron explained that staff would be submitting a rezoning request in the near
future to bring that small portion of the Kohl's lot into compliance with the rest of the
• development. He explained that much of the property in this area is currently zoned C-2 General
Commercial and the requested rezoning is an expansion of the existing C-2 zoning. The
property lends itself well to a C-2 zoning designation and staff recommends approval of the
rezoning request.

Traffic Access
The property currently has access to Stoneridge Parkway. A traffic study detailing expected traffic volumes and
necessary road improvements in conjunction with the Stoneridge Village development is on file at the Department
of Community Development.

Gentlemen,
City planning staff proposes to rezone a portion of the above referenced property so that the entirety of the
Stoneridge Village Subdivision is within a single zoning district. Currently, the zoning line splits several of
the lots within this subdivision, including Lot 2, which is owned by your company. The portion of Lot 2 that
is affected is used as a parking lot for the Kohl's store. I have included a copy of the Stoneridge Village
Subdivision Plat with the zoning line highlighted.
To provide you with some background, the owners of Lots 3, 4 and 5 have submitted an application to rezone
those lots from C-O Office Commercial to C-2 General Commercial.This application was favorably reviewed
by the Planning and Zoning Commission at their meeting on January 10, 2008.They agreed with staff that the
C-2 zoning district should also be extended to include the portion of Lot 2 that was zoned C-O as well.
Staff proposes to pursue this adjustment in the zoning line of Lot 2 as an"application in the public interest,"
and as such,there would be no fee to you.The timeline for this proposal is as follows:
February 14, 2008 Planning and Zoning Commission Public Hearing
March 3, 2008 Introduction of the bill for rezoning to City Council
March 17, 2008 City Council Public Hearing and bills pending,the bill is
eligible for passage at this time

Commercial. The property is generally located on the eastern side of Stoneridge Parkway
approximately 600 feet south of Missouri Boulevard and is described as part of Lot 2 of
Stoneridge Village Subdivision Section One, Jefferson City, Cole County, Missouri.
Mr. Barron explained that on January 10, 2008 the Commission approved to rezone a portion
of Lots 3, 4 and 5 of Stoneridge Village Subdivision from C-O Office Commercial to C-2 General
Commercial in order to eliminate a zoning line split. He stated that staff is proposing to rezone a
portion of Lot 2 of Stoneridge Village Subdivision in order to eliminate the zoning line split and
bring the C-O zoned portion into conformance with the rest of the development. He stated that
both rezoning applications will be forwarded to the City Council simultaneously.
No one spoke in opposition to this request and no correspondence was received.
Mr. Nunn moved and Mr. Lake seconded to recommended approval of rezoning Lot 2 of
Stoneridge Village Subdivision, Section One from C-O Office Commercial to C-2 General
Commercial, to the City Council. The motion passed 7-0 with the following votes:
Aye: George, Gresham, Hagan, Jordan, Lake, Nunn, Robinett

Nature of Request
The original zoning line separating the C-2 and C-O zoning districts was established prior to the design of
Stoneridge Parkway and the plating of the Stoneridge Village Subdivision. Lot 2 (as well as lots 3, 4, and 5) of
Stoneridge Village Section One are currently split by the C-2/C-O zoning line. The purpose of the rezoning request
is to eliminate the zoning line split and bring the C-O zoned portion of lot 2 into conformity with the rest of the
development. A previous request to rezone the C-O portion of lots 3, 4, and 5 was recommended for approval by
the Planning and Zoning Commission on January 10, 2008.

Traffic Access
The property currently has access to Stoneridge Parkway. A traffic study detailing expected traffic volumes and
necessary road improvements in conjunction with the Stoneridge Village development is on file at the Department
of Community Development.
Staff Recommendation
Much of the property in this area is currently zoned C-2 General Commercial and the requested rezoning is an
expansion of the existing C-2 zoning. The property lends itself well to a C-2 zoning designation and staff
recormnends approval of the rezoning request.
