HomeMy Public PortalAbout2002-022 Resolution Granting CUP to QwestMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-22 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO QWEST WHEREAS, Qwest (the "Applicant") is the owner of the property located at 3585 Pinto Drive (the "Property"); and WHEREAS, the Property is zoned Urban Residential (UR) and is improved with a 1432 sq. ft. building containing telephone switching equipment; and WHEREAS, the Applicant has proposed constructing an addition of 1750 sq. ft. and installing an exterior generator; and WHEREAS, the existing building and proposed additions are conditional uses in the UR zone and the application requires a conditional use permit; and WHEREAS, the matter was considered and recommended for approval by the planning commission at its meeting on April 9, 2002; and WHEREAS, the matter was reviewed by the city council on April 16, 2002; and WHEREAS, it has been determined that the Applicant's proposed additions on the Property will not impede the orderly development of adjacent properties for the purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicant for construction of the proposed additions, subject to the following terms and conditions: 1. The outside generator must be screened with a concrete wall or screen from the existing building and on the west and south sides. The screen must be higher than the generator and the exhaust; RHB-213919v l 02-22 ME230-340 May 7, 2002 2. The Applicant must install the proper number and types of plants in the water treatment area to the satisfaction of city staff; 3. The sound produced by the outside generator may not exceed 50 decibels when measured at the lot line. The Applicant must submit to the city the results of a test of the sound level conducted by a qualified technician; 4. The periodic testing of the generator may not occur except between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday; 5. All exterior lighting on the building and on the Property must be shoe box style designed and installed so that all sides are enclosed except the bottom with the lens recessed and the light source not visible from adjacent properties or rights -of -way. Lighting on the Property may not exceed 0 foot candles measured at any property line; 6. No outside storage shall be permitted on the Property; 7. If a floor drain is installed in the building, the Applicant must construct a curb on the floor between the battery area and the floor drain; 8. The Applicant must convey to the city an easement for roadway purposes 33 feet in width along Pinto Drive and drainage and utility easements 10 feet in width along the north, south, west and newly defined east lot lines; 9. The Applicant must comply with all requirements outlined in the letter dated February 18, 2002 from the city engineer to the zoning administrator; and 10. The Applicant must pay to the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application.
