HomeMy Public PortalAbout16-9264 Establishing the Canvasing Board Sponsored by: City Clerk RESOLUTION NO. 16-9264 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, ESTABLISHING THE CITY CANVASSING BOARD AS SET FORTH IN SECTION 8.5-9 OF THE CODE OF ORDINANCES OF THE CITY OF OPA-LOCKA, FLORIDA, FOR THE NOVEMBER 29TH, 2016 SPECIAL ELECTION; FURTHER DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Commissioner Terence K. Pinder passed away on May 24, 2016, thereby creating a vacancy in the office for a period of more than six (6) months in accordance with Section 2.7 of the Charter; and WHEREAS, Pursuant to Section 2.7 of the Charter, a Special Election is mandated to be called to fill the vacancy, and said election is set for November 29, 2016; and WHEREAS, The Miami-Dade County will not have a canvassing board impaneled to certify the result of the Special Election set for November 29, 2016; and WHEREAS, Section 8.5-9 of the City Code of Ordinances requires the City Commission to establish a canvassing board by appointing "5 qualified electors of the City who are not active participants or candidacy of any candidate in the election being canvassed"; and WHEREAS, Each City Commissioner has made his/her appointment to be approved by the City Commission. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Resolution No. 16-9264 Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission hereby appoints: a) Rose Tydus b) Geneva Johnson c) Dorothy Johnson d) Karen Jackson e) Calvin Russell to serve as the City's Canvassing Board for the November 29, 2016 Special Election pursuant to Section 8.5-9 of the City's Code of Ordinances. Section 3. The City Clerk shall deliver a certified copy of this Resolution to the Supervisor of Elections of Miami-Dade County, Florida. Section 4. The members of the City Commission shall submit the names of Resolution No. 16-9255 their respective appointments to serve on the City's Canvassing Board for the November 29, 2016 Special Election, to the City Clerk by Friday, October 21, 2016. Section 3. The City Clerk shall announce the appointments at the October 26, 2016 Commission Meeting. Section 3. The City Clerk shall deliver a certified copy of the Resolution to the Supervisor of Elections of Miami-Dade County, Florida, appointing the City's Canvassing Board for the November 29, 2016 Special Election. (1) A city canvassing board is hereby established and shall be comprised of five (5) qualified electors of the city who are not active participants in the campaign or candidacy of any candidate in the election being canvassed, appointed by the city commission. The appointed electors shall serve a term to run concurrently with the terms of the appointing city commissioners. (2) The city canvassing board shall meet in a building accessible to the public in the city and so designated by the supervisor of elections to publicly ratify the canvass of election results certified by the Miami-Dade County Supervisor of Elections.
