CALL TO ORDER: Mayor Swain called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, September 18, 1984, in the Council Chamber of the City Hall. 2. The invocation was given by Dr. Ed Linberg, Temple City Christian Church, 9723 Garibaldi. 3. The Pledge of Allegiance to the Flag was led by Mayor Swain. 4. ROLL CALL: Present: Councilmen - Atkins, Dennis, Gillanders, Tyrell, Swain Absent: Councilmen -None Also Present: Acting City Manager Shaw, City Attorney Martin, Parks & Recreation Director Kobett, Public Works Coordinator Peterson, and Julie Estrada of the Temple City Times. Councilman Tyrell moved to approve the absence of City Manager Koski, seconded by Councilman Gillanders and unanimously carried. PRESENTATION: Jan Rizzo, Manager, Temple City Branch of the Automobile Club presented to the City of Temple City, the 1983 Pedestrian Safety Award for no pedestrian deaths and a low number of injuries during 1983. She stated since 1967 Temple City has received 12 different safety awards. I5. CONSENT CALENDAR: Councilman Gillanders requested Item 5 be removed from the Consent Calendar and Councilman Atkins requested the removal of Item C (1). On motion by Councilman Atkins all other items on the Consent Calendar were unanimously approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of September 4, 1984. Approved as written. C. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF SEPT. 11, 1984: (1) PLANNING COMMISSION ACTION Received and filed memo relating to action taken by the Planning Commission at their regular meeting. D. ORDINANCE NO. 84 -552 (2nd reading) RELATING TO PARK RULES AND REGULATIONS Waived further reading and adopted Ordinance No. 84 -552 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING SECTION 3589 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO PARK RULES AND REGU- LATIONS. E. PUBLIC ADDRESS SYSTEM FOR PATIO AT LIVE OAK PARK Authorized staff to proceed with the installation of the sound sys- tem for the patio at Live Oak Park in the estimated amount of $800 and amended the adopted budget accordingly. F. RENEWAL OF AGREEMENTS: STUDENT AND THE LAW PROGRAM - TEMPLE CITY UNIFIED SCHOOL DISTRICT /LUTHERAN SCHOOL /ST. LUKE'S SCHOOL /CLEMINSON SCHOOL Approved Student and the Law agreements with subject schools and authorized Mayor and City Clerk to sign the agreements. STREET RESURFACING PROJECT - FEDERAL AID URBAN FUNDING (Olive, Broadway, Live Oak Avenue) Adopted Resolution No. 84 -2304 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING PORTIONS OF BROADWAY, LIVE OAK AVENUE AND OLIVE STREET TO BE A PART OF THE COUNTY SYSTEM OF HIGH- WAYS and authorized the Mayor and City Clerk to sign the agreement. H. REQUEST TO CONDUCT RUN FOR LIBERTY - OCTOBER 13, 1984 1 Approved request from Hans Albrecht on behalf of Stroh's Brewery to conduct an 8K run in Temple City on Saturday, October 13, 1984, to raise funds for the restoration of the Statue of Liberty, sub- ject to the conditions outlined in staff memo of September 12, 1984. I. RESOLUTION NO. 84 -2307: ESTABLISHMENT OF PROCEDURES FOR ADOPTING DEVELOPMENT AGREEMENTS Adopted Resolution No. 84 -2307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, PERTAINING TO THE ESTABLISHMENT OF PRO- CEDURES FOR ADOPTING "DEVELOPMENT AGREEMENTS." J. RESOLUTION NO. 84 -2305: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 84 -2305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. K. RESOLUTION NO. 84 -2306: WARRANTS AND DEMANDS Adopted Resolution No. 84 -2306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $83,381.60 DEMAND NOS. 8379 THRU 8447. CONSENT CALENDAR ITEM B RECOMMENDATION FROM TRAFFIC COMMISSION MEETIN OF SEPTEMBER 5, 1984 - REQUEST FOR 4 -WAY STOP AT GOLDEN WEST AND LIVE OAK AVENUE Councilman Tyrell stated that it was unfortunate that accidents have to occur before sufficient'warrants existed to justify traffic regula- tions. Councilman Gillanders stated he has viewed the intersection a number of times; felt the crest that exists should be investigated as there may be a need to revamp the engineering; the Traffic Commission's re- port was inconclusive; and if Council is to make an intelligent deci- sion,-they need more thorough background information. Councilman•Atkins stated he was present at the Traffic Commission hear- ing wherein Traffic Engineer Envall did present a comprehensive report to the Traffic Commission and the shortcomings may have occurred in the documentation and not the process at the Traffic Commission. Councilman Gillanders moved to continue this matter to the October 2, 1984, Council meeting pending a detailed and comprehensive report from staff as to the Traffic Commission recommendations, seconded by Council- man Atkins and unanimously carried. CONSENT CALENDAR ITEM C(1) PROPERTY NUISANCE CASE 84 -120 (9649 LONGDEN AVENUE) Councilman Atkins stated he had viewed the site of the property nuisance and observed the abandoned vehicle which he felt should be included in the order of abatement. Councilman Atkins moved to adopt Resolution No. 84 -2308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF with the added condition for removal of inoperative vehicle. 4 Council Minutes, September 18, 19844,x- Page 3 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: 7:30 P.M. - ASSESSMENTS FOR STREET LIGHTING IM- PROVEMENTS - ARDENEL AVENUE, 5200 BLOCK (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) Acting City Manager Shaw presented background information stating City Council, at their regular meeting of August 21, 1984, accepted the in- stallation of one street light on new marbelite standard with overhead service. The installation has been confirmed by staff and energized by Edison Company on August 6, 1984. Cost of installation was $242 re- sulting in an assessment of $30.25 per property owner. Mayor Swain declared the public hearing open and invited anyone wish- ing to speak to come forward. There being no one that came forward to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Gillanders and unanimously carried. Councilman Dennis moved to approve the assessments as detailed in the staff report dated September 10, 1984, and directed the Superintendent of Streets to notify property, owners and collect the assessments, seconded by Councilman Atkins and unanimously carried. B. PUBLIC HEARING: 7:30 P.M. - ASSESSMENTS FOR STREET LIGHTING IM- PROVEMENTS - WORKMAN AVENUE, ALESSANDRO AVENUE TO OAK AVENUE (Pur- suant to Chapter 27,,Improvement Act of 1911, Streets and Highways Code),' Acting City Manager Shaw presented background information stating City Council, at their regular meeting of August 21, 1984, accepted the in- stallation of one street light on new marbelite standard with overhead service. PUBLIC HEARING: 7:30 P.M. - REQUEST FOR TENTATIVE TRACT NO. 43195 TO ALLOW DEVELOPMENT OF AN 8 -UNIT RESIDENTIAL CONDOMINIUM (4456- 4504 Temple City Boulevard) Acting City Manager Shaw presented background information stating at their regular meeting of August 28, 1984, the Planning Commission approved and recommended that the Council approve a request for Ten- tative Tract Map to allow development of an eight -unit residential condominium for the subject property. The proposed development in- cludes the removal of two existing structures and construction of two buildings, each with four condominiums. The condominiums will be two - story, 24 feet high with gabled roofs and stucco walls and the existing swimming pool to be incorporated into the project. The Planning Com- mission has certified the Environmental Impact Report which is in accordance with the CEQA guidelines as amended in 1984. • Councilman Gillanders expressed concern that the four unit buildings do not have sprinkler systems. Councilman Tyrell stated he thought the City had established a policy that sprinklers were required in the new developments. Following further discussion, Councilmembers agreed to hold this matter over to a study session to determine if the Code should be modified-to reflect this requirement. Council_ Minutes, September 18, 1984 - Page 4 Mayor Swain declared the public hearing open and invited anyone wishing to speak to come forward. James Harley, Developer and Agent for the owner, 9631 Business Center Drive, Rancho Cucamonga, stated they had met with the County Engineer and have conformed to all requirements as directed by the uniform build- ing code as dictated by Los Angeles County. He stated sprinklers are required in commercial but not residential developments unless Temple City Code requires them which he was not made aware of, but stated they could put in smoke alarms. John Wallace, 4515 -4503 Ellis Lane, lives 'behind the proposed develop- ment stated his major concern would be the people who buy that propert would be exposed to a tremendous amount of light and noise from the property directly to the north which is now an active property nuisance case with the City and is owned by the same person who owns the sub- ject property. There being no one else that came forward to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Gillanders and unanimously carried. Responding to Council inquiry regarding the consent of Council to allow a development adjacent to a nuisance and the City's liability resulting therefrom, City Attorney Martin stated with regard to the issue of liability, which has come up with increasing frequency, at this point in time there are no cases holding for liability but the trend in the future appears to be heading in that direction. Responding to Council inquiry regarding the status of the zoning viola - tion . which is creating a public nuisance adjacent to this development, Planning Director Shaw stated it is presently with the District Attor- ney's Office and they anticipate a determination and /or solution will be forthcoming. However, a continuance would require applicant's consent. Directing his comment to applicant, City Attorney Martin stated the Council's position at this time.is that to allow this development at this particular point would be to allow a development next to a con- troversial nuisance and Council is concerned that in good public policy they should not allow a development adjacent to a nuisance as they may face future claims if they do. Since the nuisance is in the process of being acted upon, Council is asking applicant's consent to a continuance to their November 20th meeting so that both issues, since they are directly related, can be resolved at one time. James Harley, applicant and agent for the owner, agreed to the con- tinuance. On motion by Councilman Tyrell, pursuant to applicant's concurrence, the request for Tentative Tract Map 43195 was continued to the November 20 regular meeting, seconded by Councilman Dennis and unanimously carried. 7. NEW BUSINESS: None 8 COMMUNICATIONS: A. TEMPLE CITY CHAMBER OF COMMERCE - HALLOWEEN HOEDOWN Acting City Manager Shaw presented a communication from the Chamber of Commerce requesting permission to conduct the 4th Halloween Hoedown on Saturday, October 27, 1984, blocking vehicular traffic or Las Tunas Drive from Temple City Boulevard west to Cloverly Avenue. Councilman Atkins moved to approve the request as set forth in their letter of September 4, 1984, subject to the required certificate of insurance and coordination with the City staff, seconded by Councilman Dennis and unanimously carried. 1 Council Minutes, September 18, 1984 Page 5 9. TIME FOR THOSE IN THE AUDIENCE WHO WLSH TO SPEAK: Hans Albrecht, 25108 -B Marguerite Parkway, Mission Viejo, thanked the Council for approving the request to conduct the Run for Liberty through Temple City on October 13 which is a national program con- sisting of 127 races. He stated although we are on the West Coast, we can take pride in our contributions for the restoration of the Statue of Liberty. Lt. Mangan, Temple City Sheriff's Station, introduced Lt. Tom Johnston as the new liaison officer for Temple City. Lt. Johnston is a 25 year veteran of the Sheriff's Department who has had a wide diversified career in many divisions of the department. Lt. Mangan further stated he has thoroughly enjoyed his assignment in Temple City and learned that Temple City is probably one of the remaining vestiges of the life style he knew 25 years ago and was surprised that it was still alive and well. "Mother, home, God and country, and the boy scouts" - it is still here and very refreshing and he encourages people every chance he gets to take a good look at Temple City.if they are home buyers who are looking for a good community. There is a vital force in the Temple City Community to maintain a high and generous quality of life. RECESS TO CRA: At this time Council recessed to meet as the Community Redevelopment Agency; approved the minutes of the regular .meeting;° of September 4, 1984; and approved the new signage for United Bank at 5607 Rosemead. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. CALIFORNIA CONTRACT CITIES FALL FIESTA AND SEMINAR - CATALINA ISLAND - OCTOBER 19 -21, 1984 Acting City Manager Shaw stated authorization is requested for Mayor Swain and Councilmen Tyrell and Dennis to attend the subject con- ference. Hotel and travel expenses are not requested. Councilman Gillanders moved to approve the attendance, authorized the necessary expenditures and amended the adopted budget accordingly, seconded by Councilman Atkins and unanimously carried. B. HOLIDAY DECORATIONS: Mayor Swain stated the Chamber of Commerce Holiday Decoration Com- mittee presented the plans and specifications prepared by Fiesta Floats for the Holiday Decorations at the intersection of Las Tunas and Temple City Boulevard. The cost of decorations at that inter- section are estimated at $7,000 which the committee has raised through donations from business and community residents. At the adjourned meeting of June 11, 1984, Council had agreed to match funds for the Holiday Decorations and Mayor Swain asked Councilmembers if they wished to negotiate for additional strands in the Rosemead /Las Tunas intersection area. Councilmembers concurred in proceeding with the Holiday Decorations at the Rosemead /Las Tunas intersection area with invoices coming directly to the City. C. SISTER CITY Councilman Gillanders invited anyone who wished to attend the re- organization meeting of the Sister City Association on Thursday evening, September 20. He also stated the Hawkesbury District Band will be visiting Temple City during the Camellia Festival. Council Minutes, September 18, 1984 - Page 6 12.
