AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON,MISSOURI,LOCATEDAT4118 ROUTEC HIGHWAY, IN SECTION 20, IN TOWNSHIP 44 NORTH, RANGE 12 WEST IN THE COUNTY OF COLE, STATE OF MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo,the City Council of the City of Jefferson desires to annex the unincorporated area of land described in Section 1; and WHEREAS, the property is adjacent to the City, the site of a sanitary sewer pump station and is owned by the City of Jefferson; and WHEREAS, a public hearing concerning the annexation was advertised on April 2, 2008 in the Jefferson City Post Tribune; and NOW,THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, • MISSOURI, AS FOLLOWS: Section 1. The City Council intends to and shall proceed to annex, as provided by law,the unincorporated area of land described as follows: Part of the Northeast Quarter of the Southwest Quarter of Section 20,Township 44 North, Range 12 West, Cole County, Missouri, more particularly described as follows: From the northwest corner of the Northeast Quarter of the Southwest Quarter of said Section 20; thence S88 001'04"E, along the Quarter Section Line, 786.56 feet; thence S1 058'56"W, 321.04 feet to the Point of Beginning for this description;thence S31 012'55"E, 110.00 feet to a point on the northerly right-of-way of Missouri State Route C; thence S58 047'05"W, along the northerly right-of-way line of said Missouri State Route C, 150.00 feet; thence leaving the northerly right- of-way line of said Missouri State Route C, N31°12'55"W, 110.00 feet; thence N58 047'05"E, 150.00 feet to the point of beginning. Containing 0.38 of an acre. Section 2. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has an ability to furnish normal municipal services to this area. Section 3. A public hearing was held on April 21, 2008, as provided by law, concerning the annexation of the unincorporated area described in Section 1. • Section 4. The land described in Section 1 shall be zoned RS-1 until such time as the zoning may be changed in the manner provided for by State Statute and City Code. Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is hereby amended by adding on new subsection which shall read as follows: ( ) The City's boundaries shall also include the following parcel: Part of the Northeast Quarter of the Southwest Quarter of Section 20,Township 44 North, Range 12 West, Cole County, Missouri, more particularly described as follows: From the northwest corner of the Northeast Quarter of the Southwest Quarter of said Section 20; thence S88 001'04"E, along the Quarter Section Line, 786.56 feet; thence S1 058'56"W, 321.04 feet to the Point of Beginning for this description;thence S31'1 2'55"E, 110.00 feet to a point on the northerly right-of-way of Missouri State Route C; thence S58 047'05"W, along the northerly right-of-way line of said Missouri State Route C, 150.00 feet; thence leaving the northerly right- of-way line of said Missouri State Route C, N31°12'55"W, 110.00 feet; thence N58°47'05"E, 150.00 feet to the point of beginning. The effective date of this Ordinance and the annexation of the area described in Section 1 will be immediately upon passage, provided that no written objections to the proposed annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not become effective until such time as the annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo. Petition filed by the City of Jefferson, property owner, for the annexation and zoning of approximately 0.42 acres of land generally located on the north side of Missouri Route C approximately 900 feet west of Rock Ridge Road. The property consists of part of the Northeast Quarter of the Southwest Quarter of Section 20, Township 44 North, Range 12 West, Cole County, Missouri. The complete property description is on file and available for review at the Department of Community Development, Planning Division. A. Voluntary Annexation, pursuant to Section 71.012 RSMo; and B. Approval of a zoning plan for the subject property to be zoned RS-1 Low Density Detached Residential. Mr. Barron explained that the subject property consists of a sewer pump station that is owned and operated by the City and serves the Covington Gardens Subdivision. He stated that the property is bordered on three sides by land that was incorporated into the city on April 18, 2005 and is zoned RU Rural. The proposed zoning for the subject property is RS-1 Single Family Detached Residential. Mr. Barron explained that two property owners (2721 and 2807 Brush Creek Court) submitted voluntary annexation petitions and, after public notification procedures were initiated, the two property owners withdrew their petitions. He stated that staff decided to pursue the annexation of the city owned tract of land. No one spoke in opposition to the proposed annexation request and no correspondence was received. • Mr. Bickel moved and Mr. Nunn seconded to recommend approval of the voluntary annexation petition and zoning plan for 4118 Route C to the City Council. Nature of Request Originally, two property owners (2721 and 2807 Brush Creek Court) submitted voluntary annexation petitions to annex into Jefferson City. City Staff combined these two annexation petitions with an existing unincorporated city owned tract of land into one annexation case to be presented to the Planning and Zoning Commission. After public notification procedures were initiated, the two property owners withdrew their voluntary annexation petitions. City Staff decided to still pursue the annexation of the city owned tract of land. The purpose of the request is to incorporate the subject property into the city limits of the City of Jefferson. The property consists of a sewer pump station that is owned by the City of Jefferson. No right-of-way is included within this annexation proposal.
