RESOLUTION NO. 16-9274
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AMENDING
RESOLUTION 16-9264 WHICH ESTABLISHED THE CITY
CANVASSING BOARD AS SET FORTH IN SECTION 8.5-9
OF THE CODE OF ORDINANCES OF THE CITY OF OPA-
LOCKA, FLORIDA, FOR THE NOVEMBER 29TH, 2016
SPECIAL ELECTION; PROVIDING FOR INCORPORATION
OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Commissioner Terence K. Pinder passed away on May 24, 2016,
thereby creating a vacancy in the office for a period of more than six (6) months in
accordance with Section 2.7 of the Charter; and
WHEREAS, Pursuant to Section 2.7 of the Charter, a Special Election is
mandated to be called to fill the vacancy, and said election is set for November 29,
2016; and
WHEREAS, The City Commission approved Resolution 16-9264 appointing
Rose Tydus and Dorothy Johnson to the Canvassing Board for the November 29,
2016 Special Election; and
WHEREAS, Rose Tydus and Dorothy Johnson has advised the City Clerk she
is not able to serve on the Canvassing Board; and
WHEREAS, Section 8.5-9 of the City Code of Ordinances requires the City
Commission to establish a Canvassing Board by appointing "5 qualified electors of
the City who are not active participants or candidacy of any candidate in the election
being canvassed"; and
WHEREAS, There is a need to appoint someone to fill the vacancies created
by Rose Tydus and Dorothy Johnson inability to serve on the Canvassing Board.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:

Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission hereby appoints Shalonda Rivers and
011ie B. Kelley to the City's Canvassing Board for the November 29, 2016 Special
Election.
Section 3. The City Clerk shall deliver a certified copy of this Resolution to
the Supervisor of Elections of Miami-Dade County, Florida, appointing Shalonda
Rivers and 011ie B. Kelley to the City's Canvassing Board for the November 29, 2016
Special Election.
Section 4. This Resolution shall take effect upon adoption by the City
Commission.

8.5-9 OF THE CODE OF ORDINANCES OF THE CITY OF

SPECIAL ELECTION; FURTHER DIRECTING THE CITY
CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN
RESOLUTION TO BE DELIVERED TO THE SUPERVISOR
OF ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Commissioner Terence K. Pinder passed away on May 24, 2016,

impaneled to certify the result of the Special Election set for November 29, 2016; and
WHEREAS, Section 8.5-9 of the City Code of Ordinances requires the City
Commission to establish a canvassing board by appointing "5 qualified electors of
the City who are not active participants or candidacy of any candidate in the election
being canvassed"; and
WHEREAS, Each City Commissioner has made his/her appointment to be
approved by the City Commission.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:

b) Geneva Johnson
c) Dorothy Johnson
d) Karen Jackson
e) Calvin Russell
to serve as the City's Canvassing Board for the November 29, 2016 Special Election
pursuant to Section 8.5-9 of the City's Code of Ordinances.
Section 3. The City Clerk shall deliver a certified copy of this Resolution to
the Supervisor of Elections of Miami-Dade County, Florida.
Section 4. This Resolution shall take effect upon adoption by the City
Commission.

Sec. 8.5-9. - Canvassing board, composition and convening.
(1) A city canvassing board is hereby established and shall be comprised of five (5) qualified
electors of the city who are not active participants in the campaign or candidacy of any
candidate in the election being canvassed, appointed by the city commission. The appointed
electors shall serve a term to run concurrently with the terms of the appointing city
commissioners.
(2) The city canvassing board shall meet in a building accessible to the public in the city and so
designated by the supervisor of elections to publicly ratify the canvass of election results
certified by the Miami-Dade County Supervisor of Elections. The city canvassing board shall
convene at twelve o'clock noon on the day following the election to be canvassed.
