Member Carolyn Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.02-36
RESOLUTION ADOPTING ASSESSMENT ROLL
FOR CHIPPEWA ROAD IMPROVEMENT
WHEREAS, on May 7, 2002, the city council called for a hearing on the assessment of
the proposed improvement to Chippewa Road from Mohawk Drive to Willow Drive; and
WHEREAS, pursuant to notice as required by law, the city council held the assessment
hearing on this date, at which hearing all persons wishing to express an opinion were given an
opportunity to do so.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. The amended assessment roll of the project, a copy of which is attached hereto
and made a part hereof, is hereby accepted and shall constitute a special assessment against the
lands named therein. Each tract of land therein included is hereby found to be benefited by the
proposed improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of five years. The first installment shall be payable on or before the first Monday in
January 2003 and shall bear interest at the rate of 7.5% per annum from the date of the adoption
of this assessment resolution. To the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 2002. To each subsequent
installment when due shall be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may at any time prior to certification of the
assessment to the county auditor pay the whole of the assessment of such property with interest
accrued to the date of the payment to the Medina administrator -clerk -treasurer, except that no
interest shall be charged if the entire assessment is paid within 30 days of the date of the adoption
of this resolution. Any such owner may, at any time thereafter, pay to the administrator -clerk -
treasurer the entire amount of the assessment remaining unpaid with interest accrued to
December 31 of the year in which such payment is made. Such payment shall be made before
November 15 or interest will be charged through December 31 of the succeeding year.

4. The administrator -clerk -treasurer shall forthwith transmit a certified duplicate of
this assessment to the county auditor to be extended on the proper tax list of the county and such
assessment shall be collected and paid over in the sainanner ass other municipal taxes.

The motion for the adoption of the foregoing resolution was duly seconded by member Phil
Zietlow and upon vote being taken thereon, the following voted in favor thereof: Zietlow,
Smith, Lane
and the following voted against same: None. Abstained: Workman, Supel
Whereupon said resolution was declared duly passed and adopted.
