HomeMy Public PortalAbout16-9283 Reaffirming the Adopting of the Millage Ordinance for the Fiscal Year 2016-2017 Sponsored by: City Manager RESOLUTION NO. 16-9283 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OPA-LOCKA, FLORIDA, REAFFIRMING THE ADOPTION OF THE MILLAGE ORDINANCE FOR FISCAL YEAR 2016-2017; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Commission adopted Ordinance No. 16-10 on October 3, 2016 (EXHIBIT "A"); and WHEREAS, Ordinance No. 16-10 established a millage rate of 10.00 for fiscal year 2016-2017; and WHEREAS, The City Commission desires to reaffirm its adoption of the millage ordinance no. 16-10. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION FOR THE CITY OF OPA LOCAK, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka, Florida, hereby reaffirms its adoption of Ordinance No. 16-10 setting the millage rate for fiscal year 2016-2017 at 10.00 mills. Section 3. The Brown Law Group, LLC City Attorney Moved by: COMMISSIONER HOLMES Seconded by: COMMISSIONER RILEY Commission Vote: 5-0 Commissioner Holmes: YES Commissioner Riley: YES Commissioner Pigatt: YES Vice-Mayor Kelley: YES Mayor Taylor: YES 1st Reading: September 13, 2016 2nd Reading: September 27, 2016 and October 3, 2016 Public Hearings: September 13, 2016, September 27, 2016 and October 3, 2016 Adopted: October 3, 2016 Effective Date: October 3, 2016 Sponsored By: City Manager ORDINANCE NO. 16-10 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING A FINAL MILLAGE RATE PURSUANT TO SECTION 200.065, FLORIDA STATUTES, FOR FISCAL YEAR 2016-2017, COMMENCING OCTOBER 1, 2016 THROUGH SEPTEMBER 30, 2017; SETTING FORTH PUBLIC HEARING DATES; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR REPEAL OF ALL PRIOR ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on July 13, 2016, the City Commission of the City of Opa-locka, Florida ("City Commission") adopted Resolution No: 16-9214, setting the tentative millage rate of 10.000 for Fiscal Year 2016-2017, commencing October 1, 2016 and ending September 30, 2017, and scheduled public hearings on September 13, 2016, September 27, 2016 and October 3, 2016; and WHEREAS,a resolution setting the tentative millage rate appeared on the July 13, 2016 City Commission agenda; and WHEREAS,in order to ensure broad notice and allow for public input, public hearings were noticed and set for September 13, 2016, September 27, 2016 and October 3, 2016; and WHEREAS,the Miami-Dade County Property Appraiser has determined the non-exempt net aggregate value of taxable property(real, personal and centrally assessed properties), in the City of Opa-locka for the Fiscal Year 2016-2017 to be $751,530,607.00; and WHEREAS, public hearings on September 13, 2016, September 27, 2016 and October 3, 2016, will allow for public comment on, and consideration by the City Commission of the proposed millage rate; WHEREAS, the public and all interested parties have had the opportunity to address their comments to the City Commission regarding the millage rate; and WHEREAS, having considered the comments of the public regarding the millage rate, the City Commission of the City of Opa-locka desires to adopt a final millage rate for Fiscal Year 2016-2017. NOW THEREFORE, THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS: Section 1. The foregoing recitals are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance. Section 2. The City Commission of the City of Opa-locka hereby adopts and establishes the millage rate of the City of Opa-locka for Fiscal Year 2016-2017, commencing October 1, 2016, through September 30, 2017, at 10.000 mills, which is $10.00 per $1,000.00 of assessed property value within the City of Opa-locka. This represents a 21.77 % increase over the rolled-back rate of 8.2121 mills. Section 3. Public hearings are to be held by the Commission on September13, 2016, September 27, 2016 and October 3, 2016. Section 4. The City Clerk of the City of Opa-locka is hereby directed to transmit a certified copy of this Ordinance to the Miami-Dade County Property Appraiser and the Tax Collector of Miami-Dade County. Section 5. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 6. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deem a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 7. This Ordinance shall, upon adoption, become effective as specified by the City of Opa-locka Code of Ordinances and the City of Opa-locka Charter.
