HomeMy Public PortalAbout2002-043 Resolution Granting CUP for Accessory Structures at 4175 Brockton LaneMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-43 RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR ACCESSORY STRUCTURES AT 4175 BROCKTON LANE WHEREAS, Michael Bitterman and Brenda Bitterman (the "Applicants") are the fee owners of the property located at 4175 Brockton Lane in Medina, Minnesota ("the Property"); and WHEREAS, the Property is zoned Rural Residential, contains 8.41 acres of land, contains a single family residence as the primary building and six outbuildings as accessory buildings; and WHEREAS, Section 825.19, Subd. 3 of the Medina code of ordinances allows conditional use permits to be issued permitting more than two accessory buildings and an aggregate of more than 3,000 square feet of accessory building on lots larger than 5 acres in residential zones; and WHEREAS, the Applicants wish to retain four of the existing outbuildings with an aggregate square footage of 3,986, remove two existing buildings and construct one new building containing 1600 sq. ft. for a total of 5586 sq. ft.; and WHEREAS, this matter was reviewed by the planning commission at its meeting on June 11, 2002 and by the city council at its meeting on June 18, 2002 and found to be in compliance with the requirements of Section 825.39 of the Medina code regarding granting of conditional use permits. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that a conditional use permit be granted to the Applicants allowing them to have the following five accessory buildings on the Property: 1. The existing barn; 2. The existing 10.2' x 14.3' shed; 3. The existing 14.4' x 18.5' shed; 4. The existing 12.5' x 12.5' shed; and 5. The new 40' x 40' horse barn, RHB-216805v 1 ME230-347 1 subject to the following terms and conditions: 1. The accessory structures, including existing and new, may not exceed five in number or 5,600 square feet in aggregate size; 2. The overhangs at the eaves and gables of the new 40' x 40' barn shall be a minimum of 12"; 3. Any exterior lighting shall be designed and constructed so that the globe is recessed and open only on the bottom and no light is cast directly on any adjacent property or any offsite roadway; 4. Manure must be removed from the Property at least every six months; 5. The manure pile must be set back a minimum of 100' from any wetlands on the Property or adjacent thereto; 6. There shall be no commercial use of the Property for horse boarding or lessons; 7. The number of horses maintained on the Property may not exceed four; 8. The Applicants shall maintain all fencing on the Property in good repair; 9. There shall be no living quarters for humans in any accessory structure; 10. The paddock must be located as shown on the site plan submitted to the city; 11. Improvements on the east side of the old barn are discouraged; and 12. The Applicants shall pay a fee to the city in the amount determined by the city staff to represent the actual cost to the city of reviewing this conditional use permit. Dated: July 2, 2002.
