HomeMy Public PortalAboutM 1986-10-21 - CC~~~ REGULAR MEETING OCTOBER 21, 1986 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on the above date at 7:30 p.m. Mayor Henning in the chair. Councilpersons Byork, Morris, Wells, Henning answered the roll call. Also present were City Manager Gomez, City Attorney Dave McEwen. It was moved by Councilperson Byork, seconded by Councilperson Approve Wells, and carried that the minutes of the following meetings Minutes be approved as written. Regular Meeting - October 7, 1986 Special Meeting - October 13, 1986 Mayor Henning and Council Members presented Senator Ralph Dills Ralph a plaque on behalf of the City of Lynwood. Senator Dills thanked Dills Mayor Henning and Council for the plaque and stated information Plaque would be forth coming in regards to the new high school. Mayor Henning presented a Commendation to Virginia Robbins in Commend. appreciation for the hours of service as a planning Commissioner Virginia for the City of Lynwood. Robbins Resolution No. 86-110 entitled: "A RESOLUTION OF THE CITY Res. No. COUNCIL OF THE CITY OF LYNWOOD URGING RESIDENTS TO VOTE AGAINST 86-110 PROPOSITION 61 ON THE NOVEMBER 4, 1986 BALLOT", was presented. It was moved by Councilperson Morris, seconded by Councilperson ,,._, Byork, that the foregoing presentations be approved and the resolution be adopted. ROLL CALL: A~'E~MEMBERS BYORK, MORRIS, WELLS, HENNING NOES: NONE ABSENT: NONE Bette Hatcher, Southern California Edison Company representative, Commend presented Council with a Commendation from the Edison Company, from 5CE Council recessed to the Lynwood Redevelopment Agency at 7:35 p.m. Council reconvened at 7:48 p.m. CONSENT CALENDAR All matters listed under the Consent Calendar were acted upon by one motion affirming the action recommended on the agenda unless members of the council or staff requested specific items removed for separate action. Councilperson Byork inquired about Item No. 19, Traffic Enforce- Traffic ment Computer System and questioned if this was an on-going Enforce training program. Assistant to the City Manager, Fraser, stated Compute .-.. the company would train all employees at one time. System Councilperson Wells inquired about Item No. 11, Street Improve- "Street '~ ments Projects (SB-300) FY 1986-87 and questioned if 1) Norton Improve Avenue from Santa Fe Avenue to Drury Land, 2) Los Flores Boulevard Prject from Atlantic Avenue to 400 feet north of Elmwood, 4) Alley west 2~~3 Street of Atlantic Avenue from Century Boulevard and Sanborn Avenue and Improve- 5) Alley north of Century Boulevard from the first alley west ment of Atlantic Avenue to Harris Avenue are to be completed first. Project Staff replied "YES" and Virginia Avenue from Santa Fe and Peach Street will be re-evaluated later due to extensive damage to curb and gutters and will be completed in the near future. Mayor Henning requested Item No. 16, Destruction of Records. The following action was taken: Res. No. Resolution No. 86-127 entitled: "A RESOLUTION OF THE CITY --- 86-127 COUNCIL OF THE CITY OF LYNWOOD DECLARING IT'S INTENTION TO CONDUCT A PUBLIC HEARING AS TO WHETHER A NUISANCE IS BEING MAINTAINED ON CERTAIN REAL PROPERTY", was presented, Permit City Council approved the issuance of a permit to geophysical to services, Inc., for the purpose of conducting a geophysical Geophys- survey in the city contingent on the City Attorney's recommen- ical dations, 1) submittal of insurance, bonds and certificates prior Services to the permit issuance, was presented. Tree City Council approved the specifications for the Tree Maintenance Maint. Project and authorize advertising for bids, was presented. Purchase City Council authorized staff to obtain informal bids for the Trucks purchase of two compact pick-up trucks, was presented. Res. No. Resolution No. 86-129 entitled: "A RESOLUTION OF THE CITY COUNCIL 86-129 OF THE CITY OF LYNWOOD APPROVING THE PURCHASE OF CERTAIN REAL PROPERTY FROM THE DEPARTMENT OF TRANSPORTATION OF THE STATE OF CALIFORNIA AND AUTHORIZING EXECUTION OF AGREEMENTS, APPROVING "'"" THE EXECUTION OF THE SALES AGREEMENT: AND AUTHORIZING A DOWN PAYMENT OF $3,330 FOR DESIGNATED SURPLUS PROPERTIES AND PAYMENT OF THE REMAINING BALANCE OF $29,970 WHEN DUE", was presented. ''~~ OF THE CITY OF LYNWOOD ADDING CHAPTER 9, ENTITLED "REPORT OF No. REAL PROPERTY RECORDS" TO THE MUNICIPAL CODE AND DELETING 1280 CHAPTER 27 1/2, SECTIONS 27 1/2-46, 27 1/2-47, 1/2-48 THEREFROM", was presented for second reading. It was moved by Councilperson Byork, seconded by Councilperson Morris, that the Ordinance be adopted. Contreras, retail sales of Car Mobile Electronics has requested a special permit to hold a car Sterec stereo competition. Mark Jenning, legal counsel for Marco Compe- Contreras stated he has organized the competition and explained tition how the competition works. Stated he would adhere to all council Mobile rules and regulations. Comm. 245 ROLL CALL OF COUNCILPERSONS: COUNCILPERSON BYORK, GILBERT, SMITH, WRIGHT COUNCILPERSON MORRIS, GILBERT, SMITH, WRIGHT COUNCILPERSON WELLS, SIMPSON, SMITH, WRIGHT MAYOR HENNING, SIMPSON, SMITH, WRIGHT L. Smith Lowell Smith and Ronald Wright were appointed to the traffic ~, Ron and parking commission. There is still one vacancy on the Wright traffic and parking commission. Appointment at the next regular Park. .council meeting. Comm. Lee City Clerk announced nominations are open for the one vacancy Sampson on the Planning Commission. Councilperson Byork, nominated Plann. David Willis and Councilperson Wells nominated Lee Sampson. It was moved by Councilperson Wells, seconded by Mayor Henning, Comm. and carried, to closed nominations. Appointment at the next regular council meeting. INFORMATIONAL ITEMS Res. City Manager Gomez stated council has adopted Resolution No. 86-118 No. in regards to fund transfers and appropriations f_or various capital 86-118 improvements projects and it was reported unappropriated fund balance, Proposition A fund it needs corrected to read delete "Proposition A Fund" and add gas tax 2107 fund. After Council discussion: It was moved by Councilperson Morris, seconded by Councilperson Byork, to approve the deletion and add new wording. Resolution No. 86-136 entitled: "A RESOLUTION OF THE CITY COUNCIL No. OF THE CITY OF LYNWOOD AMENDING THE CLASSIFICATION PLAN AND 86-136 GENERAL AND MANAGEMENT SALARY SCHEDULES TO INCLUDE THE REVISED POSITIONS OF BUILDING INSPECTOR AND SENIOR BUILDING INSPECTOR", was presented. It was moved by Mayor Henning, seconded by Councilperson Morris, that the resolution be adopted. ROLL CALL: 1~YES: MEMBERS BYORK, MORRIS, WELLS, HENNING NOES: NONE ABSENT: NONE City Manager Gomez requested a closed session after the council and public oral communications. COUNCIL ORAL COMMUNICATIONS Mr. Mayor Henning stated he had an item which concerns him in regards Handy to Mr. Handy, a firefighter in Huston, Texas, who applied for Fire a job as a firefighter in this community. He placed Number 26 Dept. on the list, and this list was cut off at Number 25. Mr Handy believes he has been discriminated against, and I feel so too, because we do not have any blacks on our fire department. (NOTE: Verbatum of orals on file in the City Clerk's office). Mr. Handy presented a copy of his fire department training and emergency medical training. ?_~:~5 2~~~ Councilperson Morris stated with respect to Mr. Handy and his Mr. Handy abilities and capabilities, the city does have proper process Fire Dept. and proper procedures for persons seeking employment in our city. It is my opinion that Mr. Handy's appearance should be before the Personnel Commission, Personnel Board and not before council. Mayor Henning stated Mr. Handy is here because I asked him to come because I felt that the city had a problem and a problem which we need to deal with as a City Council if we find out that we have a problem of such magnitude that it is discriminating against any of our citizens in this community, we have the responsibility of coming forward as a City Council and as of the elected body to insure this doesn't happen throughout our community. He feels council should review our fire department totally to see why we have this type of thing going on, and I think that we should use some outside consultants if necessary. City Attorney Dave McEwen stated council is getting into an area involving personal qualifications that might be more appropriately discussed in closed session. Mr. Handy can attend the closed session, but I think that there are some areas in that beyond the single case that we are talking now it could have far reaching ramifications legally for the city, and there are some procedural things that are dealing with the overall process that could in fact lead to fairly substantial liability or exposure to liability that I think should not be discussed publicly. After further council discussion......(Verbatum on file in City Clerk's office). It was moved by Mayor Henning, seconded by Councilperson Wells, to hire Mr. Handy on .our Lynwood Fire Department. Motion fails. Councilperson Byork stated Mr. Handy should appear before the Personnel Commission. Councilperson Morris stated at the last council meeting there was a motion passed to investigate this matter. Mayor Henning stated the motion put a hiring freeze on the fire department. Councilperson Morris stated an investigation was also asked for Councilperson Wells stated is anyone following through with the investigation. City Manager Gomez stated yes, the staff is working on this matter. Councilperson Wells stated she feels a third party should investigate the situation. Felicia Essex, a personal friend of Mr. Handy's stated she was hearing two different sides and wanted clarification. City Manager Gomez stated staff is comparing the grades to see ,._.. how they were graded and that information will be given to council for further direction. After further council discussion: Invest. Hiring Policy Fire Dept . It was moved by Councilperson Wells, seconded by Mayor Henning, to have a third party come in to investigate the procedures for the screening for the fire department. 2~E7 After further council discussion: Hiring City Attorney McEwen clarified the motion as follows: For Policy staff to seek statements of qualifications from third party Fire consultants independent outside of city and to bring a recommen- Dept. dation or a list of those consultants with their qualifications to council at the next meeting at which time council will select the consultant and that the review of the recruiting process that is used by the City of Lynwood, specifically the fire department. ROLL CALL: AYES: MEMBERS BYORK, MORRIS, WELLS, HENNING NOES: NONE ABSENT: NONE Cal Councilperson Wells inquired if any work had been received from Trans Gal Trans in regards to cleaning the freeway corridor. City clean.... Manager Gomez stated he had been in contact with Cal Trans but freeway nothing has been done so far. Stated she would like to develop corridor some kind of critique for hanging banners across the street, proporities to city, Chamber of Commerce and some non-profit organizations. Councilperson Morris stated the city has an ordinance and perhaps staff could review and suggest changes. Staff was instructed to give each Councilperson a copy of the ordinance. PUBLIC ORAL COMMUNICATIONS Hiring Norm Ortner, 2435 S. Reservoir, Pomona, Lynwood Firefighter, Policy stated he was here representing the Board of Directors of Fire the Fire Fighters Association and that the group is not against Dept. an investigation of the allegations of discrimination. Also there are and were three preparation classes that were open to all candidates for the written test that were offered free of charge and all the material contained in the written test was covered extensively. Also the interview board did consist of two fire department captains, one being black and one being white which I feel reflects an interest in having a represen- tation of minorities as far as an interview goes. (A Verbatum in on file). Juan Gonzales, 3911 Cortland, invited the Mayor and Councilpersons to a "Lynwood Get Together" October 25, 1986, 1:00 to 5:00 at 4314 Lavania. Fire Khay Salahuddin, 4307 Lugo states she is an employee of the Dept. Lynwood Fire Department and there is a process of three different Test events, a written, an oral and an agility test, and would be interested in what the scores were on the other two parts of that examination. Stated Lynwood has had black firefighters who have left due to more benefits in the larger cities than in Lynwood. Questioned the Mayor in regards to his employment for the Department of Unemployment and why more applications of young black men did not come out of his department. Questioned if the city is hiring consultants to study the hiring process perhaps the complete hiring process for the city could be reviewed. Trash Joe Smith, 12731 Waldorf, questioned if something could be done Haulers in regards to the trash haulers misuse of citizens trash cans. Robert Fry, 12501 Alpine, stated were responsible for cleaning up he had concerns about the stereo passed and about the banners, yo to this matter and I really feel changing ordinance. he wished to thank those who Long Beach and Palm. Craig Ibnez, 4208 Stevely, Lakewood, stated he is a Lynwood Firefighter and presently President of the Lynwood Firefighters Association, and feels the city did not discriminate. The Lynwood Fire Department has a female and not many fire depart- „ ments hire females. Our Fire Department wants the best fire- : ~ fighters that the city can get. William Cunningham, 10821 Cornish, stated he has lived in Racial Lynwood for 38 years and is hurt when the Mayor, this evening, Issues referred to the whites as low class. It bothers me to hear these kinds of discussions. We should have the evidence before making any decisions and having these kinds of discussions, instead of racial discussions. Ron Wright, 11634 Virginia, stated he did not like what is going on here, especially with the white and black issue. Mayor Henning is getting awfully racial when he lets the black people talk and when I asked to talk, I'm white, I was told No. Isn't that being racial? Council recessed to closed session at 9:35 p.m. Council reconvened at 9:50 p.m. City Attorney McEwen stated council met in closed session to discuss personnel matters. The following action was taken: Hiring Practice Fire Dept.
