HomeMy Public PortalAboutM 1986-11-04 - CC249 REGULAR MEETING NOVEMBER 4, 1986 The Lynwood City Council met in a regular session in the City Hall, 11330 Bullis Road, on the above date at 7:30 p.m. Mayor Henning in the chair. Councilpersons Byork, Morris, Wells, Henning answered the roll call. Also present were City Manager Gomez and City Attorney Yeager. Mayor Henning read a Proclamation for Children's Expo. Proc. Childrens It was moved by Councilperson Morris, seconded by Councilperson Expo Wells that the Proclamation be approved. Council recessed to the Lynwood Redevelopment and the Lynwood Information Inc. Agenda. Council reconvened to scheduled matters. SCHEDULED MATTERS Mayor Henning opened the public hearing on the Appeal of CUP Appeal at 11118 Long Beach Boulevard. of CUP Ray Chivera, 11434 Plum Street stated he is the person who is appealing the CUP. Asked City Attorney what are his rights, being the appealant. City Attorney stated it has been the policy and usual procedure to let the appealant make his statements and present his case first. Mr. Chivera stated the location is not the same as it appeared at the time it went to the Planning Commission. Commvanity Development Director Vicente. Mas stated-the location, as it reads now is correct. The addresses had not been established at the time the item went to the Planning Commission. Mr. Chivera questioned whether the application is for beer and wine or all alcohol. Mayor Henning stated the ordinance should be more specific on this matter and an amendment should. be done. Mr. Chivera stated that as recent as 1983, the city denied a CUP CUP to the Shell service station on Long Beach Boulevard and denial Imperial Highway when they wanted to sell beer and wine. Stated for at least 50 people have protested against the location selling Shell beer and wine, to the ABC. Stated the City's Ordinance does Station not go along the same rules as the ABC Board does as far as how many convenience stores there are within a certain area. Hopes the city is not going overboard on the 7-11 store. Feels the community has enough establishments that sell alcohol. Asked Council to look at the ordinance again before making a decision. Rev. C. C. Coleman, New Light Baptist Church spoke in behalf of Object the Ministerial Association. Stated the city already has more to more than ninety liquor establishments as of October 27, 1986. Feels Liquor the city needs a decent eating establishment rather than another Establ place that sells alcohol. Would rather see the location empty rather than another 7-11 store at the location. 250 Object. Robert Fry, 12501 Alpine brought survey to Council from the to Conven-School District on the destruction alcohol is causing to our fence young people. Is tired of convenience stores coming into the Stores city. Spoke regarding the problems caused at establishments that sell alcohol. Stated 7-11 stores have stated that most of their business is generated by sales of items other than alcohol. Mr. Fry stated he has data to show 240 of the business is the selling of alcohol. Mary St. Julian, 12701 Waldorf stated she was under the impression that 7-11 was going to build only one store, but now sees they are going to build all over the city. Stated one 7-11 is enough. Object. Charles Glenn, 3533 Carlin asked Council to reject the CUP for CUP for another liquor establishment. There are 94 licenses to sell Liquor beer and wine. Stated the city has more hotels than any other Establish. city per the population. Sees more people on the streets of Long Beach Boulevard at night than there are during the day. Crime rate is higher at locations near liquor stores than any other place. Stated there are too many liquor stores in the area already. Asked Council to reject this request. Don Bowman, 511 N. Central, Glendale, stated his organization deals with the problems associated with alcohol and questioned where Council will put the controls. Stated there is a measure coming up that will limit the number of liquor stores in accordance with the population. Feels it costs us more than ten times the revenues that we might get in taxes and it is up to Council to place controls on the issues of permits to sell beer and wine. Mayor Henning closed public hearing and brought matter back to Council for discussion. Councilpersom Morris stated he does not like to hear that crime is the result of the use of alcohol. The increase in population is one of the factors that cause crime to rise. Is not in favor of any more little corner stores in the city. Asked that staff bring back some sort of information along the lines of possible zone changes with regard to the sale of alcoholic beverages. Support the Planning Commission. Moved to uphold the Planning Commissions decision and recommendations. Morator- Councilperson Byork stated he agrees that we have an excess ium on number of liquor stores and feels we should have a moratorium Liquor on any more locations that will be selling beer and wine. stores Seconded the motion. Councilperson Wells agreed that we do have a large number of liquor stores but agrees with the decision of the Planning Commission. Mayor Henning agreed with the decision of the manning Commission and would rather see the building occupied than empty. Is not in favor of an ordinance banning any more liquor stores in Lynwood. Resol. City Attorney Yeager stated the motion should include section 2063 that states "and the City Council affirms all findings of the Planning Commission in Resolution 2063". ROLL CALL: Ayes: Members Byork, Henning, Morris, Wells Noes: None Absent: None City Clerk Hooper asked to be excused as matters had to be prepared in order to receive election results. Mayor Henning acknowledged the presence of Willard Reed, School Board member. 251 CONSENT CALENDAR City Attorney requested that formal bidding procedures be waived on Item numbers 10, 11, and 12 in favor of an informal negotiation. It was moved by Councilperson Morris, seconded by Councilperson Wells that the foregoing items be approved. ROLL CALL: Ayes: Members Byork, Henning, Morris, Wells Noes: None Absent: None Mayor Henning stated Item #17 will be carried to the meeting of November 18, 1986. Mayor Henning stated Item #18 will be continued to; December 2, 1986 when there is a full Council. Item #19: Charitable Solicitation: Youth Against Drugs and Gang Membership and Evangelical International Church Soldiers of the Cross of Christ. It was moved by Councilperson Morris, seconded by Councilperson Wells to approve the above items. Closed Session: City Attorney stated records should reflect that a closed session is needed to meet with Lynwood Redevelop- ment Agency negotiators relative to the acquisition of property and the city is to consider a case in which litigation has been formally commenced against the city, Santos vs. City of Lynwood. The authority for the closed session is Government Code Section 54956.9A and additionally a personnel matter will be discussed. Council recessed to closed session. Char. Solicit. Youth on War Agns Drugs Santos vs. City of Lynwd Council reconvened. City Attorney stated Lynwood Redevelopment Agency met with Real Estate negotiators to discuss acquisition of property and settlement authority relative to the Santos case was given to City Attorney. On personnel matter, staff has recommendations. Assistant to City Manager Fraser stated staff recommends they Job be given the authority to effect a Job Description for Assistant Descrpt Community Development Director with appropriate salary. Asst. Comm. It was moved by Councilperson Byork and seconded by Councilperson Dev. Morris to accept the recommendations of staff. Drctr. ROLL CALL: Ayes: Member Byork, Henning, Morris, Wells Noes: None Absent: None COUNCIL ORAL COMMUNICATIONS Mayor Henning questioned whether or not staff had anything regarding Banners. City Manager Gomez stated staff would bring the policy and cost back to staff on the meeting of November 18, 1986. Mayor Henning made remarks regarding items that have appeared Fire in the newspaper pertaining to the Fire Department and the morale Dept. of the city. & city Morale 252 There was no further business and it was moved by Councilperson Byork and seconded by Councilperson Wells to adjourn to November 18, 1986. ~~{..
