RESOLUTION N0. 60-8
RESOLUTION OF INTENTION IN THE MATTER OF Tf� '
IMPROVEMENT OF A PORTION OF PENDLETON AVENUE
BETWEEN ELM AVENUE AND ATLANTIC AVENUE BY THE
CONSTRUCTION OF VITRIFIED CLAY PIPE SANITARY
SEWERS, TOGETHER WITH ALL INCIDENTAL AND
APPUR7`ENANT WORK.
WAEREAS, pursuant to the provisions of Division 4 of the
Streets and Highway Code, cited as the "Special Assessment Investi- i
gation Limitation and Majority Protest Act of 1931," as amended, the
City Council of the City of Lynwood has determined that the improve-
ment of a portion of Pendleton Avenue between Elm Avenue and Atlantic
Avenue as proposed in Resolution No. 59-54 of said city is feasible
and. that public interest, convenience, and necessity require the
improvement substantially as set forth in.eaid report, and
WHEREAS, said City Council has found that the lands to be
assessed will be able to stand the burden of the proposed assessment,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lynwood as follows:
Section l: That in the opinion o£ the City Council of the
City of Lynvaood the public interest and convenience require and it is
the intention of said City Council to order the following work or im-
provement to be done, to wit:
' Construction of 8 inch vitrified clay pipe sanitary sewers,
a nd
6 inch vitrified clay pipe sanitary sewer house laterals,/manhole,
including all ineidental and appurtenant work in.Pendleton Avenue
between the northerly prolongation of the center line�of Elm Avenue
asusaiddElm Avenue exists southerly,of Pendleton Avenue and the
northerly prolongation of a line which is 63.5o feet easterly of and.
parallel to the westerly line of Lot 15 in Tract 5103, as recorded in
Book 53, page 55 of Maps, Records of Los Angeles County.
All of said work or improvement shall be performed in the
public ways and between the limits hereinbefore designated except
where the plans indicate that said work shall be omitted.

� � �That all of the work or improvement aforesaid sfiall be
done and. performed in accordance with and to the grades shown on
plans and specifications No. 1959-J-3 on file in the office of the
City Clerk of said city. Said plans are hereby referred to £or a
full and. complete description of said proposed work and for the
grades to which the work is to be done, and said plans and specifi-
cations are by reference made a part hereof and shall govern for all
details of the proposed work.
That the total estimated cost of said work or improvement
is the sum of One Thousand Four Hundred Three and Fifty-two/One-
hundredths Dollars ($1,403.52).
.Section 2. 7'hat said contemplated work or improvement, in
the opinion of the City Council, is of more than local or ordinary
and declares
public benefit, and said City Council hereby determines/that the
district to be benefited by said work or improvement, and. to be
assessed to pay the cost and expenses of such work or improvement,
is shown on Plan No. 1 959-J- 4 on file in the office of the City Clerk
of said city, to which reference is hereby made for a full and complete I
description of the assessment district.
Section 3. The City Council hereby determines and declares
that serial bonds shall be issued in the manner and £orm provided in
Division 7 of the Streets and Highways Code, cited as "The Improvement
Act of•1911," as amended, bearing interest at the rate of six per cent
per annum to represent each assessment of Twenty-Five Dollars ($25.00)
or over remaining unpaid for thirty days after the d.ate of recordation
of the warrant; said serial bonds sha11 extend�.z�;_; over a period ending
nine years from the second day of January next succeeding the next
October 15th following their date. Said bonds and interest thereon
shall be paid at the office of the City Treasurer and the.same shall be
disbursed by him, all as provided in said "Improvement Act o£ 1911," as
amend-ed.
.Section 4. Notice is hereby given that the provisions of
that certain act of the Legislature of the State of California designated
as the Streets and Highways Code, Division 4, cited as the "Special
Assessment Investigation Limitation and Majority Protest Act of 1931,"

as amended, have heretofore been fully complied with and all the
reports required under the provisions of said act are on file in�the
office o£ the City Clerk of said city, open to public inspection and
may there be examined by all interested persons.
Section'5. The proceedings for the aforesaid work or�improve-
ment shall be taken under an act of the Legislature of the State of
California designated as the Streets and Highway Code, Division 7.,
cited as the "Improvement Act of 1911," and amendments thereto.
Section.6. The City Engineer is hereby directed to make a
d.iagram of the property affected or benefited by said proposed work or
improvement as deseribed herein and to be assessed to pay the cost and
expenses of said work, showing each separate lot, piece, or parcel of
land and the dimensions of each such lot, piece, or parcel of land and
the relative location of the same to the work or improvement proposed
to be done, all within the limits of said assessment district.
Section 7. Notice is hereby given that on Tuesday, the 15th'
day of March, 1960, at the hour of 7:30 p.m. at the Council Chambers
in the City Hall, 11330 Bullis Road, in the City of Lynwood, any and
all persons having any objections or protests to said proposed work or
improvement, or to the extent of the district to be assessed or to the
grades to which the work is proposed to be done, may appear before said
City Council and show cause why said proposed work or improvement ehould
not be carried out in accordance with this resolution.
Section 8. The City Engineer, who is Superintendent of Streets,
is hereby directed to post notices of the passage.of this resolution in
the time, form; and manner required by law:
Section 9. The City Clerk shall certify to the passage of
this resolution by the City Council o£ said City of Lynwood, and cause
the same to be published twice in the Lynwood Press, a newspaper pub-
lished and circulated weekly in said city, and hereby designated by
said City Council for the purposes aforesaid. The City Clerk is also
directed to mail notices of the adoption o£ this resolution o£ intention
in the time, form, and manner, and to the persons, all as provided in
said "Improvement Act of 1911," as amended.
