Judith Bruce said that as outgoing Chair, John Jannell has been wonderful to work with and she asked for nominations for a Chair. Chair MOTION: A motion to nominate Steve Phillips as Chair of the Conservation Commission was made by Judy Brainerd and seconded by Kevin Galligan. No other nominations were made. MOTION: A motion to close the nomination was made by Judy Brainerd and seconded by Kevin Galligan. VOTE: 7-0-0 Unanimous. VOTE ON THE CHAIR: 7-0-0 Unanimous. Steve Phillips thanked Judith Bruce for everything she has done as Chair. Vice-Chair MOTION: A motion to nominate Kevin Galligan as Vice-Chair of the Conservation Commission was made by Judith Bruce and seconded by Judy Brainerd. No other nominations were made. MOTION: A motion to close the nominations was made by Judith Bruce and seconded by Judy Brainerd. . VOTE: 7-0-0 Unanimous. VOTE ON THE VICE-CHAIR: 7-0-0 Unanimous. Clerk 1 Orleans Conservation Commission Hearing Meeting 7-21-15 MOTION: A motion to nominate Rich Nadler as Clerk of the Conservation Commission was made by Kevin Galligan and seconded by Judy Brainerd. No other nominations were made. MOTION: A motion to close the nominations was made by Mike Brink and seconded by Kevin Galligan. VOTE: 7-0-0 Unanimous. VOTE ON THE CLERK: 7-0-0 Unanimous. Notice of Intent James & Laurie Snow, Stanley & Bonnie Snow, 18 & 22 Gibson Road, by FELCO, Inc. Assessor's Map 19, Parcels 16 & 17. The proposed stabilization of an eroding Coastal Bank for two adjacent properties on Town Cove with a gabion wall & two stone walls, & the construction of a seasonal walkway connecting to the existing in-ground steps for shore access. Work will occur within 100' of the Edge of a Salt Marsh, on a Coastal Bank, Coastal Beach, & in Land Subject to Coastal Storm Flowage. David LaJoie, from FELCO Inc., was present and said this project is for 2 properties abutting Town Cove. They are proposing a gabion wall and 2 stonewalls and the construction of a seasonal walkway connecting to the existing in-ground steps for shore access. One return of the gabion wall will be on each property. The applicant has met with the Town regarding protection of the drainpipe. John Jannell said the Town has not signed off on the Notice of Intent and it is a little confusing to involve the Town with the project. Tom Daley, DPW Director, was present and said the Town has an existing drainpipe coming out of the hill with an extensive pitch. They are looking to multitask with the owners and FELCO. They would like to redo the pipe and drop in some manholes. Judith Bruce said when the site visit was done, they were concerned about the erosion where the pipe ends on the marsh and asked if anything could be done to slow the flow of water. Tom Daley said he can look at the installation of a concrete structure to slow the flow of water. Harrow & Seed will provide a planting list for the project. Steve Phillips said it appears the pipe may be broken because of the erosion below the pipe. Tom Daley said the plan is to replace the pipe with a plastic pipe. A small excavator and skid steer will be used for excavation and there are several flat areas for parking of the equipment. The marsh will be staked with silt fencing. The Commission suggested that Greg Berman, Coastal Processes Specialist from Barnstable County, be contacted as part of a 3`d party review. The Commission and James Snow discussed the right of way. The project is pending comment from the NHESP before a determination can be made. Jane Hussey requested clarification of the public access. MOTION: A motion to continue the hearing to the meeting on August 11, 2015 was made by Jim O'Brien and seconded by Kevin Galligan. VOTE: 7-0-0 Unanimous. Jim O'Brien left at 9:14 a.m.; Charles Ketchuck is now a voting member. 2 Orleans Conservation Commission Hearing Meeting 7-21-15 Eugene Curry, 50 Sipson Island, by Holmes & McGrath, Inc. Assessor's Map 94, Parcel 6. The proposed demolition & removal of an existing single family house; reconstruction & maintenance of a single family house; shoreline protection/Coastal Bank restoration; installation of approximately 290 linear feet of a coir fiber roll array; & associated clearing, excavating, grading, planting, & landscaping. Work will occur within 100' of Land Under the Ocean, Salt Marsh, Coastal Beach, Coastal Bank, Coastal Dune, & on a Coastal Beach, on a Coastal Bank, in Land Subject to Coastal Storm Flowage, & in the Pleasant Bay A.C.E.C. Tim Santos, from Holmes & McGrath, Ben Wolman and Seth Wilkinson, from Wilkinson Ecological Design, Stan Humphreys and Eugene Curry, the applicant, were present. Stan Humphreys described the existing conditions and went through the performance standards. Seth Wilkinson said they will be focusing on coastal stabilization and re- vegetation. They are proposing to start work this fall and a work protocol has been submitted. Judith Bruce said she would like to see Greg Berman from Barnstable County involved with this project to get his input given the fragile area. Seth Wilkinson went over how many fiber rolls would be installed and the construction access for the project. A Chapter 91 License is not required for removal of the concrete pier, but the State will be notified of the project. Rich Nadler said there were a number of trees proposed for removal and he asked if there was a way to save some of the trees or add a few more to be re-planted. Temporary matting over the salt marsh will be used during construction. MOTION: A motion to continue the hearing to the meeting on August 11, 2015 was made by Kevin Galligan and seconded by Mike Brink. VOTE: 7-0-0 Unanimous. Edward Coggin, 12 Arey's Lane, by Moran Engineering Associates. Assessor's Map 62, Parcel 54. The proposed construction of a second floor addition. Work will occur within 100' of the Edge of a Wetland, Coastal Bank, &within the Pleasant Bay A.C.E.C. Dan Croteau, from Moran Engineering Associates, and Edward Goggin, the applicant, were present. The paved driveway to the west between the old bog and the property is actually an unpaved traveled driveway. Dan Croteau explained the existing property and the proposed construction of a second floor addition. The addition is for a master bedroom and they are not adding bedrooms, just re-locating. The Board of Health does not consider this proposal an increase. The second floor roofline will go up 7.6'. John Jannell asked for a revised plan to be submitted showing the limit of work. Kevin Galligan asked that the revised plan show the species and designated quantity of what will be removed and in what location. The Commission discussed the addition of a rain garden on the property to contain stormwater runoff. MOTION: A motion to approve the project with a condition that a revised plan showing a proposed rain garden in the horseshoe calculated to hold a 25-year storm event be submitted, and to show the limit of work, was made by Kevin Galligan and seconded by Judy Brainerd. VOTE: 7-0-0 Unanimous. 3 Orleans Conservation Commission Hearing Meeting 7-21-15 Revised Plan Richard Thompson, 24 Priscilla Road. The approved construction of additions to an existing dwelling has been revised to show a 2'x14' expansion of an existing first floor room under the existing 2' overhang. Work will occur within 100' of 2 Freshwater Wetlands. A request has been received to continue to July 28«'. No action was taken at this time. Enforcement Hearing Last Heard 7/7/15 (J02) Kevin Russell, 61 Briar Springs Road, by Harrow & Seed. Assessor's Map 51, Parcel 35. The proposed Bank Restoration including invasive plant removal, site stabilization, restoration plantings, & replacement of previous cut trees in response to an Enforcement Order. Work occurred & will occur on a Coastal Bank, in Land Subject to Coastal Storm Flowage, & within the Pleasant Bay A.C.E.C. Russ Holden, from Ryder & Wilcox, Inc., and Adrian Punch, from Harrow & Seed, were present. The Commission was given a site plan dated 7/15/15. Russ Holden said the canopy trees have been moved beyond the existing buffer strip with wider spacing, and a note that temporary irrigation will be installed, was added to the plan. The redacted contract that the Commission had required was submitted this morning. Steve Phillips said he felt comfortable the fines were no longer necessary at this point due to a good restoration plan. Charles Ketchuck said he would like to see the fines tabled until the work is complete. John Jannell said that specific milestone dates have been given.He said this is an enforcement hearing and the owner has been responsive to the Commission's comments. The fines for the violation can be tabled for a later hearing if the milestones are not met. Administrative Reviews Patrick Regan, 21 Tanglewood Terrace. The proposed removal of a dead cedar tree. John Jannell said this item would be brought before the Commission at next week's meeting. Paula & John Beatty, 4 Seal Lane. The proposed removal of a tree damaged in a winter storm, vista pruning, & pruning of a Norway maple. Work to be done by Nauset Landscapes. John Jannell said this item will be brought before the Commission at next week's meeting. Mike & Janet Brink, 17 Pilgrim Lake Terrace East. The proposed replacement of decking on an existing deck. Work to be done by Cape Associates. Mike Brink recused himself. Pam Herrick will be a voting member. MOTION: A motion to approve this administrative review was made by Steve Phillips and seconded by Judy Brainerd. VOTE: 7-0-0 Unanimous. 4 Orleans Conservation Commission Hearing Meeting 7-21-15 Mike Brink wanted to inform the Commission the Kent's Point task force is moving forward and is continuing to bring closure to the charge. The next step will be to develop the framework and come up with a new management plan. The task force will be setting up a date to meet with the Police Chief. The Planning Board held their hearing to revoke the name change of Keziah's Lane. The hearing was continued until November 10, 2015. John Jannell recapped the name change issue. Charles Ketchuck commented on a recent meeting regarding Cedar Pond and said,it was confusing. Judith Bruce said Cedar Pond is one of the most challenging problems.
