CITY OF MEDINA
RESOLUTION NO.02-46
RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 350 BY TITLE AND SUMMARY
WHEREAS, the city council of the city of Medina has adopted Ordinance No. 350, an
ordinance adding a new section 520 to the city's code of ordinances regulating the sale and use of
turf fertilizer containing phosphorus; and
WHEREAS, the fertilizer ordinance is lengthy; and
WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the new fertilizer ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that
the acting clerk -treasurer shall cause the following summary of Ordinance No.3-6b to be published
in the official newspaper in lieu of the entire ordinance:
Public Notice
The city council of the city of Medina has adopted Ordinance No. 350. The ordinance
requires that places which sell turf fertilizer containing phosphorus also sell phosphorus -free
fertilizer, display it with at least equal prominence and post a brochure or sign regarding the city's
regulations on the use of phosphorus fertilizer. The ordinance also prohibits the use of turf fertilizer
containing phosphorus, except on new lawns or on areas shown to have insufficient phosphorus
after testing. The portion of the ordinance regulating the use of phosphorus fertilizer will be pre-
empted when a similar state law becomes effective on January 1, 2004. The full text of Ordinance
No. 350 is available for inspection at Medina city hall during regular business hours.

BE IT FURTHER RESOLVED by the city council of the city of Medina that the acting
clerk -treasurer keep a copy of the ordinance in her office at city hall for public inspection and that
she post a full copy of the ordinance in a public place within the city.

Smith and upon vote being taken thereon, the following voted in favor thereof: Lane, Supel,
Smith, Workman.

Whereupon said resolution was declared duly passed and adopted.
