HomeMy Public PortalAbout2002-052Member Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-52 RESOLUTION APPROVING SITE PLAN FOR ACE PROPERTIES WHEREAS, Ace Properties, LLC (the "Applicant") has applied for site plan approval for a building to be constructed on Lot 1, Block 1, West Ridge Development (the "Property"); and WHEREAS, the Property is zoned urban commercial; and WHEREAS, Section 825.55 of the Medina code of ordinances requires site plan review of the Applicant's proposed building; and WHEREAS, this matter was reviewed by the planning commission at its meeting of July 9, 2002; and WHEREAS, the matter was considered by the city council at its meeting of July 16, 2002. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that site plan approval be granted to the Applicant to construct the proposed building on the Property, subject to the following terms and conditions: 1. The Applicant must construct a berm along the north property line separating the Property from the Cherry Hill neighborhood. The berm will be constructed partly on the Property and partly on Cherry Hill. The Applicant must obtain the necessary easements from the residents of Cherry Hill prior to construction of the berm. Additional plantings and/or a fence on the top of the berm will be required to soften the building and the view from the Property from Cherry Hill; 2. The Applicant must meet all requirements of the city engineer as indicated in his letter of June 29, 2002, to zoning administrator Loren Kohnen; 3. The Applicant must comply with all conditions of the Watershed District regarding the Property; 4. The Applicant must comply with all requirements of the Hennepin County planning and roads department regarding the Property; 5. The west wall of the proposed building must be constructed as shown on the amended plan submitted by the Applicant; 6. All uses in leased or rented space in the building must be granted an administrative conditional use permit before occupancy will be permitted in the space; 7. No berm should be constructed along the west side of the Property adjacent to the right-of-way of Clydesdale Court; 8. The Applicant must pay to the city an administrative fee in an amount sufficient to reimburse the city for the cost of reviewing this application; and 9. The site plan approval hereby granted shall be valid for one year from the date of this resolution, after which time the approval granted shall be null and void. Dated: August 6, 2002. Philip K. Whereupon said resolution was declared duly passed and adopted.
