Dear Custodian of Records,
I request to inspect certain public records for the purpose of informing myself of the
historic and current workings of the Town of Gulf Stream and its associated entities,
vendors, consultants, advisers, contractors and agents.
The records I wish to inspect may be material to current, anticipated or presently
unforeseen legal action. The production of any and all responsive records is
therefore urgent and must be acted upon in compliance with Florida Statutes and
established case law as soon as possible.
Before making this public record request, I first searched online and in the public
records portion of your agency's website hoping I could locate the public records I seek
without having to write you directly. Unfortunately I cannot find the records I request to
inspect. Therefore I am writing you now and requesting you make every effort as
required by law to produce these public records without delay.
I ask that you take the following action:
• Read this entire request carefully and respond accordingly.
• If you are not the custodian of the public records described herein please
determine who that person is and notify me immediately in order that I may make
this request to the appropriate person without delay.
• Reference Florida Statutes and appropriate case law when responding to this
record request.
• Do NOT produce any records other than records responsive to this request.
• Identify by name the person or persons responding to this request.
• Respond to this public record request in a singular manner and do not combine
this request with any other public record requests when responding to this
request.
• Once you have determined that you do or don't have any records in your
custody responsive to this request, immediately act to obtain any responsive
records that may be in the custody of your contractor(s).
Provide only those records for inspection that do not require extensive use of
information technologies or extensive staff time or both in excess of 15 minutes.
I believe the records I seek to inspect may be in your custody AND/OR in the custody of
an entity under contract with your agency. As a courtesy to you and your contractor and
to assist in expediting my access to records responsive to this request I am notifying the
contractor of this request by copy of this email. Do not assume my act of copying the
contractor with this request relieves you of any of your duties under Florida Statute. I
ask that you contact those entities yourself, inform them of their obligations under
Florida Statute and produce any responsive records in their custody as soon as
possible.
I request to inspect the memorandum from Mr. Brannon, of Brannon & Gillespie,
LLC, addressed to Mayor Koch dated May 3, 2011 as referenced on page 5 of the
minutes of the June 30, 2011 Public Hearing.
I make this request pursuant to Article 1, Section 24 of the Florida
Constitution and Chapter 119 of the Florida Statutes.
If you contend that any of the records I am seeking, or any portion thereof, are exempt
from inspection or disclosure please cite the specific exemption as required
by X119.070 )(e) of the Florida Statutes and state in writing and with particularity the
basis for your conclusions as required by §i119.070)(f) of the Florida Statutes. Produce
for my inspection all responsive records and ONLY redact that portion of the record that
you consider exempt. To be clear, if you consider an entire record to be exempt,
produce that record in its entirety with all portions redacted that you consider exempt. I
specifically ask you to do this in order that I may inspect fully redacted records for the
purpose of challenging a particular redaction or establishing a reference for a future
request of a record that is only temporarily exempt, as in the case of a public record that
was prepared by an agency attorney exclusively for litigation and is only exempt from
disclosure until the conclusion of the litigation.
I ask you to take note of $119.07(1)(c) Florida Statues and your affirmative obligation to
(1) promptly acknowledge receipt of this public records request and (2) make a good
faith effort which "includes making reasonable efforts to determine from other officers or
employees within the agency whether such a record exists and, if so, the location at
which the record can be accessed." I am, therefore, requesting that you
notify every individual and entity in possession of records that may be responsive to this
public records request, including individuals and entities under contract with your
agency, to preserve and produce all responsive records on an immediate basis.
If the public records being sought are maintained by your agency or contactors for your
agency, in an electronic format please produce the records in the original electronic
format in which they were created or received. See §119.01(2)(f), Florida Statutes.
Again I ask that you provide only those records for inspection that do not
require extensive use of information technologies or extensive staff time or both in
excess of 15 minutes. Take note of §119.07(4)(a)3.(d) Florida Statues and if you
anticipate that any records exist, the production for inspection of which will require
extensive use of information technologies or extensive staff time or both in excess of 15
minutes, then please provide those records that can be produced within the first 15
minutes and advise me of the cost you anticipate to be incurred by your agency for the
remaining records prior to incurring this cost. Please do not incur any costs on my
behalf without first obtaining my written authorization to proceed. If you produce only a
portion of all existing responsive records, please tell me that your response includes
only a portion of all existing records responsive to this request.
If you anticipate the need to incur any costs that I would be statutorily required to pay in
order to inspect these public records which would exceed $1.00 please notify me in
advance of your incurring that cost with a written estimate of the total cost. Please be
sure to itemize any estimates so as to indicate the total number of pages and/or
records, as well as to distinguish the cost of labor and materials. Again, please do not
incur any costs on my behalf without first obtaining my written authorization to proceed.
The phrase Town of Gulf Stream when used herein refers to the Town in its entirety
including all employees, appointees, officials, assignees, counsel and consultants
including Town Manager, Town Clerk, Town Police Chief, Town Commissioners, Town
Mayor, Town Departments, Town Police Officers, Town Employees, Town Engineer, the
law firm (Jones Foster Johnston & Stubbs P.A.) that claims to be the Town Attorney
including all attorney, partner and employee members of that firm; the Town Counsel of
Sweetapple, Broeker & Varkus including all attorney, partner and employee members of
that firm, the Town Counsel of Richman Greer, P.A. including all attorney, partner and
employee members of that firm and any other entity associated with the Town and
subject to public records law.
The term public records, as used herein, has the same meaning and scope as the
definition of Public records adopted by the Florida Legislature as Statutes Chapter
119.
A record that does not exist because of its disposition requires the creation of a
disposition record. In all instances where you determine a record does not exist please
determine if the record once existed and in its replacement provide the disposition
record for my inspection.

Subject: Comparing FPL Overhead Distribution Facilities with FPL Underground
Distribution Facilities relative to Reliability and Safety
Dear Commissioner,
This communication is intended to express my strong opinion that there are significant safety and
reliability benefits provided by FPL underground electric distribution facilities when compared to
FPL overhead distribution facilities. In the recent special Town Commission meeting, comments
were made that implied FPL's opinion was that there were no Reliability or Safety benefits in
having underground FPL facilities versus overhead FPL facilities. It is true that FPL will indicate
that both types of facilities are designed and constructed to be safe and reliable. And given there
are not external factors such as wind, rain lightning, vehicle impacts, tree pruning, overloads, etc.,
then the Safety and Reliability might be characterized as equal. The facilities are certainly
designed and maintained to meet safety and reliability standards.
However, when outside factors come into play, the record will show that problems arise much
more frequently when overhead facilities are involved. In working for FPL from 1973 until 1998,
I cannot recall any fatalities or serious injuries involving the public associated with underground
distribution facilities. I can however recall several fatalities associated with overhead facilities. I
can recall incidents involving cranes working around overhead lines, tree trimming around
overhead lines, overhead lines breaking and falling on occupied cars. We are currently
undergrounding an overhead line section on Palm Beach where the resident has communicated
that the 7600 volt primary line has fallen twice on their tennis court fencing and damaged her
property. Recently a fallen energized line in Jupiter Inlet Colony adjacent to the Town Hall
resulted in a dangerous situation. In my opinion, there definitely are significant safety benefits
resulting from undergrounding power lines.
And when we consider reliability and looking at FPL's website, you will see the following

Underground Conversions
FPL has been installing underground service for close to 40 years and is committed to
increasing its underground facilities. More than 37 percent of our current system is
already underground, compared to about 20 percent in other utilities nationwide.
Currently, more than two-thirds of FPL's new distribution lines have been placed
underground. In the last couple of years, there has been a lot of interest in underground

service. We have received requests for this type of service for many reasons including:
aesthetics and increased reliability during adverse weather.
While underground service is convenient in many ways, it is important for interested
customers to understand its pros, cons and requirements to consider when choosing if it is
right for your neighborhood.
Advantages:
• Better reliability in normal and adverse weather conditions, especially during
wind and lightning events
• Fewer number of power interruptions
• No poles or overhead wires in the conversion area
Disadvantages:
• Longer duration of outages
• Underground facilities are susceptible to water
• Repairs of underground lines may require pre -arranged outages and excavation of
private property
• Underground service has a shorter life expectancy than overhead service
As an added comment, I would like to add that currently FPL is installing underground
facilities with a loop configuration that permits any section of cable or piece of
equipment that fails to be isolated by switching. This typically allows a fust responder
switchman to restore the majority or all the impacted customers without having to repair
the failed cable or equipment, thus removing the repair time form the outage duration. In
addition, current underground installations utilize underground pipes and cable can
typically be replaced simply by pulling out the bad cable and pulling in new cable.

14. Can I have just the lines in front of my house buried if no one else in my
neighborhood wants to participate?
For system reliability reasons, FPL will only convert the system to underground if one
full block or more is converted at the same time. FPL's typical underground system is a
"looped" system, which means power can be supplied to the same transformer from two

different directions. Depending on the location, more than one block may need to be
converted in order to complete this "loop."
FPL also adds the following on their website

4. What are the different strengths and weaknesses of overhead and
underground service that affect performance and reliability?
While underground facilities are not as susceptible to wind and debris -blown
damage, they are more susceptible to water intrusion and local flood damage, which can
make repairs more time consuming and costly. Overhead facility damage is easier to
locate than underground and can generally be repaired quicker. Underground
interruptions may be less frequent, but typically last longer due to more complex repair
requirements. Following recent hurricanes, we've found that areas that took the longest to
repair were generally those served by underground facilities still flooded days after the
storm passed. Damage and corrosion of underground electrical systems often shows up
days or even months later, causing additional outages and inconvenience to customers.
Storm winds can damage both types of systems, causing outages. Overhead systems face
outages resulting from trees and debris blowing into lines. Underground systems face
outages from trees collapsing on above -ground transformers and switch boxes or from
tree root systems uprooting buried cable when trees topple. While a neighborhood may be
locally served by underground cable, all electric service eventually comes back above-
ground and connects to overhead service, either in the surrounding neighborhoods, or
further down the street. So, exposure to above -ground electric service from weather,
animals and trees is never fully eliminated.
After the tropical storms of 2004 and 2005, FPL prepared a plan to improve the ability of
it facilities to withstand weather impacts. This plan was entitled "STORM SECURE:
FPL'S FIVE POINT PLAN TO BUILD A STRONGER GRID FOR THE
FUTURE". On Page 3 of the plan, the five elements of the plan are listed. Element
number 4 is as follows:
4. Promote undergrounding by (a) investing 25% of the cost of local-govemment
sponsored overhead -to -underground conversion projects otherwise borne by the
requesting locality, (b) aggressively encouraging local ordinances and legislation
requiring developers to provide underground electrical service for all new
subdivisions, developments and projects, and (c) facilitating local undergrounding
projects by allowing underground conduit and cable, and associated above -ground
transformers and switch cabinets to be placed in road rights-of-way under specific
standards and agreements.

In response to this element, FPL proposes the following actions in their report:
IV. Undergrounding
Currently 37% of FPL's distribution infrastructure is underground. FPL's current policy
is to install underground facilities in high density areas where multiple power lines are required
to serve customers, or where local ordinances require underground construction for new
residential subdivisions. Pursuant to FPSC rule, FPL's customers pay the differential cost
between overhead and underground pursuant to existing tariff. There are specific applications
under which underground service is less desirable than overhead service for reasons of site
engineering or due to extended outages after storm surge or flooding. However, analysis from
the 2004 hurricanes and Hurricane Katrina which impacted FPL's service area indicated that
underground facilities incurred fewer main line (feeder) interruptions during each hurricane. In
addition, we recognize that many communities have expressed an interest in pursuing conversion
from overhead to underground. Therefore, FPL intends to take the following actions:
- Promote the conversion of electric distribution facilities from overhead to
underground by offering to invest 25% of the cost of local government-sponsored
conversion projects otherwise home by the requesting locality, with the FPSC
recognizing such investment as new plant in service
o All property located within any area designated by the locality for conversion
would be required to convert from overhead to underground service in order to
ensure that the potential benefits to the new underground area's robustness are not
compromised by interceding overhead facilities that are exposed to causes of
overhead outages
Aggressively enhance existing efforts with local governments to strongly encourage
ordinances requiring developers to provide underground electrical service for all new
subdivisions, developments and projects
- Support legislation that would require developers throughout the state to provide
underground electrical service for all new subdivisions, developments and projects
- Support and assist efforts of communities to obtain funding assistance from federal
and state agencies to defray costs of underground conversion projects
- Facilitate local undergrounding projects by allowing underground conduit and cable,
and associated above -ground transformers and switch cabinets to be placed in road
rights-of-way under specific standards and agreements
During the upcoming meetings, I hope to have others with first hand experience talk
about their experiences and their opinions of safety and reliability relative to overhead
and underground FPL distribution facilities. As a distribution engineer, as a service center
manager with responsibility for construction crews, and as one who has been called to
review fatal accident sites by FPL claims personnel, I feel strongly about my opinion on
this subject.

This looks good to me with the change you made pursuant to Mark's suggestion in his email of August
17. 1 will have to rely on Mark for the legality of the prepayment issue and the refund, but if he is fine with
it legally then I have no objection to your proposal that the property owners who prepay their
assessments enjoy whatever proportional project budget reduction rebate may apply in the same manner
as those paying by installments.

Mark, as you know assessments run with the property. The Town's position is that a rebate would also
run with the property.
If a property was sold after the pre -payment but before the rebate and arrangements/adjustments were not
made in the purchasing transaction to account for the Rebate, if any, then the new owner will get a
pleasant surprise.

Please note there are two (2) possible methods of payment for this special assessment:
■ Payment Option No. 1 (PREPAYMENT) — Pay the Assessment in full on or before
November 1, 2011 and remove the entire lien from your property: If you pay the Full
Assessment, shown above, on or before November 1, 2011, the entire Total Assessment lien
will be removed from your property. By paying prior to November 1, 2011, you will avoid paying
first year capitalized interest, financing costs, annual interest and future annual administration and
collection costs. No partial payments will be accepted.
Please note that the full assessment is based on best practice estimates of all costs required to
construct the Project. If the actual, final cost is less that the estimated cost by a material factor, an
adjustment to the assessment will be made and a rebate, if any, will be paid to the owner of record

If you do not pre -pay your Full Assessment on or before November 1, 2011, the Total Assessment
lien will remain on your property and be payable only in up to twenty (20) annual installments,
including first year capitalized interest, financing costs, and annual interest and annual
administration and collection costs as a non -ad valorem assessment on your Property Tax Bill
issued by the Palm Beach County Tax Collector. The annual installments will include the principle
amount of the installment plus an interest rate of not to exceed 10% and annual administration and
collection costs not to exceed 5%.
Please note that the full assessment is based on best practice estimates of all costs required to
construct the Project. If the actual, final cost is less that the estimated cost, an adjustment will be
made in future installments.

I request to inspect certain public records for the purpose of informing myself of the historic and current workings of the Town of
