HomeMy Public PortalAbout59-013 (02-17-59) ..- RESOLUTION N0. 59-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD CAI,LING A SPECIAL ELECTION FOR THE PUR- POSE OF SUBMITTING TO THE QUALIFIED ELECTORS RESIDING WITHIN THE TERRITORY KNOWN AS "OZELL MANOR ANNEXATION N0. 9" THE QUESTION WHETHER OR . NOT SAID TERRITORY SHALL BE ANNEXED TO THE CITY OF LYNWOOD. WHEREAS,.the Ci.ty Council of the City of Lynwood did, by Resolution No. 2873, adopted on the 16th day of December i958 declare its intention to call a special election for the purpose of submitting to the qualified electors residing in said certain inhabited territory contiguous to said city the question of whether or not said territory shall be annexed to the City of Lynwood, and WHEREAS,,a copy of said resolution was published as required by law, and. WHEREAS, pursuant to Sections 35120-35121 of the Government Code written objections and protests to the proposed election were not made by the owners of more than one-half of the value of the territory proposed to be annexed as ehown by the last equalized assessment roll, a nd- , WHEREAS, all proceedings have been had in accordance with said resolution�.and the "Annexation Act of 1913," as amended, reference thereto hereby is made for further particulars, NOW,.THEREFORE, BE IT RESOLVED.by the City Council of the City of Lynwood., as follows: Section l. A special election.hereby is called to be held on Tuesday, the 14th day of April i959 in the territory hereinafter described and proposed to be annexed to the City of Lynwood, for the purpose of submitting to the qualified electors residing in said ter- ritory the question whether or not such territory shall be annexed to, incorporated in, and made a part of the City of Lynwood. Said territory is described as follows: Beginning at the intersection of the boundary line of the.City of Lynwood, as said boundary line existed _ .. on September 4, 1958, along the southerly line of the Pacific Electric Railway Companyts right of way, with the center line of Atlantie Avenue, as said center line is shown on map of Tract No. 8716, recorded in Book 145, pages 63 and 64 of Maps, rec'ords of Los Angeles County, California; thence southerly along said center line and continuing southerly a'long the center line.of Atlantic Avenue, as said center line is shown on map of Tract No. 8242, recorded. in Book 115, pages 55 and 56 of Maps, to the southeasterly corner of Lot 2, J. J. Bullis Tract, as shown on map recorded in Book 3, pages 612 and 613 of , Miscellaneous Record-s of said Los Angeles County; thence westerly along the southerly line of said Lot 2 to the easterly boundary line o£ the City of Lynwood as sueh bound.ary line existed on September 4, 1958; thence northerly along said boundary and following the same in all its various courses to the point of beginning. Section 2. That the polls for said election.shall be open at 7 a.m, of the day herein fixed for the holding of said election, and shall be kept open until 7 p.m. of the.same day, when,the polls shall be closed. Section 3. Upon the ballots to be used. at said election there shall be printed the words: SHALL OZEZL MANOR ANNEXATION N0. 9 BE ANNEXED T0, INCORPORATED IN,.AND MADE A PART OF THE CITY OF LYNWOOD? Opposite these words there shall be printed the words "Yes" and "No" and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (X) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Lynwood, and if an elector shall stamp a cross (x) in the -2- voting square after the printed word "No" the vote of such elector shall be counted against such annexation. Except as otherwise provided, the ballots used, the opening and closing of the polls, and the.conduct of the election in the territory shall conform as nearly as possible with Election Code pro- visions concerning General Elections and. with said Annexation.Act of 1913, as amended. � Section 4. For the purpose of said election there hereby is established in the territory_described herein one (1) voting precinct, which shall include all of said territory so proposed to be annexed. The following is the polling place.of said election precinet, and the following named. persons hereby are named officers of said election and shall constitute the Board of Election for such election precinct: Polling Place: 11814 4th Avenue, Los Angeles County, California. Inspector: Mrs. Eva H. Brake£ield Jud�es: Mrs. Lela E. Sanders Mrs. Anna H. Stone .For their services in connection with said election, the Inspector shall receive $10.00, and said judges $10.00 each; the person in possession of the polling place named herein shall receive for the use of such premises in connection with said election, the sum of $8.00. Section 5. The City Clerk o£ the City of Lynwood is authorized to cdnduct said election and perform the duties imposed upon him in accordance with the provisions of the Elections Code of the State of California and said Annexation Act of 1913, as amended. Section 6. The City Clerk sha'll certify to the adoption of this' resolution and is hereby directed to cause a notice of said special election to be published at least once a week for the four weeks prior to the date of the election in the Herald American, a newspaper of general circulation printed and published outside of the City oF Lynwood but within the County of Los Angeles, California, and circulatal -3- within said territory proposed to be annexed.. .APPROVED and ADOPTED this 17th day of February 1959• ' � ����--�-� ��� �I�� ,i � AT ST: F � 1 �I � ,, — � � STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES: ss.
