Member Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.03-07
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO DEAN JOHNSON
WHEREAS, Dean Johnson (the "Applicant") has requested a conditional use permit to
construct a commercial office/storage building on land generally located east of County Road 19
and south of Leonard's Lane (the "Property"); and
WHEREAS, the application was reviewed by the planning commission at its meeting on
November 12, 2002; and
WHEREAS, the matter was considered by the city council at its meetings of December 3,
2002 and January 7, 2003; and
WHEREAS, it has been determined that the construction of the proposed building will not
impede the orderly development of adjacent properties for the purposes for which they are zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that a conditional use permit be granted to the Applicant for construction of the
proposed building pursuant to the plans and specifications submitted to and approved by the city,
subject to the following terms and conditions:
1. The height of the building as constructed must be one foot lower than shown on the
plans and specifications submitted by the Applicant;
2. The east, south and north facades of the building must be constructed in accordance
with the modulation standards of the city's zoning ordinance;
3. Additional landscaping units must be installed on the south and east sides of the
building and around the outside storage area;
4. All exterior lighting fixtures must be designed and installed so that the light is
downcast with no globe or light source visible from adjacent properties or rights of
way;

5. Outside storage shall be limited to one truck and one trailer with city -approved
screening around the area;
6. All refuge and garbage containers must be stored inside the building;
7. The Applicant must comply with all conditions of the city engineer;
8. The Applicant must comply with all conditions of the Elm Creek Watershed
District;
9. The driveway to County Road 19 must be constructed in a location and in
accordance with the requirements of Hennepin County. The Applicant
acknowledges that the driveway is temporary and will likely have to be relocated
when the Property is developed with permanent structures;
10. All conditions of construction and design must be provided to the city before any
development or permits will be granted for the Property; and
11. The Applicant must pay to the city a fee in the amount determined by the staff to
represent the actual cost to the city of reviewing this conditional use permit
application.

The motion for the adoption of the foregoing resolution was duly seconded by member Lane and
upon vote being taken thereon, the following voted in favor thereof:
Lane, Zietlow, Smith and Brinkman.
and the following voted against same: None. Absent: Workman
Whereupon said resolution was declared duly passed and adopted.
