TAB 6 CITY COUNCIL SPECIAL WORK MEETING IONA COMMUNITY CENTER JULY 17, 2018 6:00 P.M. PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member John Price, Council Member Michael Thompson, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse, Chief of Police Karl Bowcutt, City Clerk Shara Roberts, and City Clerk Keri West. ABSENT: None. VISITORS: None. ITEMS OF BUSINESS: Discussion of Targhee Regional Transportation Authority (TRPTA): Funding Request: Mayor Gubler explained this funding request was presented during the previous City Council meeting. Council President Geray expressed due to the lack of use by Iona residents, he does not feel it's worth funding at this time. Mayor Gubler entertained a motion. Council President Geray moved to not provide financial funding support for TRPTA at this time. Council Member Thompson seconded the motion. All in favor, motion carried. Mayor Gubler directed Clerk West to follow up with email correspondence regarding the Council's decision. Discussion of City of Idaho Falls Animal Shelter Increase: Mayor Gubler explained this was discussed during the previous City Council meeting and inquired if Treasurer Sullivan had an opportunity to follow up with Attorney Rawlings. Council President Geray inquired if they were able to confirm a contractual agreement with the City of Idaho Falls. If not, he recommended Attorney Rawlings draft a letter directing them to Bonneville County with whom we have a contract. Attorney Rawlings confirmed the City does not have a contract with the City of Idaho Falls. However, there could be the potential for the City of Idaho Falls to argue there is an implied contract benefit through the contract with Bonneville County. Chief Bowcutt reported he contacted Bonneville County to seek clarification on whether the shelter is inclusive of the contract. They stated they would get back to him. In closing, Mayor Gubler stated we need more information from Bonneville County regarding the scope of services of our contract, prior to any correspondence with the City of Idaho Falls. Discussion of Fiscal Year 2019 Preliminary Budget: Mayor Gubler asked if everyone had a chance to review the information presented by Treasurer Sullivan from last month. 1 Chief Bowcutt presented the possibility of hiring a third part-time officer, at 19 hours per week which would not require paying insurance and benefits. If approved, he discussed rehiring Officer Dustin Mathie, who has experience with the City. Chief Bowcutt stated the cost of hiring this officer would be $19,760 in wages, and $3200 in payroll taxes. Council President Geray expressed concern this was not discussed earlier, as approval would need to be obtained prior to final budget. He recommended adding it to the agenda as a separate action item for our next City Council Meeting. Chief Bowcutt indicated police grants would be increasing and felt $9,500 would be a plausible number for police grants. In closing, the Council discussed taking .5% on property taxes and would make official approval of the preliminary budget in the City Council Meeting. PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member John Price, Council Member Michael Thompson, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse, Chief of Police Karl Bowcutt, City Clerk Shara Roberts, and City Clerk Keri West. ABSENT: None. VISITORS: James West, Heather Marley, Brad & Dana Andersen, David Noel, and Nathan Seedall. Mayor Gubler welcomed everyone and Council Member Price led with the Pledge of Allegiance. A roll call was taken to open the meeting. CONSENT AGENDA: City Council Special Work Meeting and City Council Meeting Minutes of June 26, 2018 were reviewed. Council reviewed the finance reports for the period ending June 30, 2018 (75% of the fiscal year elapsed). The City had $839,037.59 in the bank and routine bills had been paid, "Exhibit A. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Thompson seconded the motion. All in favor, motion carried. ITEMS OF BUSINESS: Public Hearing — 7:15 pm: Approval of Annexation and Zoning Ordinance, Amendment to the Comprehensive Plan, Annexation Agreement with the Developer, and a Final Plat for the Freedom Field Estates Subdivision: Mayor Gubler reported the public hearing to finalize the Freedom Field Estates Subdivision was cancelled, and will be rescheduled on Tuesday, August 21, 2018. Clerk Roberts indicated she would follow up with Rockwell Homes regarding necessary documents in order to meet required legal notice for the hearing. Mayor Gubler announced a quick recess for the purpose of presenting a plaque of appreciation to Clerk Roberts and an opportunity for those to wish her farewell. Approval of Fiscal Year 2019 Preliminary Budget: Mayor Gubler reported this was discussed previously during the work session meeting. Council President Geray outlined they discussed increasing police revenue from $1,000 to $10,000. Mayor Gubler outlined they discussed increasing capital improvements by $18,000, and asked Director Prouse if there were specific items or projects those funds would be allocated for. 1 Director Prouse indicated $18,000 in capital improvements could be reallocated towards balancing the Police Department budget. Mayor Gubler entertained a motion. Council President Geray moved to approve the FY2019 preliminary budget of $4,835,840 with the changes as discussed accompanied by a 0.5% increase in the property tax levy rate. Council Member Thompson seconded the motion. Approval of the preliminary budget was taken by a roll call vote: Council President Geray: YES Council Member Price: YES Council Member Thompson: YES Council Member McNamara: YES After further discussion, the Council determined they needed to amend the earlier motion to include the total between both the general and water funds. Mayor Gubler entertained a motion. Council President Geray moved to amend the earlier motion to adjust the value previously indicated to $5,819,195 for a total of the general and water budgets. Council Member Thompson seconded the motion. Approval of the preliminary budget was taken by a roll call vote, "Exhibit B": Council President Geray: YES Council Member Price: YES Council Member Thompson: YES Council Member McNamara: YES Approval of New Business License — Kreatrix Media Agency: Mayor Gubler presented the new business license application for approval. Council President Geray requested an item of business be added to next month's meeting to discuss the need for home based business licenses. Mayor Gubler expressed it appears this particular business will be approaching other businesses about marketing, and will not have clients coming to the home. Mayor Gubler entertained a motion. Council Member McNamara moved to approve the new business license application for Kreatrix Media Agency. Council President Geray seconded the motion. All in favor, motion carried, "Exhibit C. Introduction & Oath of Appointment of Keri West as City Clerk: Mayor Gubler administered the official oath of appointment for Keri West as the new City Clerk, "Exhibit D. Appointment of Andrew Rawlings as City Attorney: Mayor Gubler entertained a motion. Council President Geray moved to appoint Attorney Rawlings as the City Attorney for the City of Iona. Council Member McNamara second the motion. All in favor, motion carried. Approval of Parking Lot/Walking Path Seal Coat Bids: Director Prouse reported he received four bids for seal coating of the parking lot and walking paths in Iona Square, and is seeking approval for the lowest bid of $15,825 with HK Contractors, Inc. 2 Mayor Gubler entertained a motion. Council Member Thompson moved to approve the parking lot/walking path seal coat bid. Council Member McNamara seconded. All in favor, motion carried. Discussion & Approval of Radar Speed Signs: Mayor Gubler reported they have purchased one radar sign from the Police Department's budget, and received a grant for one radar trailer. Mayor Gubler presented purchasing two more additional radar signs for the purpose of increasing safety in the school zone which would be permanently affixed. However, there are not funds within the Police Department's budget to pay for those this fiscal year and is requesting the Council to approve the purchase of those from the City's General Fund for a total cost of $5,499. Council Member Thompson inquired if the signs include any data analysis. Chief Bowcutt confirmed they did. After further discussion, the Council decided to table the purchase of two additional signs until there is a data study conducted on the existing radar sign. Discussion of Stop Signs on the Corner of Rockwood Avenue and Haderlie Lane; Corner of Steele Avenue and Haderlie Lane: Mayor Gubler outlined this topic was recently discussed at Iona's Planning and Zoning Meeting and expressed it would have been more appropriate to discuss it on the City Council's agenda. Chief Bowcutt and Director Prouse explained that the main concern is the southbound traffic doesn't have a stop sign on Haderlie Lane. Director Prouse mentioned that he has spoken with Bonneville County and they advised there should be a stop sign for southbound traffic on Haderlie. The main concern is that the homeowner there has planted several trees on the right-of- way that would need to be removed to install the stop sign. Bonneville County suggested keeping it the way it is because there is not sufficient traffic to justify the removal of a resident's trees. Director Prouse added it is not a very high traffic area. Safety should be the number one concern; however, he agrees with Bonneville County that there is not enough traffic to consider this a problem area. The situation has improved since the current stop signs were yield signs. Director Prouse stated an appropriate topic that he would like added to the P&Z agenda is what is being allowed in our swales currently, such as trees and other dangerous, permanent structures. Trees should not be allowed due to the effect they have on the infrastructure underground. It is the role of P&Z to look into those issues and make recommendations for the City Council to revise the Code. Discussion of Title 8, Chapter 2, Section 14 — Water System Connection Fees: Mayor Gubler explained the Council raised the water connection fee a few months ago, based on the information at that time. After receiving the water system appraisal and related report, it is now apparent we are still too low on the appropriate connection fee, given the appraised value of the water system. He stated the Council will need to start looking into what that needs to be raised to, either now or in the near future. Mayor Gubler recommended waiting until we have a signed document with Rockwell on Freedom Field Estates. 3 Council President Geray questioned what the actual numbers were on the report and stated he does not recall receiving the appraisal report. Mayor Gubler reported it was approximately $6,000 median value on the official appraisal of the water system. He then requested the City Clerk to locate the numbers and have them prepared for a future discussion. Council President Geray reiterated the importance of the actual numbers to discuss the value and urgency in the connection fee being raised again. Mayor Gubler advised the Council to table this discussion until after we receive the signed contract with Rockwell Homes. Council President Geray agreed. General Water System Discussion: Dave Noel with Forsgren Associates addressed the Council and informed them we received the temporary right of way for the property on the hill. Mayor Gubler summarized the progress acknowledging the main concern was elevation. He stated we have now completed the actual survey and dug the necessary holes, which is what Dave Noel is presenting to the Council at this time. Council President Geray acknowledged receiving the emailed survey, but requested a more in depth description of what it encompasses. Dave Noel presented the plot map to the Council and explained where the bore holes were dug to determine the surface of the rock. He also showed where he plotted the ground and superimposed a tank that is the same elevation as the existing tank. Based on the calculations, there would need to be a substantial amount of backfill brought in for the initially planned tank location. Mr. Noel continued with the possibility of sliding the tank to the west a few feet to eliminate the need for that much backfill. Mayor Gubler mentioned this scenario would require blasting only 3 feet of rock, which would be more cost effective than to bring in that much backfill. Mr. Noel stated their estimate of foundation costs between the two sites would be $175,000. Blasting would cost less money and the stability of the structure would be improved. Council President Geray questioned the actual values, if there is a difference of $175,000. Mr. Noel stated he did not have the total costs of the foundations calculated, just the difference it would take to fill the site versus blast the other site. Council President Geray voiced concern the original numbers were drastically understated on the budget for backfill. Mr. Noel explained the numbers were calculated differently when they discussed a different style of tank and the bottom line would be unchanged, if we choose to blast the alternate site. Mayor Gubler discussed the progress on the permanent right of way application. Mr. Noel confirmed he only needs a few data points to complete the application. He continued that we will need to put together a summary diagram, which will include more detail. Mayor Gubler recommended if we choose not to build on the property we own yet, we will just sit on it and could use it for something else in the future. Dave Noel requested confirmation from the Council if the direction they are working towards with the structural design is for the BLM property. The Council was in agreement. Mr. Noel confirmed the application should be done shortly and he will submit it to BLM for review. 4 Iona Days: Mayor Gubler received questions regarding set up in the park on Friday. After discussing concerns of security with Chief Bowcutt, they have chosen to hire Tactical Security for $120, to maintain security in the park all night. Mayor Gubler inquired about coordination with traffic. Chief Bowcutt confirmed we will receive help from Bonneville County to assist with traffic. Director Prouse confirmed two dumpsters will be brought in, one in the parking lot and the other at the north shelter, as well as two extra portable bathrooms. Council Member McNamara asked what time the Council is helping with lunch. Council President Geray confirmed the City Council is assisting with lunch from 11 am-2pm. Council Member Thompson questioned if there were concerns with finances for Iona Days. Mayor Gubler stated he is nervous, but has been assured that the donations should cover the cost. STAFF REPORTS: Director Prouse reported seal coating has been scheduled for the 2nd week in August. PUBLIC COMMENT: No public comments were made at this time. Licenses shall be issued upon payment of the fees specified in this Title, upon the applicant's compliance with the applicable provisions of this Title and upon approval of the City Council. All licenses shall be a personal privilege of the holder. Except as expressly provided in this Title, a license shall become null and void if the holder ceases to personally supervise, conduct and operate the trade or business for which the license has been issued. Unless otherwise provided in this Title, no license fee or any part thereof may be refunded even though the licensee does not operate for the period or any portion of the period for which the license was issued. 4-1-2: FORM OF LICENSE: The City Clerk shall prepare license forms for licenses issued under this Title. The license shall specify the holder's name, the type of business licensed, the principal place of business of the licensee and the expiration date of the license. The Clerk shall account for all licenses signed by the Mayor, shall countersign the licenses and deliver the licenses to licensees. The City Clerk shall collect all license fees and promptly deliver them to the City Treasurer. The City Treasurer shall issue a receipt for any license fees received from the Clerk. 4-1-3: LICENSE FEES PAYABLE IN ADVANCE: License fees shall be paid in advance at the office of the City Clerk. 4-1-4: APPLICATION FOR LICENSE: Any person desiring to obtain any license provided for in this Title shall first apply in writing under oath to the City Council. The application together with the license fee shall be delivered to the City Clerk. The City Clerk shall prescribe the form of the application. The application shall contain the following information. (A) Applicant's full name, form of doing business, (i.e. sole proprietorship, partnership or corporation) and the name under which the business is to be conducted; (B) Applicant's state of residence and principal place of business; (C) Applicant's business and residential mailing addresses and telephone numbers; (D) The street address within the City where each place of business is to be conducted; (E) The nature of the business to be licensed; (F) The number of years the applicant has engaged in such business; (G) The zoning of the property on which the business will be conducted; and (H) Any other information required by this Title or by the Clerk in order to determine the applicant's fitness or qualifications for the license. The City Clerk shall forward a copy of each business license application to the Chief of Police, the Fire Chief, the Director of Planning and Building and the State of Idaho Department of Health, as applicable, and other appropriate City Division Directors for their review and recommendation. 4-1-5: TEMPORARY LICENSE: Upon receipt of the affirmative recommendation of the Chief of Police, Director of Planning and Building, and other City Division Directors, as appropriate, the Clerk may issue a temporary license to any applicant, except applicants for liquor -by -the -drink, message therapists or itinerant merchants licenses. Such temporary license shall expire upon the issuance or denial of a license by the Council or at the expiration of thirty (30) days after the date such temporary license was issued, whichever is sooner. Such temporary license shall state its expiration date on the face thereof. 4-1-6: APPROVAL OF LICENSE: Except as otherwise provided in this Title, the City Clerk shall present all license applications to the City Council not later than the second regular Council meeting after the application was delivered to the Clerk. At that meeting, the City Council may grant or deny the application or refer it to the appropriate City division for further investigation and review. In any event, the Council shall grant or deny the application on or before the second regular Council meeting following its initial presentation to the Council. After due consideration of the application, the Council shall either grant the application and order the Clerk to issue the license or deny the application and return the license fee with a notice of rejection to the applicant. The Council may deny the application upon finding that the applicant does not meet any of the qualifications of this Title, that applicant's conduct of business will contravene any provision of the City's Building Code, Fire Code, Zoning Ordnance, or any other applicable regulation, ordinance or statute of the City, Bonneville County, State of Idaho or the United States, that the applicant has been convicted of a felony, or that the applicant has engaged in any fraudulent, deceptive or unlawful business practices within ten (10) years prior to the date of his or her application for a business license. 4-1-7: LICENSE NONTRANSFERABLE: Except as specifically provided by this Code or State law, licenses issued by the City shall not assigned or transferred to any person other than the named holder. Issuance of a license by the City shall not authorize any person other than the person or entity named thereon to conduct such business; nor shall it authorize any business other than that named to be done or transacted. Issuance of a license shall not permit the named business to be conducted in any place other than the location or locations described in the application without prior approval of the Council. All licenses shall state the location of the business upon the face thereof. 4-1-8: SEPARATE LICENSES REQUIRED: A separate license and license fee shall be required for each business subject to the provisions of this Title, regardless of whether two (2) or more businesses are conducted or operated by the same person or entity or whether two (2) or more businesses are conducted within the same building or at the same location. 4-1-9: REVOCATION OF LICENSES: The Council may revoke any license issued under this Title at any time if the licensee does not comply with the applicable provisions of this Title or for other just cause. Before revoking any license, the City Clerk shall give written notice to the license holder of such proposed action at least ten (10) days prior to the date such proposed action is submitted to the Council. The license holder shall be given an opportunity to appear before the Council and show cause why his or her license should not be revoked. 4-1-10: DISPLAY OF LICENSE: All licensees shall post their licenses in a place conspicuous to the public in each business location and shall produce the license whenever required by any officer or other person having the authority to examine it. If an applicant desires to conduct business in more than one location, the Clerk may issue duplicate originals of the license for display in each place of business. 4-1-11: EXPIRATION DATE: No license shall be granted for a period greater than one year, and all licenses shall expire on December 31 of the calendar year for which they are issued, unless another expiration date is endorsed on the license by the Clerk. AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018, AND ENDING ON SEPTEMBER 30, 2019, APPROPRIATING THE SUM OF $ 5,819,195.00 TO DEFRAY EXPENSES AND LIABILITIES OF THE CITY OF IONA FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSE FOR WHICH SAID APPROPRIATION IS MADE. BE IT ORDAINED by the Mayor and City Council of the City of Iona, Bonneville County, Idaho. Section 1: That the sum of $ 5,819,195.00 be, and the same is appropriated to defray the necessary expenses and liabilities of the City of Iona for the fiscal year beginning October 1, 2018. Keri West City Clerk \\ Law \data\WPDATA\DWS\2708 City of Iona\ Annexation \2018 - Freedom Field Estates\Annexation ORD v02.doex -3 ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES (Prior to Platting) This ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES ("Agreement") is entered into effective as of August 21, 2018 (the "Effective Date"), by and between the CITY OF IONA, an Idaho municipal corporation (the "City"), and ROCKWELL HOMES INC., an Idaho corporation (the "Developer"). The City and Developer are individually referred to herein as a "Party" and collectively as the "Parties." RECITALS A. Developer is the sole owner, in law or equity, of a certain tract of land in the County of Bonneville, State of Idaho (the "Property"), which is more particularly described in Exhibit A hereto, which is incorporated herein by reference. B. Developer has requested the Property be annexed to the City. C. The City has previously approved a preliminary plat, which is hereby incorporated herein by reference (the "Preliminary Plat"), that describes Developer's planned development of the Property and shows all of the roads/streets referred to herein. D. The City Engineer has recommended such annexation be granted subject to certain requirements and obligations on the part of Developer. E. The City is willing to annex the Property to the City and Developer consents to the annexation of the Property to the City pursuant to the terms and conditions of this Agreement, including the Special Conditions further described in Section 16, below. AGREEMENT NOW, THEREFORE, in consideration of the covenants and conditions set forth herein, the Parties agree as follows: 1. Annexation. The City agrees to annex the Property to the City, subject to Developer's performance of the terms and conditions of this Agreement. 2. Improvement Plans. Developer anticipates that development of the Property will occur on portions of the Property in phases or divisions ("Phases" and each a "Phase"). Prior to the commencement of any construction or development within or upon any portion of the Property, Developer shall file with and obtain the approval of the City Engineer an improvement plan ("Improvement Plan"). The Improvement Plan will detail all streets, sewer lines, water lines, storm drainage facilities, street signs, traffic control devices, barricades, and other public improvements necessary to protect and provide for the health and safety of the occupants of the Property. Each Improvement Plan shall also show the proposed location of other public utilities (telephone, gas, and electricity) and irrigation facilities affected by the construction or development of such Phase. 3. Construction of Public Improvements. Unless otherwise agreed by the Parties in writing, Developer will, at its expense, design and construct all public improvements necessary to provide for or protect the health, safety, or welfare of the occupants of the Property including, but not limited to the construction of streets, sidewalks, curbs, gutters sidewalks, water and sewer facilities, storm drainage, and other necessary utilities. Unless otherwise agreed in writing by the City Engineer, Developer will construct all such public improvements in strict accordance with the Idaho Standards for Public Works Construction ("ISPWC") contained in the ISPWC 2017 Edition, or such newer edition as is published after the Effective Date but before the City's approval of any Final Plat (as defined below) relating to the development of the Property (hereafter referred to as the "Standard Specifications") or such other standards and specifications adopted by the City and in effect at the time the construction is accomplished, whichever is more stringent. The Standard Specifications are incorporated herein by reference as though set forth in full. 4. Permits. Developer shall obtain all right-of-way, excavation, or other permits required by local ordinance and comply with all requirements therein with respect to the timely performance of the work governed by such permits. 5. Completion of Public Improvements. 5.1. Developer agrees that upon a finding by the City Council, duly entered in the official minutes of the proceedings of the City Council, that streets, sewer, water, or other public improvements need to be completed in the interest of the public health, welfare, or safety, Developer will (a) forthwith file improvement drawings for such improvements, (b) obtain the approval thereof from the City Engineer, and (c) forthwith construct such public improvements. 5.2. If Developer does not commence construction of such public improvements within a reasonable time after such finding is made or if Developer does not complete such construction within a reasonable time thereafter, the City may construct or complete such facilities at Developer's expense. 5.3. The City Council shall not make such finding unless Developer has been given at least ten (10) days advance written notice of the date and place of the meeting and Developer has been given an opportunity to be heard at such meeting. At or before the meeting, the City Engineer shall furnish Developer a cost estimate for completing the required portion or portions of such public improvements. 6. Inspection. Developer will retain a professional engineer, licensed within the State of Idaho (the "Project Engineer"), to supervise, inspect, and test the construction of all public improvements constructed by Developer in order to ensure such improvements are constructed in accordance with this Agreement, the applicable approved Improvement Plan, and the Standard Specifications. Developer will not materially deviate from the 2 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES applicable approved Improvement Plan or Standard Specifications without the express written approval of the City Engineer. 7. Corrected Improvement Plans. Prior to acceptance of any Phase, Developer will file an `As Constructed' Improvement Plan (a "Corrected Improvement Plan") with the City Engineer. Such Corrected Improvement Plan shall be prepared by the Project Engineer and shall show the actual constructed location of all public improvements within such Phase, including but not limited to the horizontal and vertical location of all water, sewer, and storm drain lines; individual building service lines; curb and gutter alignment; and street grades. Such Corrected Improvement Plan shall also specifically show all changes from the original Improvement Plan and the public improvements as actually constructed. The Project Engineer shall also certify upon each Corrected Improvement Plan that such plans correctly show all public improvements as actually constructed and that such public improvements have been constructed in accordance with the Standard Specifications in effect at the time such construction was accomplished. The Project Engineer shall also deliver to the City Engineer the Construction Report as defined in SC-11 in Exhibit B hereto (see below). 8. Final Plat. Developer agrees not to commence the construction any building or structure within and upon the Property until a final property plat (hereinafter referred to as a "Final Plat") of the area encompassing the Phase where such building or structure is contemplated, has been duly prepared in compliance with Idaho Code § 31-3805 and Chapter 13, Title 50, Idaho Code, as amended, and has been approved by the City pursuant to the Subdivision Ordinance of the City. 9. Sale, Lease, or Conveyance of Part of Property. Developer agrees not to sell, lease, or convey any portion of the Property unless a Final Plat for the portion to be sold, leased, or conveyed has been approved by the City and recorded in the Bonneville County Recorder's office. 10. Acceptance of Property. Upon satisfactory completion of the public improvements and facilities, Developer's delivery of Corrected Improvement Plans, and the filing and approval by the City of a Final Plat, the City will accept the public ownership and maintenance of all public improvements located within or upon that Phase for which a Final Plat has been approved. Such acceptance shall not be valid unless expressly acknowledged in writing by the City Engineer. Except as otherwise expressly provided in the Special Conditions (described in Section 16, below), upon acceptance of such improvements, the City shall assume ownership and control of all public facilities within any dedicated street or public utility right-of-way within the Final Plat. Acceptance of a Phase shall not be deemed as a waiver of Developer's failure to fully and completely perform the terms and conditions hereof or as a waiver or release of the warranty set forth below. 3 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES 11. Warranty. Developer warrants that the materials and workmanship employed in the construction of all public improvements within the Property shall be good and sound and shall conform to generally accepted standards within the construction industry. Such warranty shall extend for a period of one (1) year after acceptance by the City of any Phase within which such improvements are located, provided nothing herein shall limit the time within which the City may bring an action against Developer on account of Developer's failure to construct such improvements in accordance with this Agreement, the Improvement Plan, or the Standard Specifications. Developer and Developer's heirs, successors, and assigns shall and do hereby warrant and agree to defend the quiet and peaceful possession of the City in all easements, rights -of -way, street dedications, or other estates or interests conveyed to the City pursuant to the terms of this Agreement or pursuant to any Final Plat which is filed hereafter, from and against all claims against Developer and Developer's successors or assigns and against every person whomsoever who lawfully holds, or who later lawfully claims to have held, rights in the premises as of the date of this Agreement. 12. Arterial Street, Surface Drainage and Other Impact Fees. Developer agrees to pay all Arterial Street and Bridge Fees, Surface Drainage Fees, or any other impact fees in force at the time of the approval of a Final Plat covering any portion of the Property. The calculation of such fees shall be based only upon the area included within such Final Plat. Such fees shall be paid in full prior to the approval of such Final Plat by the City and the amount and other terms and conditions regulating the payment and imposition thereof shall be in accordance with the City ordinance in effect at the time such Final Plat is approved. 13. Water and Sewer Main Connection Charges. Developer agrees to pay to the City at the time any separate sanitary sewer service or culinary water service connection to the City sanitary sewer system or culinary water system is requested, all connection fees, main connection charges, and main charges as set forth in the City Code in effect at the time such request for service is made. 14. Rezoning of Property. Nothing herein contained shall restrict the right of the City to change the zoning of the Property following procedures established by City Zoning Ordinance and the Idaho Local Land Use Planning Act, as amended. 15. Participation by City. The Parties agree that those portions of the water main, the sanitary sewer line, storm drains, and street section work (hereafter collectively referred to as the "Shared Work"), the cost of which the City has expressly agreed to pay pursuant to the Special Conditions attached hereto, including any water or sewer line or storm line extensions, increased line size or capacity and road width or thickness, are required because of future service needs originating from properties not owned by Developer and located within the vicinity of the Property and that sound planning requires construction thereof at the present time in order to accommodate future expansion and development. In recognition of the cost savings that can be accomplished by construction of such excess 4 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES capacity and improvements concurrently with the facilities to be constructed for Developer's purposes, and the impracticality or impossibility of constructing such excess capacity and improvements separately or at a later time, Developer agrees to design and construct such facilities subject to the City's agreement to reimburse Developer for a portion of such costs, all as set forth in the Special Conditions. The City shall have no obligation to pay for any portion of the costs of the Shared work unless prior to the commencement of the work the Parties have expressly agreed in writing to a specific amount for which the City will reimburse the Developer. Payment of such costs by the City shall be made pursuant to the Special Conditions or as otherwise agreed to by the Parties in writing. 16. Special Conditions. In recognition of the unique circumstances relative to this Property, the Parties agree to the Special Conditions specified in Exhibit B hereto, which is incorporated herein by reference (the "Special Conditions"). 17. Occupancy. No building within or upon the Property shall be used or occupied for any purpose other than for the construction of such building or structure, unless a Final Plat has been filed and approved and all public improvements within such Final Plat have been completed and accepted by the City Engineer. The City may withhold Certificates of Occupancy until all such work has been completed. Nothing herein shall prevent the use of a model building for the purpose of Developer's sales promotional efforts provided the building is not occupied for commercial or industrial purposes. 18. Irrigation Facilities. Developer shall relocate or reconstruct all ditches, headgate structures, culverts, siphons, drywells, or other similar appurtenant structures that will be impaired or otherwise disturbed by the construction of this Property. Developer shall also obtain the consent of all persons or entities who have any water right or control over such structures. Developer will also indemnify and hold the City harmless from any action, claim, demand, or cost of any kind, including, but not limited to, attorneys' fees and court costs, arising from the relocation or reconstruction of such facilities or Developer's failure to properly relocate or reconstruct such facilities. 19. Storm Water Discharge Certification. Prior to the acceptance and approval of an Improvement Plan for any portion of the Property, Developer shall obtain the certification of any Irrigation District, canal company, or other entity into which any storm water from such phase or division will be discharged. The certification shall state that such water delivery entity has reviewed and approved the Improvement Plan for such phase or division and that the discharge of storm waters from such area into their canal or ditch in the manner shown in the Improvement Plan is approved and accepted by such entity. 20. Relocation of Power Lines. Developer shall relocate at its expense all existing electric utility poles or other utility lines or fixtures necessary to construct the public improvements within or upon the Property as shown on the Improvement Plans. 5 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES 21. Taxes and Assessments. Developer shall pay all real property taxes and assessments levied or assessed against any interest in real property which Developer has agreed to convey or dedicate to the City pursuant to this Agreement. Such taxes and assessments shall be paid prior to the acceptance by the City of the public improvements within any phase or division of the Property. 22. Default. In the event Developer fails to comply with the terms and conditions hereof in any material respect, the City may, without further notice to Developer, exercise any or all of the following remedies, at the City's election and in the City's discretion: 22.1. Withhold the issuance of any building permit or certificate of occupancy for any structure located within any phase or division of the Property affected by such default; 22.2. Withhold the connection of water, sewer, or electric service to any parcel located within any phase or division of the Property affected by such default; 22.3. Refuse to accept public ownership and maintenance of public improvements within any phase or division of the Property affected by such default and record a notice of such action with the Bonneville County Recorder's office; 22.4. Issue a stop work order for any building under construction within any phase or division of the Property affected by such default; or 22.5. Bring an action for damages, injunctive relief, specific performance, or any other remedy available at law or in equity. 23. Remedies Cumulative. All remedies herein are cumulative and, to the extent not wholly inconsistent with each other, may be enforced simultaneously or separately, at the sole discretion of the City. 24. Recording Fees. Prior to the execution and approval of this Agreement, Developer shall pay to the City all recording fees necessary to record this Agreement with the Bonneville County Recorder's office. Prior to the approval of any Final Plat for the Property (or any portion thereof), Developer shall pay to the City all recording fees necessary to record such Final Plat with the Bonneville County Recorder's office. 25. Notices. Any notice, request, or other communication given under this Agreement shall be in writing and (a) delivered personally, effective immediately; (b) sent by telecopy or facsimile; (c) delivered by overnight express mail (charges prepaid), effective upon receipt; (d) sent by registered or certified mail, postage prepaid, effective upon receipt; or (e) sent by email with receipt acknowledged, effective upon being sent, addressed to the address, fax number, and/or email address provided on the signature page hereto. Notwithstanding any other provision of this Agreement, either Party may at any time change its address for such notices by delivering or mailing to the other Party, in the manner set forth herein, a notice of such change. 6 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES 26. Conflict with Standard Specifications. In the event of any conflict between the terms of this Agreement (including the Special Conditions) or the Improvement Plans and the Standard Specifications, the terms of this Agreement (including the Special Conditions) or the Improvement Plans shall prevail over any contrary provision of the Standard Specifications. In the event of any conflict between the terms of this Agreement and the Improvement Plans, the terms of this Agreement shall prevail. 27. Covenants Appurtenant to the Land. All covenants and conditions set forth herein shall be appurtenant to and run with the Property and shall be binding upon Developer's heirs, successors, or assigns. 28. General Provisions. 28.1. Waiver. Failure of either Parry to require performance of any provision of the Agreement shall not affect either Parry's right to require full performance thereof at any time thereafter and the waiver by either party of a breach of any provisions hereof shall not constitute a waiver of a similar breach in the future or of any other breach or nullify the effectiveness of such provision. 28.2. Attorneys' Fees. If any Party engages an attorney to enforce or interpret any provisions of or rights arising under this Agreement, the defaulting Parry shall pay to the non -defaulting Parties all costs and expenses, including, but not limited to, reasonable attorneys' fees and costs, which the non -defaulting Parties may incur in enforcing this Agreement or in pursuing any remedy allowed by law, whether such is incurred by the filing of suit, on appeal, or otherwise. 28.3. Choice of Law, Venue, and Forum. This Agreement is governed by, and construed and enforced in accordance with, the laws of the State of Idaho. Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Agreement may only be brought against any of the Parties in the state or federal courts in the State of Idaho in and for Bonneville County, Idaho, and each of the Parties consents to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action or proceeding and waives any objections to venue laid therein. Process in any action or proceeding referred to in the preceding sentence may be served on any party anywhere in the world. 28.4. Headings. The headings in this Agreement are for reference only and do not limit or define the meaning of any provision of this Agreement. 28.5. Interpretation. Each party has participated fully in the review of this Agreement. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Agreement. 28.6. Entire Agreement. This Agreement sets forth the entire understanding of the Parties with respect to the matters set forth in this Agreement as of the Effective Date; it 7 - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES supersedes all prior oral or written agreements of the Parties as to the matters set forth in this Agreement except as expressly set forth herein; and it cannot be altered or amended except by an instrument in writing, signed by both Parties. 28.7. Severability. If any provision of this Agreement or any portion of any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the invalidity, illegality, or unenforceability may not alter the remaining portion of such provision, or any other provision of this Agreement, as each provision of this Agreement is deemed severable from all other provisions of this Agreement. 28.8. Obligation and Authority. This Agreement and the Exhibits attached hereto constitute the legal, valid, and binding obligation of the Parties, enforceable against the Parties in accordance with its terms. Each Party has the absolute and unrestricted right, power, and authority to execute and deliver this Agreement and to perform its obligations hereunder 28.9. Counterparts; Electronic Delivery. This Agreement may be executed in counterparts, each of which is deemed an original but all of which constitute one and the same instrument. The signature pages may be detached from each counterpart and combined into one instrument. This Agreement may be signed and delivered electronically (fax or e-mail), a printed copy of which shall be effective as an original. Any Party so delivering such a copy via electronic communication shall deliver an executed original of this Agreement to the other Parties upon request. 29. Effective Date. This Agreement shall become valid and binding only upon its approval by the City Council of the City and upon its execution by the Mayor. Except as supplemented and modified herein, Developer shall comply with all aspects of the Idaho Standards for Public Works Construction ("ISPWC") for water works and street works contained in the ISPWC 2017 Edition, or such newer edition as is published after the Effective Date but before the City's approval of any Final Plat relating to the development of the Property (or any portion thereof, as applicable). SC-2. Street, Sidewalk and Lighting. (a) Typical Street Section. Developer shall construct all streets in accordance with the street section shown on the attached drawing denoted Drawing 1. Developer shall conform to all ISPWC specifications and details for sub -grade, sub -base, crushed gravel, pavement, and sidewalk. (b) Chip Seal. Developer agrees to chip seal all street surfaces constructed on the Property the calendar year following the calendar year in which such street was constructed as platted and paved. (c) Street Signage. Developer shall provide all traffic and street name signage in conformance with ISPWC and Manual on Uniform Traffic Control Devices (2009 Edition, including Revision 1 and 2, both dated May 2012), as published by the United States Federal Highway Administration and most recently supplemented by the State of Idaho (the "MUTCD"). Sign posts shall be made of steel square tubing with the one-piece anchor post per SD (Standard Drawing)-1130 of the ISPWC. Street name signs are to be white lettering on green signage to match existing City name signs and may be installed on the same sign post as the stop sign. (d) Sidewalks. All sidewalks throughout the Property shall be installed by Developer and shall be five feet wide and constructed per the standards required by the Americans with Disabilities Act and all rules and/or regulations associated therewith (collectively, the "ADA"), including connecting sidewalks through the drainage swales in each direction at each street corner using culverts. Sidewalks must be placed over the minimum base requirements given in ISPWC. Sidewalk concrete shall be properly cured by Developer using any method allowed by ISPWC. (e) Street Grading and Swales. Developer shall grade the streets with a vertical (longitudinal) grade not less than 0.4 percent per the City's Subdivision Ordinance and swales in the development in a manner that will prevent flooding in the lower elevations of the development during rain or snow melt on frozen ground events. Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES The Idaho Falls' standard of 1.3 inches multiplied by the contributing area will be sufficient to calculate volume of stormwater to be captured in the swales underground. Hydrologic calculations are to be used to demonstrate success of the grading plan. Infiltration trenches (BMP-8, see Idaho Department of Environmental Quality Catalog of Stormwater Best Management Practices for Cities and Counties or other BMP approved by the City) may be used at periodic low points created with adverse longitudinal grading in the street profiles to ensure flooding does not occur at the lower elevations of the development. (0 Street Lights. In the Improvement Plans, Developer shall depict the location of all street lights, which shall be approved by the City. After approval, the City will contract with Rocky Mountain Power, Inc. ("Rocky Mountain Power") to install, own, and maintain the street lights —which shall be "functional lights" (as described by Rocky Mountain Power) or similar, utilizing (as possible and recommended by Rocky Mountain Power) 33-foot wood poles, LED type bulbs in cobra head lights, mounted on standard metal extension arms —and other necessary related infrastructure. City shall cooperate with Developer to coordinate with Rocky Mountain Power regarding the installation of the street lights at a time appropriate and convenient to Developer's construction. Developer shall pay all costs associated with the installation of the street lights and other necessary related infrastructure. City shall deliver to Developer a copy of the invoice received from Rocky Mountain Power or other proof of payment for the goods and services relating to the street lights (the "Installation Invoice"); and within 14 days of receiving the Installation Invoice, Developer shall provide the City with the full amount charged by or paid to Rocky Mountain Power. Developer shall also pay all costs associated with the ownership, maintenance, and operation of the street lights by Rocky Mountain Power until the City accepts the property pursuant to Section 10, above. City shall deliver to Developer a copy of any invoice received from or other proof of payment to Rocky Mountain Power relating to its ongoing ownership, maintenance, and operation of the street lights (an "Ongoing Invoice"); and within 14 days of receiving any Ongoing Invoice, Developer shall provide the City with the full amount charged by or paid to Rocky Mountain Power. SC-3. Drinking Water System Works. (a) Mainline Pipe. Developer agrees to provide all mainline water pipe shall be AWWA C-900 (DR18) Polyvinyl Chloride (PVC) bell and spigot pipe with rubber gasket joints. All fittings are to be ductile iron. Developer shall install all PVC pipe per the requirements of ISPWC and American Water Works Association ("AWWA") C-605 Underground Installation of Polyvinyl Chloride Pressure Pipe for Water. Flexible couplings for use with pipe shall be as specified in ISPWC. Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES (b) Pipe Lay and Testing. Developer agrees to trench, lay, backfill, pressure test, and disinfect all pipelines in accordance with ISPWC and all applicable AWWA requirements. (c) Trace Wire. Developer shall provide No. 12 AWG insulated copper wire (the "Wire") over the top of all mainline pipe, hydrant runs, and service lines from the mainline to each water meter box. The Wire shall be accessible at the surface at all mainline gate valves and hydrants and meter boxes. (d) Hydrants. Developer shall furnish and install hydrants as required in ISPWC. At each hydrant location, Developer shall place the hydrant centered two feet from the back of sidewalk within the utility easement. Developer shall also locate the hydrant valve in the street. Each hydrant shall be a Mueller Centurian, Clow Medallion, or Waterous Pacer. Each hydrant shall be supplied to accommodate a bury depth of six feet and be painted yellow. (e) Gate Valves. Developer shall furnish and install mainline resilient seated gate valves as per ISPWC. Any valve larger than a 12-inch valve may be the butterfly type. (0 (g) Flush Hydrants. Developer shall provide and install flush hydrants (see the attached drawing denoted Drawing 2) at the end of all permanent and temporary dead-end mainlines. All flush hydrants shall be placed two feet from the back of the sidewalk, within the utility easement. The locations of each flush hydrant are to be plainly shown on each set of Improvement Plans submitted for review and on the Corrected Improvement Plans. Service Lines. Developer agrees to provide residential service lines that are iron pipe size, one -inch diameter, 250 psi rated polyethylene ("PE") pipe per AWWA C-901, as specified in ISPWC. Each service line connection to the mainline shall utilize a service saddle and corporation stop as per ISPWC for use with PE pipe. (h) Meter Boxes and Meters. The City is in the process of changing its meter box standard to the Mueller Thermal -Coil type meter boxes. Developer shall use the 18-inch diameter, 72-inch deep meter box for use with a one -inch meter. Each meter box shall be complete with a side locking cast iron lid, an angle dual check valve, insulation pad, and one -inch lock wing full port ball valve to be used as a shutoff. Developer shall supply one -inch Sensus iPERL meters in each meter box at each lot on the Property or, in the alternative, the City may purchase the one -inch Sensus iPERL meters and Developer shall reimburse the City for the actual purchase costs within thirty days of the date of purchase. Meter Box Placement. Developer shall place each water meter box, with meter, centered two feet from the back of sidewalk within the utility easement in the middle of each lot, while maintaining a horizontal separation of at least 10 feet from (i) Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES 0) the sewer service line. In all cases where the meter/meter box assembly is placed on private property, an easement must be provided with the Final Plat that will allow City access to the meter/meter box assembly. Meter Box Grading and Initiation of Service. The meter lid is to be set at or within one inch above finished grade level, which is defined as the same elevation as the back of the sidewalk in most cases. The City may place a lock in the closed position of each ball valve after the meter/meter box assembly is installed. Any such lock will remain in place until the water account has been established with the City and the meter box installation is approved and accepted by the City. SC-4. Backflow Prevention. Developer or individual homeowners shall install backflow prevention devices as required by the City's Water Ordinance and the Idaho Department of Environmental Quality ("DEQ") requirements, including but not limited to IDAPA 58.01.08. Backflow prevention devices for residential lawn sprinkler systems shall be approved for use in Idaho. These backflow prevention devices shall be installed with a resilient seated shutoff valve or full port ball valve. SC-5. Northside Connections to Developing Water Distribution System and Southwest Connections to Existing Water Distribution System. (a) Division No. 1 Waterline Connections. Developer shall install a 16-inch waterline from a point in 49th North Street (determined in cooperation with the City) directly North of the eastern edge of the Property, along 49th North Street to the eastern entry of the development on 49th North Street (denoted as Thornton Road on the Preliminary Plat). Developer shall install a 12-inch waterline through the Property and connect to the existing 12-inch waterline on Olsen Avenue at the intersection with Rushton Road. All waterline segments described in this subsection shall be placed as part of the construction of Division No. 1 of the Property. Developer shall coordinate the timing of the construction of the waterline segments located outside Division No. 1 of the Property with the City's construction of its new well, storage tank, and water transmission line to be placed in 49th North Street and up on the Iona Hill east of the end of 49th North Street. (b) Reimbursement for Division No. 1 Waterline Connections. The City will reimburse the developer for the material cost difference between 16-inch pipe and 12-inch pipe for the 49th North Street waterline segment and the difference between 12-inch pipe and 8-inch pipe for the waterline segment within the Property. Reimbursable items pursuant to this subsection shall include only mainline valves, mainline fittings, and pipe. Such reimbursement shall be made in the same manner described in subsection SC-5(d), below. (c) Division No. 2 Waterline Extension. As part of the construction of Division No. 2 of the Property, Developer agrees to extend the 16-inch waterline in 49th North Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES Street from the eastern entry into the development (denoted as Thornton Road on the Preliminary Plat), previously installed as part of the construction of Division No. 1 of the Property, pursuant to subsection SC-5(a), above, to a point in 49th North Street (determined in cooperation with the City) directly North of the western edge of the Property. Developer may seek reimbursement for the upsize of the waterline from 12-inch pipe to 16-inch pipe; reimbursable items pursuant to this subsection shall include only mainline valves, mainline fittings, and pipe. Such reimbursement shall be made in the same manner described in subsection SC-5(d), below. (d) Reimbursement Methodology. Reimbursement payments by the City shall be due within thirty days from acceptance of the Property by the City and delivery of an itemized statement to the City setting forth in detail the total amount of the costs for which Developer claims the City is responsible. Such amount shall, for purposes of this Section SC-5, be the difference in price between a quote for the smaller -sized reimbursable items and a quote for the larger -sized reimbursable items; the two quotes shall be provided with the itemized statement, and shall be made on the same date (which date shall be the date the actual materials are quoted for purchase and actually purchased by the Developer and/or Developer's contractor), by the same supplier, with the same supplier price break level to the purchaser applied to both quotes. In any event, the City reserves the right to verify the veracity and accuracy of the quotes, or either of them, through independent means. SC-6. Westside Connection to Existing Water Distribution System. Developer, at its expense, shall lay whatever pipe is necessary; connect to the existing mainline pipe that is extended eastward from Rushton Circle in the easement located within the vacated street running toward what is denoted as Burke Drive on the Preliminary Plat. This connection shall be made through an easement along the south border of Lot 4, Block 5 at the west end of Burke Drive (as depicted on the Preliminary Plat). Developer shall pressure test, disinfect, flush, and ready the waterline for service. SC-7. Connection to Main Street and Southeast Connection to Existing Water Distribution System. To connect the existing North end of Main Street to the Property, including water distribution system connections at that location, the division of work between the City and Developer shall be as described below: (a) Developer. Developer shall: (1) Construct "Main Street" on the Property to the South edge of the Property on a grade suitable for a smooth connection to Main Street (as existing as of the Effective Date and extended by the City pursuant to Section SC-7(b) of this Agreement), in coordination with City Engineer to grade the street and the connection. Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES (2) Construct all mainline waterline work to the connection point of the existing mainline on Main Street, which is South of the South boundary of the Property; make the connection, pressure test, disinfect, flush, and ready the waterline for service. (3) Disconnect the service line (including, but not limited to, digging up the service connection and close corporation stop or otherwise remov the connection and cap) from an abandoned trailer house near the end of the existing mainline in Main Street. (4) Remove any and all existing tree stumps, downed tree debris, and any other debris preparatory to making Main Street a through street from Steele Avenue to the South boundary of the Property. (b) City of Iona. The City shall: (1) Install a new culvert beneath Main Street for the existing ditch located within the Rushton Road right-of-way. (2) Extend Main Street from its existing paved endpoint within the original Iona townsite to the South boundary of the Property for a smooth connection to Main Street, in coordination with Developer and/or Project Engineer to grade the street and the connection. SC-8. Configuration of Intersection at Rushton Road and Olsen Avenue. The City will, at its expense, determine the desired street and traffic flow configuration at the intersection of Rushton Road and Olsen Avenue. The City will prepare the design for the intersection and Developer will construct the improvements per the City's design, which may require Developer to completely reconstruct the intersection. The City will not require reconstruction that includes curb and gutter. The City's design of the intersection may occur before or after Developer's Improvement Plan for Division No. 1 is approved by the City. SC-9. Materials Testing. Developer shall compact the trench backfill materials and street and sidewalk pavement section materials (subbase, minus 3/4" crushed base and asphalt plant mix) using mechanical means under the guidance and support of an independent materials testing firm with compaction testing. Cores taken from the plantmix pavement after laydown are not required. Portland cement concrete used in sidewalks shall also be inspected and tested by an independent materials testing firm. All materials testing (frequency, test standards, etc.) shall be in accordance with ISPWC. Developer's independent testing firm will report all test results to the City Public Works Department (in writing, by email to publicworks@cityofiona.org) on a weekly basis throughout construction. SC-10. Pressure Testing and Bacteriological Testing of Water Lines. Project Engineer shall witness each pressure test segment and monitor each segment proven bacteriologically safe. Developer and/or Project Engineer shall notify the City's Public Works Department (in writing, by email to publicworks@cityofiona.org) 24 hours in advance of each water Exhibit B - ANNEXATION AGREEMENT FOR FREEDOM FIELD ESTATES pressure test so that a representative of the City may, at the City's election, also be present during each test. SC-11. Final Construction Report. Prior to acceptance of any Phase and together with any Corrected Improvement Plan, Developer shall submit a construction report for such completed Phase (a "Construction Report"), which shall, at a minimum, contain each of the following: (a) A compilation of all trench backfill material testing density and inspection reports from independent materials testing firm. (b) A compilation of the Project Engineer's field inspection reports documenting each waterline pressure test and negative bacteriological test set on each waterline segment isolated for testing. (c) A compilation of all street and sidewalk pavement section material testing density and inspection reports from independent materials testing firm. (d) A compilation of all sidewalk Portland cement concrete material testing and inspection reports from independent materials testing firm. These should include field slump and air tests and laboratory cylinder break reports. (e) A compilation of Project Engineer's daily field inspection reports for the duration of the project. A statement from Developer's surveyor certifying that all property corner pins removed or damaged during construction have been restored and are in their proper location if the applicable Final Plat is recorded prior to completion of construction. AutoCad-prepared record drawings with certification that work was accomplished in substantial conformance with the DEQ and City approved plans and specifications. Two options for increasing the fee are given: Option 1 — Use Average Water Right Valuation The average valuation the City groundwater rights is 3.3 million dollars. This amount is the average of the range of valuations given in the report which is 4.15 million dollars on the high side and 2.49 million dollars on the low side. Using this number in the calculation, the connection fee will increase to $6,944. A copy of the calculation is attached to this letter. Option 2 - Use the Low Side Water Right Valuation Using the low side valuation of the City groundwater rights of 2.49 million dollars, the connection fee will increase to $6,035. A copy of the calculation is attached to this letter. Either one of these valuations places the City on firm footing for using a rational method to support the fee increase. The informal estimate originally used in the water connection fee calculation was shown by the Idaho Water Engineering water right valuation document to be very conservative. We suggest the City update the Water Connection Fee binder provided to you a year ago by adding a copy of this letter, the attached calculations and the Idaho Water Engineering water right valuation document to it at the appropriate locations.
