CALL TO ORDER Chairman Vizcarra called the Community Redevelopment Agency Regular Meeting to order at 10:21 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: 3. CONSENT CALENDAR Member - Chavez, Sternquist, Wong, Yu, Vizcarra Member -None Executive Director Pulido, Interim Authority Counsel Vail, Assistant Executive Director Lambert, Authority Secretary Flandrick Ms. Wong moved to approve the Consent Calendar, seconded by Mr. Chavez and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: ABSTAIN: Member - Chavez, Sternquist, Wong, Yu, Vizcarra Member -None Member -None Member -None A. APPROVAL OF MINUTES Approved the Minutes of the Regular Meeting of December 1, 2009, as presented. B. ADOPTION OF RESOLUTION NO. CRA 09 -983 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. CRA 09 -983, a RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $11,604.67 DEMAND NOS. 3744 THROUGH 3747. 4. UNFINISHED BUSINESS — None 5. NEW BUSINESS A. RESOLUTION NO. CRA 09 -984 — TEMPLE CITY REDEVELOPMENT AGENCY ANNUAL REPORT FOR JULY 1, 2008 TO JUNE 30, 2009 Assistant Executive Director Lambert stated Community Redevelopment Law requires that the Temple City Redevelopment Agency approve and present to the City Council an Annual Report for the Redevelopment Agency. The Report contains the following sections: 1. An overall description of the Agency's activities for the prior year and those programs proposed for the coming year; Agency Minutes December 15, 2009 Page 2 2. Independent financial audit prepared by Mayer, Hoffman, McCann P.C.; 3. \ The Annual Report of financial transactions submitted to the State Controller; 4. A description of the Agency's activities affecting housing and displacement; and 5. The Statement of Indebtedness submitted to the State Controller. The largest accomplishment of the Agency during Fiscal Year 2008 -2009 was the continued success of the Handyworker Grant Program funded with the 20% set aside tax increment monies allocated to the Low /Moderate Housing fund. Expenditures for that program totaled $323,492,1with an average grant amount of 47,890 allocated to 41 residents. Staff recommended that the Redevelopment Agency review the Annual Report for Fiscal Year 2008 -2009, make any modifications desired and accept the report for filing with the City Council, the California Department of Housing and Community Development, and the Office of the State Controller. Assistant Executive Director Lambert responded to questions from Vice Chairman Yu, stating the report must be filed by the end of the year; and Financial Services Manager Molina stated the draft report is presented to the Agency at this time, with the final audit report to be completed by the auditors for approval in January. The Agency is requested to acknowledge the draft report for finalization and filing. Assistant Executive Director Lambert added that Exhibit A of the Report lists the activity for Fiscal Year 2008 -2009 with the continued programs as set forth in the original report. Ms. Wong moved to: 1) Accept the report for filing with the City Council, the California Department of Housing and Community Development, and the Office of the State Controller; and 2) Adopt Resolution No. CRA 09 -984, a RESOLUTION OF THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY APPROVING THE ANNUAL REPORT FOR FISCAL YEAR 2008 -2009; seconded by Mr. Chavez and unanimously carried. 6. COMMUNICATIONS — None 7. PUBLIC COMMENTS — None 8. UPDATE FROM EXECUTIVE DIRECTOR — None 9. MATTERS FROM AGENCY MEMBERS — None 10. CLOSED SESSION SUBSEQUENT NEED ITEM As previously expressed to the City Council, Agency Counsel Vail stated the need to add an item to the agenda, as there was a need to take immediate action and that need for action came to the attention of the Agency and City after the agendas for the meetings of December 15, 2009 were posted. The item is a joint closed session with the City Council regarding 1 1 1 1 1 Agency Minutes December 15, 2009 Page 3 existing litigation: TCD v. City of Temple City. Ms. Wong will recuse herself from this closed session. Vice Chairman Yu moved to add this item to the agenda, seconded by Mrs. Sternquist and carried by the following roll call vote: AYES: Member - Chavez, Sternquist, Yu, Vizcarra NOES: Member -None ABSENT: Member -None ABSTAIN: Member -None JOINT CLOSED SESSION — CITY COUNCIL AND COMMUNITY REDEVELOPMENT AGENCY At 10:30 p.m., the City Council and the Community Redevelopment Agency recessed to a joint closed session for the purpose stated below. Purpose: Existing Litigation Cases: One (1) — TCD v. City of Temple City Authority: Government Code Section 54956.9(a) Representatives: City Manager /Executive Director, City Attorney /Agency Counsel RECONVENE The City Council and Community Redevelopment Agency reconvened at 11:13 p.m. with all members present. CLOSED SESSION STATEMENT City Attorney /Agency Counsel Vail stated the City Council and the Redevelopment Agency met with legal counsel regarding the TCD v. City of Temple City litigation and gave direction to counsel. There was no other reportable action. 11.
