WORKSHOP SESSION
February 10, 1987
The Bal Harbour Village Council met in a workshop session on Tues-
day, February 10, 1987 at the Village Hall. The meeting was called to order
at 4:00 p.m. by Mayor John S. Sherman and the roll was called. Those present,
were:

Mayor Sherman briefly recapped the reason that this special workshop
meeting had been called. During consideration of the variance requests for
property located at 9929 Collins Avenue (proposed Bal Harbour Park site), at-
tention had been called to the Village's existing zoning code. Both Dean
Thomas Regan of the University of Miami and Dean Anthony Catanese of the Uni-
versity of Florida, who had been retained as consultants for the Village, had
recommended that the Village review its existing code. In response to this
recommendation, Village administration contacted the firm of Harland Barthol-
omew, the Village's original planner, represented today by Mr. Malcolm Drummond.
Mrs. Miller proceeded to introduce Mr. Drummond.
Mr. Drummond spoke of the importance of having this section of the
Village code in proper order. He had reviewed Village records and spoke of
three areas which he felt must be addressed in this review of the code. These
areas were: the comprehensive plan - specifically the land use plan, the ocean
front district, and the variance procedure of the Village. Mr. Drummond talked
of the need for specific statements in the comprehensive plans of how this area
should develop, of the need to reevaluate the ocean front district - perhaps
providing for a system of trade-offs, and the need to establish a stronger var-
iance procedure - this might include the establishment of a board of planning
and zoning. The study would include review of and recommendations in each of
these three areas. Mr. Drummond stated that the west side of the Village has
developed in accordance with the ideas of the original planners, however, it is
clear that they did not foresee the type of high-rise buildings that have ap-
peared in the ocean front. Mr. Taplin suggested that Mr. Drummond include in
his review the apartmentsand condominiums located along Collins Avenue on the
west side. Many of these buildings are aging and demolition of them may be
considered in the near future. A price of approximately $3,000 was quoted by
Mr. Drummond as the cost of such a review (or $100 per hour).
Mrs. Miller queried as to whether or not impact fees would be inclu-
ded in such a study. Mr. Drummond explained that impact fees were originally
intended to help defray the costs of the additional services that a development
would require. Such fees may be disguised in a number of ways. Mayor Sherman
suggested that impact fees could be tied to the issuance of a building permit.
It was noted that with the impending development of the Bal Harbour Park pro-
ject, time is of the essence in action as to impact fees.
