Member Smith introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.03-14
RESOLUTION VACATING A PORTION OF PRAIRIE DRIVE
WHEREAS, at the request of the city of Medina (the "City"), Hennepin County (the
"County") intends to extend Prairie Drive from its current terminus to the western edge of the
County's public works facility site; and
WHEREAS, the extension of Prairie Drive will partially involve a different right-of-way
than originally intended and platted; and
WHEREAS, the City has received a request from the County to vacate the portion of
Prairie Drive which will not be used for said extension; and
WHEREAS, the resulting realignment of Prairie Drive will require the County to quit claim
an easement for a portion of Prairie Drive to the City and in exchange the City will vacate all
interest in the platted segment of Prairie Drive which is no longer needed for roadway purposes; and
WHEREAS, the portion of Prairie Drive proposed to be vacated is legally described as:
The westerly 522.97 feet of the existing road right of way according to the plat of Hennepin County
Public Works Addition, Hennepin County, Minnesota in the northwest quarter of the northeast
quarter of Section 10, Township 118 North, Range 23 West as measured along the centerline of said
right of way; and
WHEREAS, pursuant to Minn. Stat. § 412.851, the City has scheduled a public hearing to
consider the proposed vacation; and
WHEREAS, notice of the public hearing was posted, published twice in the official
newspaper and mailed to the owners of other affected properties at least 10 days before the hearing,
all in accordance with law; and

WHEREAS, the City has this day held the public hearing on the proposed vacation, at
which hearing all interested parties were heard; and
WHEREAS, following the public hearing, the City has determined that the vacation of the
described portion of Prairie Drive to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The City hereby declares that the portion of Prairie Drive legally described above is
hereby vacated.
2. The administrator -clerk -treasurer is authorized and directed to prepare and present to
the County auditor a notice that the City has completed these vacation proceedings
and request that the same be entered in the County's transfer records.
3. The vacation described herein is subject to, and the administrator -clerk -treasurer is
authorized to proceed as described above, only upon receipt by the City of a quit
claim deed from Hennepin County for an easement for roadway purposes over the
realigned portion of Prairie Drive.

The motion for the adoption of the foregoing resolution was duly seconded by member Lane
and upon vote being taken thereon, the following voted in favor thereof
Workman, Lane, Zietlow, Smith
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
