RESOLUTION NO.03-17
RESOLUTION VACATING A PORTION OF MEANDER ROAD
AND VACATING UTILITY EASEMENTS
WHEREAS, Klingelhutz Companies is in the process of platting a parcel of land generally
located north and south of Meander Road and west of County Road 116 (the "Property"); and
WHEREAS, Rolling Green Business Park, LLC has purchased a portion of the Property
and will develop it as an office PUD; and
WHEREAS, Klingelhutz Companies and Rolling Green Business Park, LLC have
requested that the city of Medina (the "City") vacate portions of Meander Road as shown on the
preliminary plat; and
WHEREAS, the portion of Meander Road proposed to be vacated is legally described as:
The south twenty (20) feet and the north twenty (20) feet of the west one hundred (100) feet of
Meander Road; and
WHEREAS, the portion of Meander Road proposed to be vacated is no longer needed for
roadway purposes; and
WHEREAS, the City currently has utility easements encumbering the west five feet and the
south five feet of Lot 2, Block 2, Medina Meadows and the south five feet of Lot 1, Block 2,
Medina Meadows, Hennepin County, Minnesota; and
WHEREAS, the utility easements described above are no longer needed by the City; and
WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing for
May 20, 2003, to consider the proposed vacation of a portion of Meander Road and the described
utility easements; and

WHEREAS, notice of the public hearing was posted, published twice in the official
newspaper and mailed to the owners of other affected properties at least 10 days before the hearing,
all in accordance with law; and
WHEREAS, the City has this day held the public hearing on the proposed vacations, at
which hearing all interested parties were heard; and
WHEREAS, following the public hearing, the City has determined that the vacation of the
described portion of Meander Road and the vacation of the described utility easements to be in the
public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The City hereby declares that the portion of Meander Road legally described above
to be vacated.
2. The City hereby declares the utility easements legally described above to be vacated.
3. The administrator -clerk -treasurer is authorized and directed to prepare and present to
the County auditor a notice that the City has completed these vacation proceedings
and request that the same be entered in the, ounty's transfer records.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None.
Whereupon said resolution was declared duly passed and adopted
