RESOLUTION N0. 285z RESOLUTION OF INTENTION IN THE MATTER OF THE IMPROVEMENT OF THE NORTH SIDE OF ABBOTT RO'AD BETWEEN SAN LUIS AVENUE AND SAN JUAN AVENUE BY THE CONSTRUCTION OF CEMENT CONCRETE SIDE- WALKS, TOGETHER WITH ALL INCIDENTAL AND APPUR- TENANT WORK. 4�fIEREAS, pursuant to the provisions of Division 4 of the Streets and Highways Code, cited as the "Special Assessment Investi- gation Limitation and Majority Protest Act of 1931," the 'City Council of the City of Lynwood has determined that the improvement of the north side o£ Abbott Road between San Luis Avenue and. San Juan Avenue as proposed in Resolution 1vo. z838 of said city is feasible, and that the public interest,convenience, and necessity require the improvement substantially as set forth in said report, and WHEREAS, said City Council has found that the lands to be assessed will be able to stand the burden of the proposed assessment, NOW, THEREFORE, BE IT RESOLVED by the,City Council of the City of Lynwood as follows: Section 1: That in the opinion of the City Council of the City of Lynwood the public interest and convenience require and it is the intention of said City Council to order the following work or improvement to be done, to wit: The necessary grading, and the construction of cement con- crete sid.ewalks on the north side of Abbott Road between the eoutherly prolongation of the Center line o£ San Luis Avenue and the southerly prolongation of the Center line o£ San Juan Avenue in Tract No. 5975 as recorded in Book 76, Pages 22 and. 23 of Maps, Records of Los Angeles County. All of said work or improvement sha11 be performed in the public ways and between the limits hereinbefore designated except where the plans indicate that said work shall be omitted. That all of the work or improvement aforesaid shall be done and performed. in accordance with and to the grades shown on Plans and Specifications No. 1958-P-3 on file in the office o£ the City Clerk of _ - said �ity. 5aid plans are hereby referred to for a full and complete description of said proposed work and for the grades to which the work is to be done and said plans an� specifications are by reference made a part hereof and shall.govern for all details of the proposed work. . That the total estimated cos't of said work or improvement is.the sum of Seven Hundred Twenty-nine.and No/100ths Dollars ($729,00). Section 2: That said oontemplated work or improvement, in the opinion of said City Council, is of more than local or ordinary public benefit, and said City Council hereby determines and declares that the district to be benefited by said work or improvement, and. to , be assessed to pay the costs and expenses of such work or improvement, is shown on Plan No. 1958-P-4 on file in the office of the City C1erk of said city, to which reference is hereby made for a full and complete. � description of the assessment d.istrict. Section 3: The City Council hereby determines and declares that serial bonds shall be issued in the manner and.form provided in ° Division 7 of the Streets and Highways Code cited as the ° Improvement Act of 1911,",as amended, bearing interest at the rate of six per cent per annum to represent each assessment of Twenty-five Dollars (�25.,00) or over remaining unpaid for thirty days after the da�e.of recordation of the warrant; said serial bonds shall extend over a period ending nine years from the second day of January next succeed.ing the next October Fifteenth following their date. Said,bonds and intereat thereon shall be paid at the office of the City Treasurer and the same shall be disbursed by him, all as provided in the said "Improvement Act of 1911," as amended. Section 4: Notice is hereby given that the provisions of - that certain act of the Legislature of the State of California desig- � nated as the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Majority Protest Act of 1931," as amended, have heretofore been fully complied with and all the reports required under the provisions of said Act are on file in -2- the office of the City Clerk o£ said city, open to publie inspection ' �and may there be examined by all interested persons. Section 5: The proceedings for the aforesaid work or improvement shall be taken under an Act of the Legislature of the State of Cali£ornia designated as the Streets and Highways'Code, Division 7, cited as the "Improveme'nt Aet of 1911," and amendments thereto. Section^6: The City Engineer is hereby directed to mal�e a. . diagram of the property affected or benefited by said proposed work ' or improv.ement as described herein and to be assessed to pay the costs and expenses of said work, showing such s'eparate lot, piece, or parcel of land and the dimensions o£ each such lot, piece, or parcel of land and the relative location of the same to the work or improvement pro- posed to.be done, all within the limits of said assessment district. Seetion 7: Notice is hereby given tha't on Tuesday, the 5th d.ay,of November, 1958 at the hour of 7:30 p.m. a� the.Council Chambers in the Ci�y Hall, 11330 Bullis Road, in the City of Lynwood, any and I all persons having any ob,jections or protests to said proposed worlc or improvement, or to the extent of the district to be assessed, or to the grade� to which the worlc is proposed to be done, may appear before �said City Council and shova cause why said propose� work or improvement . should not be carried out in accordance with this resolution. Section 8: The City Engineer, who is the Superintendent oP Streets, is hereby directed to post notices of.the passage of this resolution in the time, form, and manner required by law. Section 9: The City,Clerk �hall certify to the passage o£ this resolution by the City Council of said City of Lynwood and cause the same to be published twice in the Lynwood Press, a newspaper published and circulated'weekly in said city and hereby,designated by said City,Council for the purposes aforesaid.
