HomeMy Public PortalAbout2003-020 Resolution Vacating a Portion of Willow Drive1 Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.03-20 RESOLUTION VACATING A PORTION OF WILLOW DRIVE WHEREAS, the city of Medina (the "City") has completed a roadway and intersection improvement project at T.H. 55 and Willow Drive (the "Project"); and WHEREAS, the Project involved, among other things, the realignment of the right-of-way for Willow Drive north of T.H. 55; and WHEREAS, as a result of the realignment, the city has more right-of-way for Willow Drive than necessary to meet current or anticipated needs; and WHEREAS, the portion of Willow Drive proposed to be vacated is legally described on Exhibit A attached hereto; and WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing for July 1, 2003, to consider vacation of a portion of Willow Drive; and WHEREAS, notice of the public hearing was posted, published twice in the official newspaper and mailed to the owners of other affected properties at least 10 days before the hearing, all in accordance with law; and WHEREAS, the City has this day held the public hearing on the proposed vacation of a portion of Willow Drive, at which hearing all interested parties were heard; and WHEREAS, following the public hearing, the City determined that the portion of Willow Drive described on Exhibit A is no longer needed for roadway purposes and vacation of the described portion of Willow Drive to be in the public interest. RHB-233125v1 ME230-345 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota as follows: 1. The City hereby declares that the portion of Willow Drive legally described above to be vacated. 2. The administrator -clerk -treasurer is authorized and directed to prepare and present to the County auditor a notice that the City has completed these vacation proceedings and request that the same be entered in the County's transfer records. RHB-233125v1 ME230-345 1 EXHIBIT A The portion of Willow Drive to be vacated is legally described as follows: That portion of Willow Drive north of State Highway No. 55 bounded on the west by the existing westerly Willow Drive right-of-way (Line A), on the east by a line parallel to and 66-feet east of the existing westerly Willow Drive right-of-way (Line B), and on the north by a diagonal line (Line C) defined by the following two end points: commencing at the southeast corner of the southwest quarter of the northeast quarter of section 4, Township 118 N, Range 23 W; thence northerly along the east line of said quarter quarter section a distance of 541.8-feet; thence deflecting to the left at an angle of 90° a distance of 33-feet to the intersection with Line A, said intersection shall be the northwest end point of Line C. Commencing at the southeast corner of the southwest quarter of the northeast quarter of section 4, Township 118 N, Range 23 W; thence northerly along the east line of said quarter quarter section a distance of 324.8-feet; thence deflecting to the right at an angle of 90° a distance of 33-feet to the intersection with Line B, said intersection shall be the southeast terminus of Line C.
