AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING,
AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF
JEFFERSON, FOR PROPERTY ADDRESSED AS 1208 EAST ELM STREET,CONSISTING
OF PART OF LOTS 108, 109, 110, AND 111 FAIRVIEW ADDITION, JEFFERSON CITY,
COLE COUNTY, MISSOURI, BY REZONING 0.23 ACRES FROM RS-4 MEDIUM DENSITY
RESIDENTIAL TO C-1 NEIGHBORHOOD COMMERCIAL.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning
have in all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan
and the zoning map and the proposed zoning change would not necessitate a
change to the Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RS-4 Medium Density
Residential to C-1 Neighborhood Commercial, described as follows: Property Description:
• Part of Lots No. 108, 109, 110 and 111 in Fairview Addition to the City of Jefferson', Missouri:
said Fairview Addition being a subdivision of Outlots No. 57 and 58 in said city, described as
follows: Beginning on the northeasterly corner of Lot No. 108; thence westerly along the
northerly line of said lot, 100 feet; thence southerly parallel with the easterly line of Lots 108,
109, 110 and 111. 101 feet and 3 inches to the southerly line of Lot No. 111; thence easterly
along and with the southerly line of Lot No. 111, 100 feet to the southeasterly corner of said
Lot No. 111; thence northerly 101 feet and 3 inches along the easterly lines of Lots 110, 110,
109 and 108 to the place of beginning. Containing approximately 0.23 acres.
Section 2. This ordinance shall be in full force and effect from and after its passage

17, 2007 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320 East
McCarty Street, to consider rezoning land addressed as 1208 E. Elm Street from RS-4 Medium
Density Residential to C-1 Neighborhood Commercial:

• Case No. P07026 — 1208 East Elm Street; Rezoning. Request filed by Donnell Rehagen,
authorized representative, National Biodiesel Board, property owner, to rezone approximately
0.23 acres from RS-4 Medium Density Residential to C-1 Neighborhood Commercial. The
property is located on the southwestern corner of the intersection of East Elm Street and Benton
Street and is described as part of lots No. 108, 109, 110, and 111 in Fairview Addition to the City
of Jefferson, Missouri. (Central Missouri Professional Services, Consultant)
Chairman Berendzen confirmed that all regular members and alternates Mr. Deeken and Mr.
Jordan will vote on this case.
Mr. Brian McMillian, Central Missouri Professional Services, 2500 E. McCarty Street, distributed
visuals depicting the area to be rezoned and a preliminary site plan. He explained that the adjacent
office building at 601 Clark Avenue will be occupied by the National Biodiesel Board. Mr. McMillian
stated that the purpose of this request is to match the zoning of the adjacent property and build a
parking lot to serve the adjacent office building.
Mr. Cary Gampher, The Architects Alliance, 631 W. Main Street, spoke regarding this request.
Mr. Gampher distributed a visual depicting the elevations and floor plan for the existing office building
located at 601 Clark Avenue. He explained that the existing office building consists of 10,000 square
feet with conference rooms and training facilities occupying the lower level and offices occupying the
main level.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that the purpose of the rezoning
request is to match the zoning of the adjacent property and the request is in line with the development
• plan map of the Comprehensive Plan.
Mr. Nunn moved and Mr. Bickel seconded to recommend approval to rezone 1208 E. Elm Street
from RS-4 to C-1, to the City Council. The motion passed 8-0 with the following votes:

Review Criteria. The following criteria shall be considered when reviewing
an application to amend the Zoning Ordinance text and Zoning Map:
a. The existing zoning was in error at the time of adoption.
There was no error, although the 1996 Comprehensive Plan shows the
area as commercial.
b. There has been a change in character in the area due to installation
of public facilities, other zone changes, new growth trends, neighborhood
deterioration, or development transitions.
The area is a transitional neighborhood with several properties being
• used as neighborhood commercial.
C. There is a community need for the proposed rezoning.
The community will benefit with a national board having a permanent
location in our community.
d. The proposed change is consistent with, and in furtherance of, the
implementation of the goals and policies of the Comprehensive Plan, other
adopted plans, and the policies, intents and requirements of this Ordinance
and other City regulations and guidelines.
The proposed change is consistent with all existing City plans.
e. The proposed zoning is compatible with the zoning and uses of
property nearby.
The use is compatible with the neighborhood.

Traffic Access
This existing office building has a gross floor area of 10,000 square feet, which would be expected to generate
approximately 16 peak hour vehicle trips. Traffic impact studies are required for developments that generate more
than 100 additional peak hour trips.
Staff Recommendation
The application for rezoning is an expansion of an existing commercial district and is in line with the development
plan map of the Comprehensive Plan. Staff recommendation is for approval.
