HomeMy Public PortalAbout2826 (07-01-58) RESOLUTION N0,2826 - • RESOLUTION OF INTENTION IN THE MATTER OF THE IMPROVEMENT OF THE NORTH SIDE OF'ABBOTT ROAD BETWEEN WASHINGTON AVENUE AND JACKSON AVENUE BY THE CONSTRUCTION OF CEMENT CONCRETE SIDE- WALKS, TOGETHER.WITH ALL INCIDENTAL AND APPUR- TENANT WORK. WHEREAS, pursuant to the provisions of Division 4 of the Streets and Highways Code, cited as the "Special Assessment Investi- gation Limitation and Majority Protest Act of 1931," the City Council o£ the City of Lynwood has determined that the improvement of the north side of Abbott Road•between Washington Avenue and Jackson Avenue as proposed in Resolution No. 2808 of said city is feasible, and that the publie interest, convenience, arid necessity require the improve- ment substantially as set £orth in said report, and WHEREAS, said City Council has found that the lands to be assessed �will be,able to stand the burden of the proposed assessment, NOW,. THEREFORE, BE IT RESOLVED by the City Council of the City of.Lynwood as follows:. . _... Section l: That in the opinion of the City Council of the � City of Lynwood. the public interest and convenience require and it is the intention of said City Council to order the following work or improvement to be done, to wit: The necessary grading, an�] the construction of cement concrete sid.ewalks on the north sid.e of Abbott Road between the southerly prolongation of the westerly line of Washington Avenue and the southerly prolonoation of the easterly line of Jackson Avenue in Tract No. 6436 as recorded in Book 70, Pages 16 and 17�of Maps, , Records of Los Angeles County. All of said work or improvement shall be performed in the public ways and between the limits hereinbefore designated eYCept � where 'the plans indicate that said work shall be omitted. , That all of the work or improvement aforesaid shall be done and performed in accordance with and to the grades shown on Plans and Speci£ications No. 1958-G-3 on file in the office of the City Clerk �' � -1- - � said city. Said plans are.hereby referred to for a full and complete description of said proposed work and for the grades to which the work is to be done'and said plans and specifications are by reference made a part hereof and shall govern £or all details of the proposed worlc. � That the total estimated cost of saic3 work or improvement is the sum of Four Hundred Seventy-six and No/100ths Dollars ($476.00). Section 2: That said contemplated work or improvement, in the opinion of said City Council, is of more than local or ordinary � public benefit, and said City Council hereby determines.and d.eclares that the district to be benefited by said worlc or improvement, and to _ be assessed to pay the costs and expenses of such work or improverrient, is shown on Plan No. 1958-G-4�on file in the office of the City Clerk of said city, to which reference is hereby made for a£ull and complete , description of the assessment district. Section 3: The City Council hereby determines and declares that serial bonds shall be issued in the manner and form provided in Division 7 of the Streets and Highways Code cited as the "Improvement Act of 1911," as amended, bearing interest at the rate of six per cent per annum to'represent eacli assessment of Twenty-five Dollars ($25.OU) —' or over remaining unpaid for thirty days after the date of recordation of the warrant;•said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October fifteenth following their date. Said bonds and interest � thereon shall be paid at the office of the City Treasurer and the same shall be disbursed by him, all as provided in the said "Improvement Act , of 1911," as amended. Section 4: Notice is hereby given that the provisions of that certain act of the Legislature of the State of California desig- nated a,s the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Majority Protest Act of 1931," as amended, have heretofore been fully complied with and all " the reports required under the provisions of said Act are on file in the office of the City Clerk of said city, open to public inspection -2- and may there be examined by all interested persons. , Section 5: The proceedings for the.a£oresaid work or improvement shall be taken under an Act o£ the Legislature of the State of California designated as the Streets and Highways Co�e, Division 7, cited as the "Improvement Act of 1911," and amendments thereto. Section 6: The City Engineer is hereby directed to make a diagram o£ the property affected or benefited by said proposed work or improvement as described herein and to be assessed to pay the costs and expenses o£ saidiwork, showing such separate lot, piece, or parcel of land and the dimensions of each such lot, piece, or parcel of land and the relative location of the same to the work or improvement pro- posed to be done, all within the limits of said assessment district. ' Section 7: Notice is hereby given that on Tuesday, the 5th , day of August 1958 at the hour of 8 p.m, at the Council Chambers in the City Hall, 11330 Bullis Road, in the City of Lynwood, any and all persons having any objections or protests to said proposed work or improvement, or to the extent of the district to be assessed, or to _ the grades to which the work is proposed to be d.one, may appear before said City Council and show cause why said proposed work or improvement should not be carried out in accordance with this resolution. � Section 8: The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices o£ the passage of this resolution in the time, form, and manner required by, law. Section 9: The City Clerk shall certify to the passage of this resolution by the City Council of said City of Lynwood and cause the same to be published twice in the Lynwood Press, a newspaper published and circulated.weekly in said city and hereLy designated by ,� L said City Council for the purposes aforesaid-.
