HomeMy Public PortalAbout2003-022 Resolution Granting Concept Plan Approval for PUD for Klingelhutz CompaniesMember Lane introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.03-22 RESOLUTION GRANTING CONCEPT PLAN APPROVAL FOR PUD FOR KLINGELHUTZ COMPANIES WHEREAS, Klingelhutz Companies (the "Applicant") has applied for concept plan approval for its office PUD (the "PUD") under the PUD ordinance codified at sections 827.25 through 827.43 in the Medina code of ordinances; and WHEREAS, the PUD was reviewed by the planning commission at its meeting on March 11, 2003; and WHEREAS, the planning commission recommended approval of the concept plan for the Applicant's PUD, subject to certain terms and conditions; and WHEREAS, this matter was considered by the city council at its meeting on April 15, 2003. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that concept plan approval be granted to the Applicant for its PUD, subject to the following terms and conditions: 1. Site and hydrant locations must be reviewed by the Hamel fire chief; 2. The plan must be in conformance with any requirements of the Elm Creek Watershed District; 3. The plan must be in conformance with any requirements of Hennepin County Transportation Department; 4. All exterior lighting, including lighting on the buildings, must be downcast type with all sides enclosed except the bottom, with the globe not visible from adjacent properties or rights of way and with site lighting in compliance with the city's lighting ordinance; 5. Lighting standards in the parking area or on the building may not exceed a RHB-231138v1 1 ME230-352 maximum height of 20 feet; 6. Additional landscaping, subject to city approval, must be provided for a 25 foot setback to the parking area along County Road 116 to achieve a more complete buffer at the southeast parking area; 7. The berms adjacent to Meander Road must include 8 foot spruce trees; 8. The Applicant must comply with all requirements of the city engineer; 9. The trail along County Road 116 must be graded by the Applicant; 10. The Applicant must pay the park dedication fee equal to 10 percent of the value of the land prior to final plat approval, payable prior to issuance of any building permit; 11. Approval of the PUD concept plan hereby granted is subject to final approval of the plat of Rolling Green Business Center; 12. The Applicant is authorized to proceed to the general development plan stage, subject to the revisions to the concept plan outlined above. 13. The general plan must be submitted within 180 days of the date of approval of the concept plan; 14. The Applicant must pay to the city an administrative fee sufficient to reimburse the city for the cost of reviewing this application; and 15. Nothing herein shall be deemed to relieve the Applicant from the need to comply with all other land use regulations of the city, including the city's subdivision regulations. Dated: May 6, 2003.
