RESOLUTION NO.03-23
RESOLUTION GRANTING PRELEVIINARY APPROVAL TO
IlLE PLAT OF ROLLING GREEN BUSINESS CENTER
WHEREAS, the city of Medina (the "City") has received an application from Klingelhutz
Companies and Rolling Green Business Park, LLC (the "Applicant") regarding the platting of
certain land in Medina located generally west of County Road 116 near Meander Road, which land
is legally described in Exhibit A attached hereto (the "Property"); and
WHEREAS, Rolling Green Business Park, LLC has an agreement to sell one of the
proposed lots to Klingelhutz Properties for development into individually owned office units; and
WHEREAS, the preliminary plat of the Property was reviewed by the planning
commission on March 11, 2003, and, following a public hearing thereon as required by law, the
planning commission recommended approval of the preliminary plat, subject to certain terms and
conditions; and
WHEREAS, on April 15, 2003, the city council reviewed the preliminary plat for its
conformance with the ordinances of the City and the General Plan of Development to guide
development of the Property, considered the recommendations of the planning commission, and
heard the comments of the Applicant and other interested parties regarding the matter.
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina,
Minnesota that preliminary approval of the plat of Rolling Green Business Center is hereby granted,
conditioned upon the adoption and publication of an ordinance rezoning of proposed Block 1 of the
Property to Planned Unit Development and subject to the following terms and conditions and the
Developer making the following modifications:

1. The final plat must be in conformance with all requirements of the city engineer,
including all drainage, ponding and utility easements;
2. The final plat must be in conformance with requirements of Hennepin County;
3. The final plat must be in conformance with all requirements of the Elm Creek
Watershed District;
4. The Applicant must pay a park dedication fee in lieu of dedication of land, which fee
is 10 percent of the value of the Property prior to submission of the final plat, payable prior to
issuance of the first building permit;
5. The Applicant must convey to the city an easement for a trail along the east edge of
the Property and must grade the trail;
6. The Applicant must extend sanitary sewer and water westerly up to the wetlands and
complete any required wetlands mitigations related to utility or road work;
7. The Applicant must extend sanitary sewer to the east side of County Road 116 to a
location determined by the city;
8. The Applicant must execute a petition and waiver agreement acceptable to the city
attorney to ensure extension of public improvements to the westerly edge of the Property in the
future;
9. The Applicant must pave Meander Road from County Road 116 to a point 341.18
westerly thereof and grade the road westward to the wetlands;
10. The Applicant must provide adequate title evidence for review by the city attorney;
11. The Applicant must pay an administrative fee to the city in an amount sufficient to
reimburse the city for the costs of reviewing the Planned Unit Development and preliminary plat of
the Property; and
12. The Applicant must submit the final plat for the Property for review by the city
within 180 days of the date of this resolution.

The motion for the adoption of the foregoing resolution was duly seconded by member Workman
and upon vote being taken thereon, the following voted in favor thereof
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None.
Whereupon said resolution was declared duly passed and adopted.
