HomeMy Public PortalAbout2788 (03-04-58) RESOLUTION N0. 2788 RESOLUTION OF INTENTION IN THE MATTER OF THE IMPROVEMENT OF BIRCH S`IREET BETWEEN FERNWOOD AVENUE AND THE CITY PARK BY THE C10NSTRUCTION OF CEMENT CONCRETE CURBS, DRIVEWAYS, SIDE- WALKS, AND GUTTERS, AND THE REMOVAL OF EXIST- ING PARKWAYS, DRIVEWAYS, AND TREES, TOGETHER WITH ALL INCIDENTAL AND APPURTENANT WORK, WHEREAS, purs'uant to the provisions of Division 4 of the Streets and Highways Code, cited as the "Special Assessment Investi- gation Limitation and Majority Protest Act o£ 1931," the City Council of the,City of Lynwood has determined that the improvement of Birch , Street between the,center line of Fernwood Avenue and the City Park as proposed in Resolution No. 2673 of said city is feasible, and , that the public interest, convenience, and necessity require the 3mprovement substantially as set forth in said report, and WII�REAS, said City Council has found that the lands to be assessed will be able to stand the burden of the proposed assessment, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as follows: I Section l: That in the opinion of the City Council o£ the I Cit of L nwood the � y y public interest and convenience require and it is the intention�of said City Council to order the following work or improvement'to be done, to wit: The removal of trees, cement concrete curbs, gutters, side- walks, and driveways, and the construction of cement concrete curbs, gutters, driveways, and sidewalks, including all incidental and . appurtenant work, in Birch Street between the center line of Fernwood Avenue and a line 40 feet northerly of and parallel to the northerly line of Tract No. 33�5 as recorded 'in Book 36, Page 42 0£ Maps, Records of Los Angeles County, including portions of intersecting streets. All of said work or improvement shall be performed in the public ways and between the limits hereinbefore designated except. where the plans ind-icate that said work shall be omitted. That a11 of the work or improvement aforesaid shall be done., -1- and performed in accordance with and.to the grades shown on Plans and Specifications No. 1956-c-3 on file in the office of the City Clerk of said city. Said plans are hereby referred.to for a full and com- plete description of said proposed work and. for the grades to which the work is to be done and said plans and speci£ications are by reference mad.e a part hereof and shall govern for all details of the proposed work. � That the total estimated. cost of said work or improvement is the sun of Six Thousand Four Hundred Seventy-seven and 57/100ths � Dollars ($6,477.57). I That said contemplated. work is of general public benefit and said City Council hereby determines that forty per cent (40�) of the cost of said improvement shall be paid from the General Fund of said. city. . Section 2: That said contemplated work or improvement, in the opinion of said City Council, is of more than local or ordinary public benefit, and said City Council hereby determ3nes and declares that the district to be benefited by said work or improvement, and to be assessed to pay the costs and expenses of such work or im provement, is shown on Plan No. 1956-c-4 on file in the office of the City Clerk , of said City, to which reference is hereby made for a full and complete description of the assessment district. Section 3: The City Council hereby determines and declares that serial bonds shall be issued in the manner and form provided in Division 7 of the Streets and Highways Code cited as the "Improvement Act of 1911," as amended, bearing interest at the rate of six per cent per annum to represent each assessment of Twenty-five Dollars ($25.00) or over remaining unpaid for thirty days after the date of recordation of the warrant; said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October fifteenth following their date. Said bonds and interest thereon shall be paid at the office of the City Treasurer and the same shall be disbursed by him, all as provided in the said "Improvement Act _2_ I of 1911," as amended. Section 4: Notice is hereby given that the provisions of that certain act of the Legislature of the State of California desig- nated as the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Majority Protest Act � of 1g31 as amended, have heretofore been fully complied with and all the reports required under the provisions o£ said Act are on file in the office of the City Clerk of said city, open to public inspection, and may there be examined by all interested persons. Section 5: The proceedings for the aforesaid work or � improvement shall be taken under an Act of the Legislature of the State of California designated as the Streets and Highways Code, Divi- sion 7, cited as the "Improvement Act of 1911," and amendments thereto. Section 6: The City Engineer is hereby directed to make a diagram of the property a£fected or bene£ited by said proposed work or improvement as described herein and to be assessed to pay the costs and expenses of said work, showing such separate lot, piece, or parcel of land and the dimensions o£ each such lot, piece, or parcel of land and the relative location of the same to the work or improvement pro- posed to be done, all within the limits of said assessment district. Section 7: Notice is hereby given that on Tuesday, the lst day of April 1958 at the hour o£ 8 p.m, at the Council Chambers in the City Hall, 11330 Bullis Road, in the City of Lynwood, and and �,� persons having any ob,jections or protests to said proposed work or impr�vement, or to the extent of the district to be assessed, or to the gr.ades to which the work is proposed to be d.one, may appear before said City Council and show cause why said proposed. work or improvement should not be carried out in accordance with this resolution. Section 8: The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices of the passage of this resolution in the time, form, and manner required. by law. Section 9: The City Clerk shall certify to the passage of this resolution by the City Council of said City of Lynwood and cause -3- � i the same to be published twice in the Lynwood. Press, a newspaper published and circulated weekly in said city and hereby designated by said City Council for the purposes aforesaid. Said Clerk is also directed to mail notices of the adoption of this Resolution of Intention in the time, form, and. manner, and to the persons, all as prov-d��d in said, "Improvement Act of 1911," as amended..
