RESOLUTION N0. 2797
RESOLUTION OVERRULING PROTESTS AND DETERMINING
THAT THE CITY COUNCIL HAS ACQUIRED JURISDICTION
TO ORDER THE PROPOSED WORK OR IMPROVEMENT IN THE
. MATTER OF THE IMPROVEMENT OF BIRCH STREET BETWEEN
FERNWOOD AVENUE AND THE CITY PARK BY THE CON-
' STRUCTION OF CEMENT CONCRETE CURBS, DRIVEWAYS,
SIDEWALKS, AND GUTTERS, AND THE REMOVAL OF EXIST-
ING PARKWAYS, DRIVEWAYS, AND TREES, TOGETHER WITH
ALL INCIDENTAL AND APPURTENANT WORK,
WF3EREAS, the City Council of the City of Lynwood did on ,
the 4th day of March 1958 adopt its Resolution of Intention No.
2788 ordering the improvement o£ Birch Street between Fernwood Avenue
and the City Park by the construction of cement concrete curbs, drive-
ways, sidewalks, and gutters, and the removal of existing parkways,
d.riveways, and trees, together with all incidental and appurtenant
work, and
WHEREAS, Tuesday, the 15th day of April 1958 at the hour
of 8 p.m, at the Council Chambers in the City Hall in said City of
Lynwood. was the time and place set in said Resolution of Intention
when and where any objections to the proposed work or improvement, or
to the extent of the d-istrict to be assessed-, or to the grades to
which the work was proposed to be done would be heard by said City
Council, and
� WHEREAS, the City Clerk of said City has heretofore pre-
sented and filed an affidavit o£ publication of said Resolution of
Intention, showing that the same was published according to law, and
WHEREAS, said City Clerk has also presented and filed his
affidavit of mailing notices of the adoption of said Resolution of
Intention in the time, form, and manner, and to the persons, all as
provided by an Ar.t of the Legislature o£ the State of California,
designated as Division 7 0£ the Streets and Highways Code, and cited
as the"Improvement �ct of 1911," and amendments thereto, and
WHEREAS, the City Engineer-Superintendent of Streets has
heretofore presented and filed an af£idavit showing that notices of
the passage of saicl Resolution of Intention have been posted in the
manner provid.ed by said Act, and

WHEREAS, at said hearing held on the 15th day of April,
1958 no protests were filed against any of the things proposed to
be done under said Resolution of Intention No. 2788.
.NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lynwood that the said City Council has acquired'full juris-
diction to order the proposed. work or improvement.
APPROVED and ADOPTED this 15tYi day of April 1g58.
