HomeMy Public PortalAbout2798 (04-15-58) Z��� RESOLUTION N0, z79g RESOLUTION ASCERTAINING AND DETERMINING RATE OF PER DIEM WAGES AND THE GENERAL PREVAILING RATE OF PER DIEM WAGES FOR LEGAL HOLIDAYS AND OVER- TIME WORK IN THE LOCALITY FOR EACH CRAFT'OR TYPE OF LABORER, WORKMAN, OR MECHANIC NEEDED TO EXE- CUTE THE CONTRACT FOR FURNISHING AND DELIVERING CERTAIN MATERIALS AND SUPPLIES IN CONNECTION WITH THE HEREINAFTER MENTIONED IMPROVEMENT IN ACCORDANCE WITH PLANS AND SPECIFICATIONS N0. 1956-c-3 IN THE MATTER OF THE IMPROVEMENT OF BIRCH STREET BETWEEN FERNWOOD AVENUE I�ND THE CITY PARK BY THE CONSTRUCTION OF CEMENT CONCRETE CURBS, DRIVEWAYS, SIDEWALKS, AND GUTTERS, AND THE REMOVAL OF EXISTING PARYWAYS, DRIVEWAYS, AND TREES, TOGETHER WITH ALL INCIDENTAL AND APPURTEN- AN� WORK. BE IT RESOLVED by the City Council of the City of Lynwood, California as follows: WHEREAS, pursuant to an Act of the Legislature of the State of California, approved April 24 1957 and known as the "Labor Code," the City Council of the City of Lynwood is required to ascertain the � general prevailing rate of per diem wages for legal holidays and overtime work, in this locality for each craft or type of laborer, workman, or mechanic needed to execute the proposed contract for the removal of trees, cement concrete curbs, gutters, sidewalks, and drive- ways, and the construction of cement coricrete curbs, gutters, drive- ways, and sidewalks, including all incidental and appurtenant work, _ in Birch Street between the center line o£ Fernwood Avenue and a line 40 feet northerly of and parallel to the northerly line of Tract No. 3335 as recorded in Book 36 , Page 42 of Maps, Records of Los Angeles County, including portions of intersecting streets, in accor- dance with Plans and Specifications No. 1956-C-3 on file in the office o£ the City Clerk of the said City of Lynwood. NOW, THEREFORE, the City Council of the City of Lynwood does hereby resolve as follows: Section l: The City Council of the City of Lynwood does hereby ascertain and determine that the general prevailing rate of hourly wages, in the locality in which said work or improvement is to be done, £or each craft or type of laborer, workman, or mechanic needed to execute the cmtract for furnishing and d.elivering certain materials and. supplies in connection with the improvement hereinabove described and. in accordance with Plans and. Sundays and holidays - one and one-half (1-1/2) times the above rates. Provided that not less than one and one-half times the pre- vailing rate shall be paid for any working time more than eight hours during any one calend.ar day, and for time on Saturdays, Sundays, and the several legal holidays, to wit: New Year�s Day, Decoration Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, and ' Christmas Day. Provided that notwithstanding the general provisions I -2- contained herein, flagman, guards, and watchmen shall be paid one and one-half times the prevailing rate for overtime (overtime shall be time worked in excess of eight hours per day or forty hours per week), and the straight preva'iling rate for time worked on Saturdays, Sunday� and- holidays where such time does not constitute overtime. The foregoing prevailing wage schedule is based upon a working day of eight hours, and in the event that laborers, workmen, or mechanics are employed less than eight hours per day,�the rate of per diem�wages shall be de be that fraction of the foregoing rates that the number of hours o£ employment bears to eight. The rate of compensation for any classification not listed in the schedule, but which may be required to execute the proposed work, shall be commensurate and in accord, with the rates specified for similar and comparable classification or for those performing similar'.or comparable duties. •APPROVED and ADOPTED this 15th day of April 1958.
