SUBJECT: ADOPTION OF RESOLUTION NO. 16-5225 -RECITING THE FACT OF
THE SPECIAL MUNICIPAL ELECTION OF NOVEMBER 8, 2016,
DECLARING THE RESULT, AND DECLARING SUCH OTHER MATTERS
AS PROVIDED BY LAW FOR CITY MEASURE AA (AMENDING CITY
CHARTER)
RECOMMENDATION:
The City Council is requested to adopt Resolution No. 16-5225 (Attachment A) recit ing
the facts of the Special Municipal Election held on November 8, 2016 and declaring
such other matters as provided by law for City Measure AA (amending city charter).
BACKGROUND:
1. On July 19, 2016, the City Council adopted Resolution No. 16-5187 calling a
Special Municipal Election for November 8, 2016 to adopt a Charter amendment,
and setting forth certain Elections Code-required steps for adoption of the
amendment and adopted Resolution No. 16-5188 requesting the Board of
Supervisors of Los Angeles (LA) County to consolidate the City's Special
Municipal Election with the November 8, 2016 Statewide General Election
pursuant to Section 1200 of the State Elections Code.
2. On November 8, 2016, from 7:00 a.m. until 8:00 p .m., the City's poll ing places
were open to voters to cast their ballot.
3 . On November 8, 2016, a count of ballots cast, both precinct and vote-by-mail
ballots, was conducted by the LA County Election Department. Remaining
provisional and vote-by-mail ballots were schedu led for ballot count on Friday,
November 11; Tuesday, November 15; Friday, November 18; Tuesday , November
22; Friday, November 25; Monday, November 28; Wednesday, November 30 (if
necessary); and Friday, December 2 (if necessary).
4. On December 2, 2016, the LA County Election Department posted the official

Statement of Votes Cast for the City's Special Municipal Election on its website .
ANALYSIS:
The LA County Election Department issued the official Statement of Votes Cast for the
City's Special Municipal Election pertaining to Measure AA (Measure) as required by
law on December 3, 2016. As a result of the election, a majority of the voters voted in
favor of the Measure thus amending the Charter of the City Of Temple City Sections
200 , 502, 610 , 1100, and 1103 prohibiting Councilmembers and Commissioners from
accepting City contractor or lobbyist gifts without full reimbursement; estab lish stricter
Councilmember contribution and gift restrictions; impose overall limit of four terms for
Councilmembers; prohibit City contractors, lobbyists, and employees from serving on
City commissions ; prohibit Council candidates from accepting City contractor or lobbyist
contributions.
The final results, including all vote-by-mail and provisional ballots is now presented to
the City Council to declare as follows :
8,781 voted yes for Measure AA
1,388 voted no for Measure AA
CITY STRATEGIC GOALS:
City Counci l's adoption of reso lution reciting the facts of the Special Municipal Election
of November 8, 2016 and declaring t he results wi ll promote the City's Strateg ic Goals of
Good Governance and Citizens Education and Communication.
FISCAL IMPACT
This item does not have an impact on the Fiscal Year (FY) 2016-17 City Budget.

A RESOLUTION OF T HE CITY COUNCIL OF THE CITY OF TEMPLE
CITY, CALIFORN IA, RECITING THE FACT OF THE SPECIAL
MUNICIPAL ELECTION HELD ON NOVEMBE R 8, 2016 , DECLARING
THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal election w as held an d conducted in the City of Temple City,
California, on Tuesday, November 8, 2016, as requ ire d by law; and
WHEREAS, notice of sa id election was given in time, form and manner as provided by law ; that
votin g precincts were properly establi shed; that election officers were appointed and that in all respects the
election was held and conducted and the vo tes were cast, rece ived and canvassed and the returns made
and declared in time , form and manner as required by the provis ion s of the Elections Code of the State o f
California for the ho ldi ng of elect ions in charter cities ; and
WHEREAS, the Los Angeles County Electio n Department has canvassed the returns of the e lection
and has certified the results to this City Cou ncil ; the results are received , attached and made a part hereof as
Exh ibit "A";
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMP LE CITY , CALIFORNIA, DOES
RESOLVE , DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the measure (Measure AA) voted upon at the electi on is as follows :
Sha ll the Temple City Charter be amended to do the following, none of which
grant the City new powers: prohibit Councilmembe rs and Commissioners from
accepting City contractor or lobbyist gifts w ithout full reimbursement; establish
stricter Councilmember contribution and gift restrictions ; impose overall limit of
four terms for Councilmembers ; prohibit City contractors, lobbyists , and
employees from serving on City commiss ions ; prohib it Council candidates
from accepting City contractor or lobbyist contributions?
SECTION 2. T hat the number of votes given at each precinct and the number of vo tes given in the
City for and against the measure are listed in Exhibit "A" attached.
SECTION 3. The City Council does declare and determine tha t:
As a result of the election, a majority of the voters voting on Measure AA did vote in favor of it, and
that Measure AA was carried, and Section 200, 502, 610, 1100, and 1103 prohibiting Councilmembers and
Commissioners from accepting City contractor or lobbyist gifts without full reimbursement; e~tablish stricter
Councilmember contribution and gift restrictions ; impose overall limit of four terms for Councilmembers;
proh ibit City contractors, lobbyists , and employees from serving on City commissions; prohibit Council
candidates from accepting C ity contractor or lobby ist contribut ions.
SECTION 4 . The City Clerk sha ll enter on the records of the City Counc il of the City, a statement of
the result of the e lection showing the whole number of the ballots cast in the City.
