Mayor Yu called the City Council Regular Meeting to order at 7:33 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: 3. INVOCATION Councilmember-Chavez, Fish, Man, Sternquist, Yu Councilmember -None City Manager Cook, Assistant City Attorney Murphy, City Clerk Kuo, Community Development Director Forbes, Administrative Services Director Hause, and Parks and Recreation Director Burroughs Pastor Jim Walden with First Baptist Church provided the Invocation. 4. PLEDGE OF ALLEGIANCE Troop 161 led those present in the Pledge of allegiance. 5. CEREMONIAL MATTERS-PRESENTATIONS A. PET OF THE MONTH Presentation rescheduled to December 6, 2016. B. RECOGNITION OF CITY STAFF City Council recognized City staff Karen Johnson, Personnel Analyst, for being selected as a finalist for the California Joint Powers Insurance Authority's 2016 Capstone Award. The Capstone Award is presented each year to an individual who best exemplifies the practice of risk management in the public sector. Mayor Yu and City Council presented Ms. Johnson with a certificate. City Council Minutes November 15, 2016 Page 2 of 9 C. 2016 BOOKMARK CONTEST WINNERS Temple City Children's Librarian Xuemin Zhong provided information regarding the 2016 Bookmark Contest. Mayor Yu and City Council presented the contest winners with certificates. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Xuemin Zhong, Temple City Children's Librarian, announced upcoming library events. 7. CONSENT CALENDAR Councilmember Chavez pulled Item ?C. Councilmember Chavez made a motion to approve the remainder of the Consent Calendar items. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. Minutes of the Special City Council Meeting of October 28, 2016; 2. Minutes of the Special City Council Meeting of November 1, 2016; and 3. Minutes of the Regular City Council Meeting of November 1, 2016. Action: Approved. B. TEMPORARY SUSPENSION OF OVERNIGHT PARKING PERMIT ENFORCEMENT DURING THE HOLIDAY SEASON The City Council is requested to temporarily suspend enforcement of the overnight parking permit requirement during the holiday season to allow families and friends to gather without having to worry about obtaining an overnight parking permit. Action: Approved the temporary suspension of overnight parking permit enforcement from 12:00 midnight on Sunday, December 18, 2016, City Council Minutes November 15, 2016 Page 3 of 9 to 11:59 p.m. on Sunday, January 8, 2017. D. CONSIDERATION OF THE WAIVER OF STANDARD CITY INSURANCE REQUIREMENTS FOR CONSULTANTS PROVIDING SERVICES TO CITY PUBLICATIONS The City utilizes the services of sole proprietors for writing and translation services in the City's publications and notices. The City's standard insurance requirements exceed the levels of insurance those persons need in their normal course of business. Action: 1. Approved the attached resolution waiving the City's standard insurance requirements for a specified list of consultants who perform editing, copy writing, and translating services for City notices and publications; and 2. Directed City staff to return with a forrnal policy for City Council adoption that would authorize the City Manager to waive the standard insurance requirements for consultants doing similar work in the future. E. FISCAL YEAR (FY) 2016-17 CITY BUDGET-FIRST QUARTER BUDGET AMENDMENTS Approval of the adjustments are necessary to ensure actual spending levels in individual line items do not exceed budgeted appropriations at the close of the first quarter of FY 2016-17. Action: Authorized staff to revise various budgeted appropriations for the FY 2016-17 City Budget to ensure actual spending levels are within budgeted appropriations during the current fiscal year. F. FIRST QUARTER FINANCIAL STATUS REPORT To keep the City Council updated on the status of the City's financial activities, financial reports are reported on a quarterly basis. Action: G. VISA CARD REPORT Received and filed the First Quarter Financial Status Report. The City Council is requested to review, receive and file the Visa Card Report. ADOPTION OF RESOLUTION NO. 16-5218 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 16-5218 authorizing the payment of bills. Action: Adopted Resolution No. 16-5218. C. REQUEST FROM THE TEMPLE CITY CAMELLIA FESTIVAL FOR SUPPORT AND AUTHORIZATION FOR USE OF STREETS AND FACILITIES FOR THE 2017 CAMELLIA FESTIVAL The City Council is requested to review and approve the requests from the Camellia Festival for City's support for the 2017 Camellia Festival. Councilmember Chavez pulled this item and invited the Camellia Festival Director Dawn Tarin to speak regarding the upcoming festival. Dawn Tarin, Camellia Festival Director, announced the theme for next year's festival and upcoming festival activities. Councilmember Chavez made a motion to authorize use of streets and facilities including temporary parking bans and street closures for the festival and parade as identified in the letter from the Camellia Festival to the City Manager; approve consumption of alcohol in Temple City Park, pursuant to Section 4-4-0 of the Temple City Municipal Code; authorize Bingo in Temple City Park, pursuant to Section 4-1 F of the TCMC and waiver of the $50 license fee; authorize sponsor banners in Temple City Park pursuant to Section 3-5D- 10 of the TCMC; and authorize certain local community organizations, to sell food, patches, etc. along the parade route. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 16-1016 REMOVING TITLE 9, CHAPTER 1, SECTION C OF THE TEMPLE CITY MUNICIPAL CODE The City Council is considered to adopt an ordinance to remove the Fast City Council Minutes November 15, 2016 Page 5 of9 Track Modification Committee from the Temple City Municipal Code. Planning Manager Reimers gave a brief summary of the staff report. Mayor Yu opened public hearing. Steve Stafford, Temple City resident, spoke in favor of adopting the proposed ordinance. Hearing no further request to speak, Mayor Yu closed public hearing. Councilmember Chavez made a motion to introduce for first reading by title only and waive further reading of Ordinance No. 16-1016, removing Title 9, Chapter 1, Section C of the Temple City Municipal Code; Waive further reading of Ordinance No. 16-1016; and schedule the second reading of Ordinance No. 16-1016 for December 6, 2016. APPEAL OF THE PLANNING COMMISSION'S DECISION DENYING A CONDITIONAL USE PERMIT TO ESTABLISH A 7,891 SQUARE FOOT KARAOKE TELEVISION (KTV) BUSINESS IN THE CAMELLIA SQUARE SHOPPING CENTER, LOCATED AT 9055 LAS TUNAS DRIVE, UNIT 125 Applicant has filed an appeal of the Planning Commission's decision to establish a 7,891 square foot KTV establishment in the Camellia Square Shopping Center. Mayor Yu announced that the applicant for this project has requested to continue the public hearing to a date uncertain. Once a public hearing date has been determined, proper notices will be issued. Councilmember Man made a motion to continue the public hearing. AMENDMENT TO CITY MANAGER'S EMPLOYMENT AGREEMENT AND AWARD OF A ONE-TIME PERFORMANCE BONUS City Council directed the City Attorney to prepare an amendment to the City Manager's agreement for City Council consideration. Mayor Yu provided a brief summary regarding the City Manager's evaluation process. Mayor Yu opened public comment. Hearing no request to speak, Mayor Yu closed public comment. City Council thanked City Manager Cook for the work he has done and expressed their appreciation for his contribution to the community. Councilmember Man made a motion to approve the award of a one-time performance bonus in the amount of Five Thousand Dollars ($5,000) to City Manager Cook, payable at the next regular payment period; and approve the First Amendment to Employment Agreement for the position of City Manager, which amends section 2.1 of the Agreement to increase his base salary to One Hundred and Ninety Thousand Dollars ($190,000). COMMUNICATIONS-None 12. UPDATE FROM CITY MANAGER City Manager Cook reported on the Veteran Day Celebration. He thanked the Parks and Recreation staff for a successful event and the contractor for completing the project on time. He announced the nomination period for the upcoming March 7, 2017 General Municipal Election (i.e., November 14 to December 9). Those interested in pulling nomination paper should contact the City Clerk's Office. He also spoke regarding specific local, county, and state propositions and measures that was voted on November 8 Statewide General Election and the impact they will have on the City. 13. UPDATE FROM CITY ATTORNEY Assistant City Attorney Murphy briefed City Council regarding an environmental City Council Minutes November 15, 2016 Page 7 of 9 lawsuit in Poway, San Diego. 14. As a result of the meetings, the Ad Hoc directed staff to submit a report to City Council for consideration regarding the structure of the Public Arts Commission. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER CHAVEZ Congratulated City Manager Cook and Parks and Recreation Director Burroughs for a successful Veteran's Day Celebration. He also thanked Councilmember Fish and Mayor Pro Tem Sternquist for their contribution to the Veteran Memorial Project and Veteran's Day Celebration. B. COUNCILMEMBER FISH Spoke regarding the Veteran's Day Celebration and the Chamber's Annual Gala. She invited the public to the City's Christmas Parade on Dec. 2 and commented regarding the upcoming Thanksgiving holiday. C. COUNCILMEMBER MAN Commented on the Veteran's Day Celebration and the Veteran Memorial Project. He also commented on the Chamber's Annual Gala and the check acceptance ceremony for the Temple City County library renovation. City Council Minutes November 15, 2016 Page 9 of 9 D. MAYOR PROTEM STERNQUIST Commented on the recent Statewide General Election, the library renovation project and regarding the school districts now also having to comply with the MS4 permit. E. MAYOR YU Also commented on the Veteran's Day Celebration and his experience working as a poll worker for the November 8 Statewide General Election. He also spoke regarding the need to address the deteriorating pavement condition citywide. 16. REIMBURSEMENT OF EXPENSES TO CITY OFFICIALS FOR CONDUCT OF CITY BUSINESS AND FOR CITY PAYMENT OF CONFERENCE EXPENDITURES-None 17. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City business owner, congratulated City Manager Cook on his work anniversary, invited the public to the next Kiwanis Club meeting and commented on the veteran's day celebration.
