CITY OF MEDINA
RESOLUTION NO.03-30
RESOLUTION VACATING DRAINAGE AND UTILITY EASEMENTS
WHEREAS, Larry R. Zilverberg and Susan E. Zilverberg (the "Owners") are the fee
owners of Lots 3 and 4, Block 2, Tuckborough Farm Fifth Addition (the "Property"); and
WHEREAS, the Owners are combining their lots into a single parcel by replatting the
Property as JJZ Addition; and
WHEREAS, the Owners have requested that the city of Medina (the "City") vacate the
drainage and utility easements currently located on both sides of the common lot line between Lots
3 and 4; and
WHEREAS, the drainage and utility easements proposed to be vacated are legally
described on Exhibit A attached hereto; and
WHEREAS, the drainage and utility easements proposed to be vacated will no longer be
needed following combination of the two lots; and
WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing for
October 7, 2003, to consider the proposed vacation of the drainage and utility easements; and
WHEREAS, notice of the public hearing was posted, published twice in the City's official
newspaper and mailed to the owners of other affected properties at least 10 days before the hearing,
all in accordance with law; and
WHEREAS, the City has this day held the public hearing on the proposed vacation, at
which hearing all interested parties were heard; and

WHEREAS, following the public hearing, the City has determined that the vacation of the
described drainage and utility easements to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The City hereby declares the drainage and utility easements legally described on
Exhibit A to be vacated.
2. The administrator -clerk -treasurer is authorized and directed to prepare and present to
the County auditor a notice that the City has completed these vacation proceedings
and request that the same be entered in the County's transfer records.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

Legal Description
Drainage and Utility Easements to be vacated
All of the drainage and utility easements as dedicated in the plat around the
perimeter of Lots 3 and around the perimeter of Lot 4, Block 2, Tuckborough Farm
Fifth Addition.
