RESOLUTION NO.03-32
RESOLUTION GRANTING FINAL APPROVAL TO THE
PLAT OF ROLLING GREEN BUSINESS CENTER
WHEREAS, the city of Medina (the "City") received an application from Klingelhutz
Development Company ("Klingelhutz") and Rolling Green Business Park, LLC ("Rolling Green")
regarding the platting of certain land in Medina located generally west of County Road 116 near
Meander Road, which land is legally described in Exhibit A attached hereto (the "Subdivision");
and
WHEREAS, the preliminary plat of the Subdivision was reviewed by the planning
commission on March 11, 2003 and, following a public hearing thereon as required by law, the
planning commission recommended approval of the preliminary plat, subject to certain terms and
conditions; and
WHEREAS, on May 6, 2003, the city council reviewed the preliminary plat for its
conformance with the ordinances of the City and the General Plan of Development submitted by
Klingelhutz regarding Block 1 of the Subdivision, considered the recommendations of the planning
commission, heard the comments of all interested parties regarding the matter and granted
preliminary approval of said plat; and
WHEREAS, the Klingelhutz and Rolling Green have now prepared a final plat of the
Subdivision and requested approval thereof; and
WHEREAS, the final plat has been reviewed by city staff for its conformance with the
terms of preliminary plat approval and of the City's ordinances.

NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina,
Minnesota that final approval of the plat of Rolling Green Business Center is hereby granted,
conditioned upon the adoption and publication of an ordinance rezoning Lot 1, Block 1 of the
Subdivision to Planned Unit Development and subject to the following terms and conditions:
1. Klingelhutz must execute a P.U.D. development agreement acceptable to the City in
form and substance;
2. Rolling Green must execute a petition and waiver agreement acceptable to the City
in form and substance to ensure extension of Meander Road and the utilities to the western
boundary of the Subdivision;
3. Klingelhutz and Rolling Green must each deed to the City a strip of land 15 feet in
width along the eastern boundary of the Subdivision, which land shall be taken in partial
satisfaction of park dedication requirements.
4. Klingelhutz and Rolling Green must comply with the comments and
recommendations regarding engineering matters outlined in the letters dated February 26,
2003 and June 27, 2003, from Tom Kellogg of Bonestroo Rosene Anderlik & Associates to
City zoning administrator Loren Kohnen and any additional comments or requirements
which may result from the city engineer's review of the revised plans for the Subdivision;
5. Klingelhutz and Rolling Green must comply with the requirements of the city
attorney's supplemental plat opinion letter dated October 7, 2003;
6. Klingelhutz and Rolling Green must pay an administrative fee to the city in an
amount sufficient to reimburse the city for the costs of reviewing plat of the Subdivision;
and
7. Klingelhutz and Rolling Green must file the final plat of the Subdivision with
Hennepin County within 60 days of the date of this resolution or the final approval hereby
granted shall be null and void.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
