CITY OF MEDINA
RESOLUTION NO. 03-35
RESOLUTION GRANTING FINAL PLAT APPROVAL
FOR MAPLE WALK
WHEREAS, CBR Development, LLC (the "Applicant") has applied to plat property in
Medina located near Maple Avenue and Oak Street and legally described on Exhibit A attached
hereto (the "Property"); and
WHEREAS, the Applicant intends to combine seven parcels into three lots by means of
a plat to be known as Maple Walk (the "Subdivision"); and
WHEREAS, the final plat has been submitted by the Applicant and has been reviewed
by the city staff for compliance with the City's ordinances.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota that final plat approval is hereby granted to the Applicant for Maple Walk, subject to
the following terms and conditions:
1. The Applicant must remove all existing structures located on the Property at the
time of final plat approval. Demolition permits are required prior to removal of
the buildings;
2. The Applicant must comply with all requirements of the watershed district;
3. The Applicant must comply with all requirements of the City engineer;
4. The Applicant must pay to the City sanitary sewer and water connection fees of
$12,320, which fees are payable prior to recording the plat with Hennepin
County;
5. The Applicant must pay to the City a park dedication fee of $7000, which fee is
payable prior to recording the plat with Hennepin County;
6. The Applicant must pay to the City an administrative fee in an amount necessary

to reimburse the City for the cost of reviewing this application; and
7. The Applicant must record the final plat with Hennepin County within 60 days
of the date of this resolution or the approval hereby granted shall be null and void.

The motion for the adoption of the foregoing resolution was duly seconded by member
Brinkman and upon vote being taken thereon, the following voted in favor thereof:
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

The Property is legally described as follows:
Parcel One (Abstract Property):
The East %2 of Lot 7, and all of Lots 8 and 14, Block 26, "Independence Beach,
Hennepin County, Minnesota", according to the recorded plat thereof, and situate
in Hennepin County, Minnesota.
Parcel Two (Torrens Property):
The West 40 feet of Lot 10,
The East 30 feet of Lot 16, and
All of Lots 9 and 15,
All in Block 26, "Independence Beach, Hennepin County, Minnesota", according
to the recorded plat thereof, and situate in Hennepin County, Minnesota.
