CITY OF MEDINA
RESOLUTION NO.03-37
RESOLUTION GRANTING PRELIMINARY APPROVAL TO
THE PLAT OF MEDINA PARKS SECOND ADDITION
WHEREAS, the city of Medina (the "City") has received an application from Medina
Parks, a Minnesota partnership (the "Applicant") regarding the platting of certain land in Medina
located generally east and west of Willow Drive and north of Pioneer Trail, which land is legally
described in Exhibit A attached hereto (the "Property"); and
WHEREAS, the preliminary plat of the Property, which will be known as Medina Parks
Second Addition, was reviewed by the planning commission on October 14, 2003, and, following a
public hearing thereon as required by law, the planning commission recommended approval of the
preliminary plat, subject to certain terms and conditions; and
WHEREAS, on November 4, 2003, the city council reviewed the preliminary plat for its
conformance with the ordinances of the City, considered the recommendations of the planning
commission, and heard the comments of the Applicant and other interested parties regarding the
matter.
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina,
Minnesota that preliminary approval of the plat of Medina Parks Second Addition is hereby granted,
subject to the following terms and conditions:
1. The final plat must be in conformance with all requirements of city engineer Tom
Kellogg as noted in his letters to zoning administrator Loren Kohnen dated March 26, 2003 and
September 15, 2003;
2. The final plat must be in conformance with all requirements of the Elm Creek
Watershed District and the Pioneer -Sarah Creek Watershed District;
3. The Applicant must pay a park dedication fee in the amount of $38,025 in lieu of
dedication of land. The park dedication fee is applicable only to Lot 1, Block 1 and is payable prior

to issuance of the first building permit. Additional park fees will be due on replatting of the
remainder of the Property;
4. The final plat shall include a 10 inch drainage and utility easement on the north edge
of the Property;
5. The Applicant must provide adequate title evidence for review by the city attorney;
6. The Applicant must pay an administrative fee to the City in an amount sufficient to
reimburse the city for the costs of reviewing the plat of the Property; and
7. The Applicant must submit the final plat for the Property for review by the City
within 180 days of the date of this resolution.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Workman, Zietlow, Smith, Brinkman
and the following voted against same: Absent: Lane
None
Whereupon said resolution was declared duly passed and adopted.
