AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,AUTHORIZING A NOTICE
TO BE PLACED IN THE JEFFERSON CITY NEWS TRIBUNE RELATING TO OPEN
BURNING TO BE SUBMITTED TO VOTERS ON NOVEMBER 6, 2007.
WHEREAS, the City Council approved Ordinance No. 2006-105 on December 4, 2006,
authorizing submission to qualified voters of the City of Jefferson on
November 6, 2007, of the issue of unlimited open burning known as
Proposition 1; and
WHEREAS, the approved ballot language states that burning would be restricted to"yard
waste, paper and cardboard in designated containers,during daylight hours";
and
• WHEREAS, the initiative petition if approved would also eliminate all penalties for open
burning; and
WHEREAS, Proposition 1 removes the authority of municipal authorities to restrict open
burning for public safety reasons; and
WHEREAS, the City Council desires that voters be fully informed regarding Proposition
1.
NOW THEREFORE, BE IT ENACTED THAT A 4 INCH BY 5 INCH SIZE
ADVERTISEMENT/NOTICE BE PROMINENTLY PLACED IN T' 'E_' i G��1T4
6F THE JEFFERSON CITY NEWS TRIBUNE IN THE THREE CONSECUTIVE SUNDAY
EDITIONS AND MONDAY EDITION IMMEDIATELY PRECEDING THE ELECTION ON
NOVEMBER 6, 2007, SUCH NOTICE TO READ AS SET FORTH ON EXHIBIT A
ATTACHED HERETO WHICH IS INCORPORATED HEREIN BY THIS REFERENCE.

Notice for voters concerning Proposition 1, on the November 6, 2007 ballot.
The City of Jefferson allows burning of yard waste from November 15 of each year
to March 15 of the following year. The ballot language for Proposition 1 reads"Shall the
Code of the City of Jefferson be amended to allow unlimited open burning of yard waste,
paper and cardboard in designated containers, during daylight hours as set forth in the
initiative petition submitted to the City?"

Voters should be advised that Proposition 1 removes all penalties for open burning. The
elimination of penalties applies not only to yard waste, paper and cardboard but to any
other substance as well. Proposition 1 also requires that paper and cardboard be
burned in a suitable container with a wire mesh or metal rack top.
• Further, Proposition 1 removes the ability of the City of Jefferson to restrict open burning
for safety reasons.
If Proposition 1 passes, any individual in the City of Jefferson may maintain or authorize
to be kindled burned or maintain any open burning without permission of the City of
Jefferson.
