RESOLUTION N0 2739
• RESOLUTION RATIFYING EMPLOYMENT OF SPECIAL
COUNSEL AND FOR FURTHER EMPLOYMENT OF SAID
COUNSEL,
The City Council o£ the City of Lynwood does hereby
resolve as follows: !
1. That the law firm of Robertson, Aarney, Drummond and
Dorsey be employed as legal counsel to represent the City of Lynwood,
a Municipal Corporation; Ralph E. Darton, as Chief of Police of the
City of Lynwood; Irvin L. Brockman, as .Chairman of the Personnel
Board of the City of Lynwood; Roy Lincoln, Larry Pettijohn, Julius
Lipschultz, Louis Reggiardo, as Members of the Personnel Board of
the City of Lynwood, in the case heretofore filed in the Superior
Court of Los Angeles County, Compton Bran'ch, entitled: John M. Crow
v. The City of Lynwood et al. No. Comp.C.-1678, upon condition that
David Harney of said firm will personally conduct the defense of said
case in all the steps and proceedings in said case;
2. That it is further resolved that the City will pay said
law firm the sum of $150.00 for every day that the said David Harney
is required to, and actually makes an appearance in Court in connection
with the defense of said case; that the City will pay said law firm
further sums for the preparation of pleadings in connection with said
case as follows: A minimum of $50.00 and a maximum of $100.00 for
each pleading, depending upon the importance o£ and the time required
to prepare said pleading, that a"pleading" shall be deemed to include:
A deniurrer, an answer, a motion to strike from the pleadings, a motion
to strike testimony or documentary evidence from the record, other
formal written motions, except as follows: (a) where a written motion
o�r notice of motion is required, the affidavit or affidavits in support
o£ each motion or notice of motion and the motion or notice of motion,
shall be deemed to constitute a single pleading, and (b): routine
motions or notices of'motions, i,e., memorandum'to set case for trial
shall not be deemed a motion or notice of motion within the meaning
of that term as employed in this Resolution, trial briefs and memoranda

of points and authorities, except a memorandum of points and authorities
in support of a demurrer or motion or notice,of motion which shall be
deemed a part of the pleading to which it is attached. �
That it is fur.ther r�solved that the per diem and the
"pleading" fees hereinabove pr�vided for shall be deemed to includ"e
payment in full for all legal services performed by said law firm in
connection with the said case'in the Superior Court, including services
performed in preparation for trial, and in preparing and arguing a
motion for a new trial, but shall not be deemed to include any legal
services in connection with an appeal from an order or judgment of the
� Superior Court, nor any services in connection with a rehearing before
the Pereonnel Board in the event that a rehearing is ordered.
