RESOLUTION NO.03-42
RESOLUTION GRANTING PRELIMINARY PLAT
APPROVAL FOR MEDINA BUSINESS SUITES
WHEREAS, C&C Investments, LLP, a Minnesota limited liability partnership (the
"Applicant") has applied to replat certain land in Medina which is currently legally described as Lot
1, Block 1, Wild Acres, Hennepin County, Minnesota (the "Property"); and
WHEREAS, the preliminary plat of the Property was reviewed by the planning
commission on November 12, 2003, and, following a public hearing thereon as required by law, the
planning commission recommended approval of the preliminary plat, subject to certain terms and
conditions; and
WHEREAS, on December 2, 2003, the city council reviewed the preliminary plat for its
conformance with the ordinances of the city and the General Plan of Development to guide
development of the Property, considered the recommendations of the planning commission, and
heard the comments of the Applicant and other interested parties regarding the matter.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota that preliminary plat approval for Medina Business Suites is hereby granted, conditioned
upon the adoption and publication of an ordinance rezoning the Property to Planned Unit
Development and subject to the following terms and conditions:
1. The final plat must be in conformance with all requirements of the city engineer,
including all drainage, ponding and utility easements;
2. The final plat must be in conformance with requirements of Hennepin County;
3. The final plat must be in conformance with all requirements of the Elm Creek
Watershed District;

4. In lieu of dedication of land, the Applicant must pay a park dedication fee Of
$19,900 or such other amount as determined by the city staff in conformance with the city
ordinance. The fee shall be payable prior to issuance of the first building permit;
5. The Applicant must provide adequate title evidence for review by the city attorney;
6. The Applicant must pay an administrative fee to the city in an amount sufficient to
reimburse the city for the costs of reviewing the Planned Unit Development and preliminary plat of
the Property; and
7. The Applicant must submit the final plat of the Property for review by the city
within 180 days of the date of this resolution.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Workman, Lane, Smith, Brinkman
and the following voted against same: (Absent: Zietlow)
None
Whereupon said resolution was declared duly passed and adopted.
