AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, FOR
PROPERTY ADDRESSED AS 3401 AND 3405 TRUMAN BOULEVARD,CONSISTING OF PART OF
THE SOUTHEAST QUARTER OF SECTION 4, TOWNSHIP 44 NORTH, RANGE 12 WEST,
JEFFERSON CITY,COLE COUNTY,MISSOURI,BY REZONING 3.01 ACRES, FROM C-O OFFICE
COMMERCIAL, RA-2 HIGH DENSITY RESIDENTIAL AND RS-1 LOW DENSITY RESIDENTIAL TO
C-1 NEIGHBORHOOD COMMERCIAL.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would not necessitate a change to the
Comprehensive Plan Development Plan Map.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from C-O Office Commercial, RA-2
High Density Residential and RS-1 Low Density Residential to C-1 Neighborhood Commercial,
described as follows: Part of the Southeast Quarter of Section 4,Township 44 North, Range 12 West,

Beginning at the Southwest corner of Tract A,as described in Quit Claim Deed of record in Book 368,

Case No. P07030 - 3401and 3405 Truman Boulevard; Rezoning. Request filed by Brad
Hutchison, authorized representative, West Truman Partners LLP, property owner, to rezone
approximately 3.01 acres from C-O Office Commercial, RA-2 High Density Residential, and RS-1
Low Density Residential to C-1 Neighborhood Commercial. The property is located on the
southwestern corner of the intersection of West Truman Boulevard and Constitution Drive and is
described as part of the southeast quarter of Section 4, Township 44 North, Range 12 West,
Jefferson City, Cole County, Missouri.
Mr. Lake and Mr. Bickel announced that they will abstain on Case No. P07030.
Chairman Berendzen confirmed that all other regular members present, and alternates Mr.
Deeken, Mr. Jordan and Mr. Yarnell will vote on this case.
Mr. Brad Hutchison, 3200 Pembroke Square, authorized representative for West Truman
Partners, LLP, spoke regarding this request. He explained that the purpose of the rezoning is to
accommodate a hair salon, which is not a permitted use in the C-O, Office Commercial zoning district.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that the purpose of the rezoning
request is to enable partial use of the property for a personal service business (beauty salon).
Personal services, such as beauty shops, barber shops, spas, and tanning salons, are not permitted
in the C-O Office Commercial zoning district. However, personal service businesses are permitted in
the C-1 Neighborhood Commercial zoning district. Much of the property along Truman Boulevard is
zoned C-1 Neighborhood Commercial and the vacant land located at 3314 Truman Boulevard was
approved for rezoning to C-1 at the May 10, 2007 meeting of the Planning and Zoning Commission.
Staff recommends approval of the rezoning request.
SMr. Robinett moved and Mr. George seconded to recommend rezoning 3401 and 3405 West
Truman Boulevard from C-O, RA-2 and RS-1 to C-1, to the City Council. The motion passed 8-0 with
the following votes:
