RESOLUTION ASCERTAINING AND DETERMINING RATE
OF PER DIEM WAGES AND THE GENERAL PREVAILING
RATE OF PER DIEM WAGES FOR LEGAL HOLIDAYS AND
OVERTIME WORK IN THE LOCALITY FOR.EACH CRAFT
OR TYPE OF LABORER, WORKMAN, OR MECHANIC NEEDED
TO EXECUTE THE CONTRACT FOR FURNISHING AND DE-
LIVERING CERTAIN M3�`I`ERIALS AND SUPPLIES IN CON-
NECTION WITH THE.ABOVE MENTIONED IMPROVEMENT IN
ACCORDANCE WITH PLANS AND SPECIFICATIONS N0,
1956-G-3 IN THE MATTER OF THE PROPOSED IMPROVE-
MENT OF MURIEL DRIVE (WEST SIDE) BETWEEN 133.60
FEET SOUTH OF VIRGINIA AVENUE nrrD 133.54 FEET
NORTH OF JOSEPHINE STREET BY THE CONSTRUCTION OF
CONCRETE CURBS, GUTTERS, AND CROSS GUTTERS, T0-
GETHER WITH ALL INCIDENTAL AND APPURTENANT WORK.
BE IT RESOLVED by the City Council of the City of Lynwood,
California, as follows:
WI�REAS, pursuant to an Act of the Legislature of the State
of California, approved April 24, 1937, and known.as the."Labor Code,"
the City Council of the City of Lynwo,od is required to ascerta-in the
general prevailing rate of per diem wages for legal holidays and. over-
time work, in this locality for each craft or type of laborer, work-
man, or mechanic needed to execute the proposed. contract for the con-
struction of cement concrete curbs, gutters, and cross gutters, in-
cluding all incidental and appurtenant work on the west sid.e of
Muriel Drive lying between 133.60 feet south of Virginia Avenue and
133.54 feet north of Josephine Street, in aecordance.with Plans and.
Specifications No. 1956-G-3 on.file in the office of the City Clerk
of the said City of Lynwood,
NOW, THEREFORE, the City Council of the City of Lynwood
d.oes hereby resolve as follows:
Section 1: The City Council of the City of Lynwoad does
hereby ascertain and determine that the general prevailing rate of
hourly wages, in the locality in which said work or improvement is
to be d-one, for each craft or type of laborer, worlrnian, or mechanic
need.ed. to execute the contract for furnishing and d.elivering certain
materials and supplies in.connection with the improvement hereinabove
described. and in accord.ance with Plans and. Specifications No. 1956-G-3
on file in the office of the City Clerk of said.City, is as £ollows:

Proyided. that not less than one and. one-half times the
prevailing rate sha11 be paid for any working time more than eight
hours during any one calendar d.ay, and for time on Saturdays, Sund.ays,
and the several legal holidays, to wit: New Years Day, Decoration Day,
Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, and
Christmas Day.
Provided. that notwithstanding the general provisions con-
tained. herein, flagmen, guard.s and watchmen sha11 be paid one and- one-
half time the prevailing rate for overtime (overtime shall be time
worked in excess of eight hours per d.ay or forty hours per week), and.
the straight prevailing rate for time worked on Saturdays, Sundays,
and holid.ays where such time d.oes not constitute overtime.

The foregoing prevailing wage sched.ule is based. upon a.
working day of eight hours, and. in the.event that laborers, workmen,
or mechanics are employed less than eight hours per d.ay, the rate of
per diem wages shall be deemed. to be that fraction of the foregoing
rates that the number o£ hoursof employment bears to eight.
The rate of compensation for any classification not listed
in the schedule, but which may be required to execute the proposed.
work, sha11 be commensurate and in accord. with the rates specified
for similar and comparable classification or f'or those performing
similar or comparable d.uties.
