RESOLUTION OVERRULING PROTESTS IN CONNECTION
WITH Tf� HEARING ON DEBT LIMITATION FOR THE
, PROPOSED IMPROVEMENT OF MURIEL DRIVE (WEST SIDE)
BETWEEN 133.60 FEET SOUTH OF VIRGINIA AVENUE AND
133.5�+ FEET NORTH OF JOSEPHINE STREET BY THE
CONSTRUCTION OF CONCRETE CURBS, GUTTERS, AND
CROSS GUTTERS, TOGETHER WITH ALL INCIDENTAL AND
APPUR`ITENANT WORK.
WHEREAS, the.City Council of the City of Lynwood. d.id, on
the 7th day of November 1956 approve an investigation report under
the provisions o£ Diyision 4 of the Streets and. Highways Code, cited.
as "Special Assessment Investigation, Limitation and Majority Protest
Act of 1931" as amend.ed, upon the proposed improvement of Muriel Drive
(west sid.e) between,133.60 feet south of Virginia Avenue and. 1 33•5� -
feet north of Josephine Street, by the construction of concrete
curbs, gutters, and. cross gutters, together with all incid.ental and.
appurtenant work, as shown on Plan No. 1j56-G-2 on file in the office
o£ the City Clerk of said. City, and.
WHEREAS, sa.id report having been duly prepared. and filed,
a hearing was held by said. City,Council on the l8th d.ay of December,
1956 in the manner proyided in said Act above referred to; and.
WHEREAS, more than thirty days have expired since the date
of mailing notices of hearing on said report; ,
NOW, THEREFORE, the City Council o£ the City of Lynwood
d.oes hereby resolve as follows:
l. That the protests made at said. hearing on said. investi-
gation report be and. the same are hereby overruled..
2. That the public interest, convenience, and. necessity
require the doing and making o£ the public improvement set forth and.
described. in said report above referred to and. substantially in the
manner set forth;
3. That the project consisting o£ the proposed. improvement
a.bove referred. to is feasible, and that the land. to be assessed. will
be able to carry the burden o£ said proposed. assesament.
4. That the estimated total amount proposed to be assessed.
upon any or all lots or parcels of land.for the costs and. expenses
.
of said. proposed improvement d.oes not exceed the limitation of indebt-
ed.nes� established and set forth in said act above referred. to and
wi11 not, by the levy thereof, ca.use said. limitation to be exeeed.ed.
in any instance; `
5. No ma.jority protest has been filed. with the clerk of
the legislative bod.y by the owners of the property proposed. to be
assessed to pay the costs and expenses of said. proposed. improvement.
6. Tha.t it is hereby ord.ered. that the proceedings for the
making of s�id proposed improvement be undertaken pursuant to the
provisions of an Act of the Legislature of the State of California,
d.esignated as Division 7 of the Streets and. Highways Code,.cited as
��the "I�nprovement Act of 19ll,, and amendments thereto."
